Can a forced ideology be called morality?
What I am concerned with here when I say “forced ideology” is when an individual accepts an ideology because they were told to do so, whether this is from a personal authority figure, such as a parent, or something or someone more systemic, such as the military commander for drafted soldiers.  This should be contrasted to an ideology one rationally accepts, based on knowledge and self-reflection.  There is, of course, a very grey area here which is not easy to define, but I am currently most interested in a strong understanding of forced ideology.
If a person does a “good” act based on a belief system which they have not rationally accepted, is the act really good?  Or is the person good/moral?  If a child makes a conscience effort to not lie on Christmas Eve for fear of not getting presents from Santa (assuming the child has something to gain from lieing), has the child done good?
My instinct tells me no, the act is not necessarily morally good.  One may argue that refraining from lieing is an objective moral good and the intent plays no part.  I, however, cannot agree with this.  Discarding the objective/subjective arguments of morality for another day, I cannot believe actions should be divorced so coldly from intent.
At issue for me is “good” actions which are more based on routine or dogma as opposed to rational choice or desire.  However, it seems that this thought has implications on “evil” actions as well.  If blind acceptance to an ideology devalues the “good” of an action, then it must devalue the “evil” of an action.
If giving to the poor because you are told to do so is not a morally good action, then what about a solider who kills because he is told to do so?  Or perhaps to make it even more stark, what about a man who rapes a virgin for purification?
I have too strong an emotional response to such evil deeds and too strong a belief in individual responsibility to accept that.  But I have to admit that I do feel that the good acts are devalued because of this.   Perhaps this is just faulty thinking on my part, but I think it simply leads to a better conclusion.
It is blind acceptance that is the problem.  I believe that blind acceptance is intellectually criminal.  Individuals must have a personal and reasoned system of beliefs or they do not really have a belief system.  One of the real tests of a person’s character is how they act compared to what they believe in.  Those with a void for a true belief system (or an understood belief system) often find themselves doing things or acting in ways contrary to their ideology.  Or they act accordingly to their ideology but are miserable in the process.
Blind acceptance is an individual choice.  You might even say (in fact, I do) that it is a moral choice.  Not accepting responsibility for your beliefs or your actions does not make those beliefs or actions justifiable.
It just makes them stupid.

In his new book, "Total Recall," former California Gov. Arnold Schwarzenegger explains why he didn't want to talk to the media when it was discovered that he had fathered a child with the family housekeeper.
"I wanted to protect my family's privacy," Schwarzenegger writes, "which remains a priority of mine today."
That being the case, a question comes to mind. If Schwarzenegger wants to protect his family's privacy, what was he doing on "60 Minutes" Sunday night, talking about that affair and admitting to a number of others?

The simplest answer, I suppose, is that he was promoting the book. But that raises another question:
If Schwarzenegger cares about his wife and their four kids — or his former mistress and the child she had with him — why write the book at all?
Let's think about this. His wife, Maria Shriver, and the kids were gone for a week, and not only was Arnold bold enough to have Mildred Baena do a little extra "housework," but he was careless enough to get her pregnant in the family domicile. She later brought the child to the house to play with half brothers and half sisters, all of them unaware they were related, until the resemblance became a little too obvious.
And yet, after putting his family through all of that, after Maria filed for divorce and his family exploded, the 38th governor of the great state of California still thinks it's appropriate to memorialize the whole thing in book form and blab about it on national television?
"It's another case of Arnold being Arnold," a former Schwarzenegger advisor and longtime GOP consultant told me, saying his former boss was simply promoting the book and drawing attention to two upcoming movies. Like a shark in the ocean, he said, "Arnold's got a single-minded purpose to do what Arnold wants to do."
And he never lets contradiction get in the way.
"Secrecy is just part of me," he wrote in the book, explaining how he answered Shriver when she asked him why he hadn't confessed earlier. "I keep things to myself no matter what."
Secrecy would be a part of me, too, if I'd slept with the maid and my love child was running around the house under my wife's nose. Schwarzenegger writes that Maria had suspected the truth, but since he wasn't certain the child was his when she first asked, he denied it.
Schwarzenegger said on TV that Shriver hadn't read the book, which covers everything from his upbringing in Austria to his bodybuilding and Hollywood days, and I can understand why it wouldn't be at the top of her reading list. Imagine how she might react, though, if she were to read this passage in which Schwarzenegger writes about discussing the affair with his wife.
"I explained that it was my screw-up, that [Maria] should not feel that it had anything to do with her."
What a prince. The former Mr. Olympia did some cardio work with the maid while his wife was away, and he's not even blaming her.
"You're the perfect wife," he goes on, re-creating his conversation with her in the office of their therapist. "It's not because anything is wrong, or you left home for a week, or any of that. Forget that. You look fantastic, you're sexy, I'm turned on by you today as much as I was on the first date."
Classy guy, huh?
Maybe he'll invite her to the sophomore prom and try to patch things up. And he can pick her up in the fantastic new idiot-mobile he drove on "60 Minutes," a $250,000 Mercedes Unimog truck that looks like a Hummer on steroids.
Poor Maria. And poor Arnold. He's unlikely to find another woman who would have stood by him through his denials about all those groping stories during the recall of Gov. Gray Davis. She even stayed true after Schwarzenegger said that although "most" of the groping allegations were false, he wasn't denying bad behavior. As he put it, "where there's smoke there's fire."
Say again?

GOP Lawmakers Want to Ditch Healthy School Lunch Rules

What Obesity Problem? Two Congressmen try to add more calories to school lunch.

Now that we’re all officially back to school (yes, we’re looking at you, Chicago), the 32 million students who participate in the National School Lunch Program have probably noticed a change in what’s on their lunch plates.
More fruits, vegetables, whole grains, low-fat milk, and a cap on the number of calories being served.
Kids in kindergarten through fifth grade are limited to 650 calories. For seventh and eighth grade, that
number bumps up to 700 calories, and high school students are capped at 850 calories. Why? It’s part
of the updated guidelines called for in the 2010 Healthy, Hunger-Free Kids Act.
One in three American children today is overweight or obese. Many health experts agree that limiting the
calories on the plate is a good starting place to address the epidemic, particularly when we know that many
children consume nearly half their daily calories at school.

But U.S. Reps. Steve King, R-Iowa, and Tim Huelskamp, R-Kan., are trying to repeal the calorie cap with
their No Hungry Kids Act, H.R. 6418, introduced by King last week. Never mind that the calorie
recommendations are based on the Dietary Guidelines for Americans and studies done by the Institute of
Medicine, and are similar to recommendations made by the Mayo Clinic, the American Heart Association
and others.

They argue in part, that athletes, like football players, aren’t getting the calories they need, and show up
at after-school practice hungry. Regan Hopper, a spokesperson with the USDA Food & Nutrition Service,
says that’s not the case.
“Local schools do have flexibility in the meal patterns to make available more fruits and vegetables or a
second carton of milk. There are also after-school snack programs that schools can look into for students,”
Hopper tells TakePart. “We have an obesity epidemic; we must address it.”
But King’s bill specifically would eliminate the new calorie limits.  
“The misguided nanny state, as advanced by Michelle Obama's 'Healthy and Hunger
Free Kids Act,' was interpreted by Secretary Vilsack to be a directive that, because
some kids are overweight, he would put every child on a diet,” King says in a statement that sounds
more politically motivated than it does concerned over what kids are being served for lunch.

In fact, the jab at USDA Secretary Tom Vilsack is likely a poke at his wife too.
Christie Vilsack is running for office, vying for the very seat King is hoping to keep, and her prospects
look good.
“GOP internal polling shows a single-digit race, with King picking up less than 50 percent of the vote.
This week, one plugged-in national Republican privately named King as one of the five GOP
incumbents most likely to not return to Congress next year,” writes Shira Toepliz for Roll Call.
And according to Politico, Pete Sessions, the National Republican Congressional Committee
chairman, had a “Come to Jesus” talk with King recently.
We don’t know if that scolding had anything to do with King’s No Hungry Kid bill, or if it was related
to some of his other policy moves, like the midnight egg amendment he slipped into the 2012 Farm Bill.
But what we do know is King has a seat on the powerful House Agriculture Committee, and that this
congressional race is one to watch closely if you’re concerned with critical food issues.
And for the super-wonks in the crowd, King isn’t the only Ag Committee member whose reelection is
uncertain. Keith Good over at FoodPolicy.com has the list of races that include committee members
embroiled in several tight races. Will inaction on the 2012 Farm Bill revamp the House Ag Committee?
We’ll know come November.

(AP) Homeland Security says border patrol agent killed
WASHINGTON
A U.S. Border Patrol agent was killed and another wounded in a shooting near the U.S.-Mexico border in Arizona, the Department of Homeland Security said Tuesday.

The agents were involved in a shooting near the Brian Terry Station near Naco, Arizona, on early Tuesday.

The wounded agent was airlifted to a hospital after being shot in the ankle and buttocks, according to the department.

The agents were assigned to the Naco, Ariz., station about 100 miles southeast of Tucson.

Univision Reports More Disturbing Information on Fast and Furious

The Spanish language television news network Univision unleashed a bombshell investigative report on Operation Fast and Furious Sunday evening, finding that in January 2010 drug cartel hit men slaughtered students with weapons the United States government allowed to flow to them across the Mexican border.
“On January 30, 2010, a commando of at least 20 hit men parked themselves outside a birthday party of high school and college students in Villas de Salvarcar, Ciudad Juarez,” according to a version of the Univision report in English, on the ABC News website.
“Near midnight, the assassins, later identified as hired guns for the Mexican cartel La Linea, broke into a one-story house and opened fire on a gathering of nearly 60 teenagers. Outside, lookouts gunned down a screaming neighbor and several students who had managed to escape. Fourteen young men and women were killed, and 12 more were wounded before the hit men finally fled.”
Citing a Mexican Army document it obtained and published, Univision reported that “[t]hree of the high caliber weapons fired that night in Villas de Salvarcar were linked to a gun tracing operation run by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF).”
That operation was Fast and Furious.
So, our guns were used to gun down 16 teenagers and wound 12 more.
If you are not familiar with Fast and Furious, and I don’t blame you if you are not, Fast and Furious is a gun tracing operation run by the ATF (Bureau of Alcohol, Tobacco, Firearms and Explosives), where nearly 2,000 guns went unaccounted for. According to Mexico’s former Attorney General, approximately 300 Mexicans have been killed by Fast and Furious guns. Nearly 2,000 high-powered weapons “walked” across the border to Mexico and were used by Mexican drug cartels that murdered hundreds of innocent people, including these teenagers. You may remember a gun from Fast and Furious was also used to kill U.S. Border Patrol agent Brian Terry.
According to ABC News, “Univision News identified a total of 57 more previously unreported firearms that were bought by straw purchasers monitored by ATF during Operation Fast and Furious, and then recovered in Mexico in sites related to murders, kidnappings, and at least one other massacre.”
Although the mainstream media have tried their best to ignore Fast and Furious, Univision, which is no conservative place, feels a bit differently about it since it is Mexicans that are being brutally murdered with our guns.
Texas is involved in this as well.

  • Fast and Furious also included groups, criminal activities, and organizations that involved corrupt law enforcement.
  • The roots of this operation included local law enforcement departments in the state of Georgia, who used unethical confidential informants to run drugs, threaten people by use of coercion and code of silence.
  • Former Sheriff Victor Hill was directly involved in not logging evidence and putting drugs back out onto the street. Victor Hill was witnessed with a trunk load full of missing/unaccounted weaponry.
  • The late Sheriff Dee Stewart had stolen property on his own land.

Mitt Romney's cringe-worthy moment with Texas Gov. Rick Perry last year.

Mitt Romney and President Obama will attempt their most statesmanlike poses for Wednesday night’s debate in Denver, but there is one dichotomy that could break the congenial facade: Obama likes to interrupt. Romney doesn’t like to be interrupted.
When he took on John McCain in the 2008 debates, then-Sen. Barack Obama showed no hesitation at jumping in when he thought his opponent had misrepresented his positions. He didn’t wait for moderator Jim Lehrer to call on him or until the end of McCain’s remarks.

“That’s not the case,” and “That’s not true,” Obama interjected when McCain suggested that top military leaders judged the Democrat’s Afghanistan withdrawal proposal to be too precipitous. And when McCain suggested Obama would meet willy-nilly with Iranian President Mahmoud Ahmadinejad, Obama cut in: “Nobody's talking about that.”

DEBATE QUIZ: Who said it?

Romney participated in one of the monumentally cringe-inducing moments of the primary campaign season, courtesy of Texas Gov. Rick Perry — who took a tough shot at the Republican front-runner, then repeatedly interrupted his attempts to respond.

The two were among a throng of GOP candidates on stage last October in Las Vegas, when Perry challenged Romney on immigration reform. Playing off a news report in the Boston Globe, Perry accused the former Massachusetts governor of hiring illegal workers at his home. “The idea that you stand here before us and talk about that you are strong on immigration is on its face the height of hypocrisy,” Perry said.

Romney forced out a laugh that sounded as mirthful as a chain saw, “Ha. Ha. Ha. Ha.” He then denied hiring illegals immigrants and said he would give Perry the facts. No, “I’ll tell you what the facts are,” Perry interjected. Romney tried again to proceed with his rebuttal (in which he eventually explained that a contractor had failed to properly check the workers’ documents) but Perry took another shot: “It’s time for you to tell the truth, Mitt.”

Romney then reached a hand into Perry’s air space and laid it on Perry’s shoulder for several seconds. He first appealed, plaintively, for moderator Anderson Cooper to jump in. Cooper looked amused. Romney then became exasperated and, sounding like a hectored spouse, tried: “Would you please wait?” and “Are you just going to keep talking?” and “Let me finish what I have to say.”

The mannerly Romney wasn’t all sweetness, though. He suggested Perry had lit into him because “this has been a tough couple of debates and I understand that, so you’re going to get testy.” Perry’s eyes narrowed and seemed to turn dark with anger, which Romney answered with another aw-shucks protestation: “Look, let me take my time and then you can take your time, all right?”

It amounted to a remarkably asymmetrical verbal fusillade, Romney both posing as the victim and perfect gentleman, his honor in danger of being tainted, while he unleashed wicked broadsides at Perry’s management of Texas — not aggressive enough about building a border wall and offering scholarships to undocumented students.

Romney finished his answer with a couple of gems. “You have a problem with allowing someone to finish speaking,” he said, turning to face Perry at the adjacent lectern, “and I suggest that, if you want to become president of the United States, you have to let both people speak, so let me speak.”

Romney got a chance to complete his answer and it included this memorable line, which he said he had delivered to his contractor: “I’m running for office, for Pete’s sake. I can’t have illegals.”

U.S. gathers information about possible targets in Libya

U.S. intelligence and the Pentagon have begun assembling preliminary information about potential targets and militant personnel in Libya that could be struck if President Barack Obama ordered such action.
A senior U.S. official, who declined to be identified because of the sensitive nature of the information, confirmed details to CNN, noting the United States would likely seek cooperation from Libya before launching any military strike.
Some of the details were first reported by the New York Times.
The stepped up effort is in response to the September 11 attack on the U.S. consulate in Benghazi that killed Ambassador Christopher Stevens and three other Americans.
U.S. intelligence has said it believes the attack was "a deliberate and organized terrorist assault carried out by extremists" affiliated or sympathetic with al Qaeda.
CNN reported previously that U.S. drones have been collecting intelligence in eastern Libya for weeks, and that American intelligence agencies are eavesdropping and intercepting suspected insurgent communications.
The official offered repeated caution about the effort. While he acknowledged that "options are being teed up," he said "don't think that a final list of who was involved is solid."
He said any early list of targets or personnel is part of standard target planning and is "highly pre-decisional," noting that the president would have to decide whether to launch a strike.
The official repeatedly noted the standard job of the intelligence community and the military is to prepare options for the president if he asks for them, which he has not.
The current effort involves assembling so-called "target packages." A target package includes the intelligence matched to a specific site earmarked for a potential strike.
It also includes intelligence justifying a potential strike against any enemy personnel being targeted and a specific calculation on how civilian casualties would be avoided.

(Reuters) - A mortar bomb fired from Syria landed in a residential district of the southeastern Turkish town of Akcakale on Wednesday, killing a woman and four children from the same family and wounding at least eight other people.
A cloud of dust and smoke rose up over low-rise buildings as residents ran to help the wounded. Others, infuriated by the increasing spillover of violence from Syria's civil war, took to the streets shouting protests against the local authorities.
Foreign Minister Ahmet Davutoglu phoned U.N. Secretary General Ban Ki-moon to brief him about the incident and also spoke with senior military officials and Syria crisis mediator Lakhdar Brahimi, his ministry said in a statement.
Davutoglu signaled over the weekend that Turkey would take action if there was a repeat of a mortar strike which damaged homes and workplaces in Akcakale last Friday.
"It (latest mortar round) hit right in the middle of the neighborhood. The wife and four children from the same family died," Ahmet Emin Meshurgul, local head of the Turkish Red Crescent, told Reuters, adding he knew the victims personally.
"People here are anxious, because we got hit before. Security forces tried to convince people to empty the neighborhood near the border, but now we've been hit right in the middle of the town," he said.
A Reuters witness saw three police officers among the wounded being taken to hospital.
Prime Minister Tayyip Erdogan long cultivated good relations with Assad but became a harsh critic after Syria's popular revolt began last year, accusing him of creating a "terrorist state". Erdogan has allowed Syrian rebels to organize on Turkish soil and pushed for a foreign-protected safe zone inside Syria.
GUNFIRE STRAYING OVER BORDER
Syria's worsening bloodshed has increasingly affected border zones, with stray bullets flying into Turkish territory.
"Over the last 20 to 25 days there have been very heavy clashes on the Syrian side. We have felt the effects of these in Akcakale," Labor Minister Faruk Celik, an MP for the province where Akcakale is located, told parliament.
In April, Turkey reported an incident to the United Nations in which at least five people, including two Turkish officials, were wounded when cross-border gunfire struck a Syrian refugee camp in Kilis, further west along the frontier.
Turkey beefed up its troop presence and air defenses along its 900-km (560-mile) border after Syria shot down a Turkish reconnaissance jet in June. But residents in Akcakale said there was still not enough security.
"People here are rising up, there is no security. People were chanting for the local governors to resign," local resident Ibrahim Halil Arslan told CNN Turk television.
"Everybody here is so anxious. We keep our children locked at home, and we are trying to live under this psychological pressure," he said.
Washington sees Turkey as the pivotal player in backing Syria's opposition and planning for the post-Assad era. But Ankara has found itself increasingly isolated and frustrated by a lack of international consensus on how to end the conflict.
Turkey is also sheltering more than 90,000 refugees from Syria and fears a mass influx similar to the flight of half a million Iraqi Kurds into Turkey after the 1991 Gulf War.

Postal Service defaults on $5.6B retiree pre-payment

5:13PM EST October 1. 2012 - Because of congressional inaction, the U.S. Postal Service today defaulted on a $5.6 billion pre-payment for future retiree health benefits, the second such default in two months.
The Postal Service missed a $5.5 billion payment in August, bringing the missed pre-payments to $11.1 billion for the fiscal year that ended Sunday. Overall, the postal service expected a $15 billion deficit for last year, and a projected shortfall of $238 billion over the next 10 years.
Congress mandated the early funding in 2006. No other government agency or private business is required to make such over-payments.
Despite the defaults, "customers can be confident in the continued regular operations," Postmaster General Patrick Donahoe said in a statement.
"We will continue to deliver the mail and pay our employees and suppliers. Postal Service retirees and employees will also continue to receive their health benefits," Donahone said, noting that current retirees' health care is paid from the agency's general operating budget.
"Comprehensive reform of the laws governing the Postal Service is urgently needed in order for the Postal Service to fully implement its five-year business plan and return to long-term financial stability," Donahoe said.
Facing declining mail volume, the Postal Service has proposed several sweeping measures to reduce losses, including ending Saturday delivery, closing mail handling centers, reducing staffing, cutting local post office hours and starting new shipping services to compete with UPS and Fedex.
The Senate has passed legislation to restructure the Postal Service that would allow it to tap into its retiree overpayments, allow some proposed changes, but not eliminate Saturday delivery. (Read a summary.) The House has declined to act on similar bills. Congress recessed last month until after the November election.
A spokeswoman for House Majority Leader Eric Cantor, R-Va., would not comment last week on whether the lame-duck session would take up postal-restructuring, says theFederal Times, published by Gannett, USDA TODAY's parent.
In reporting today's default, Government Executive writes, "Congress has punted on the question of a solution until after the election. Expect Congress to fight Postal Service efforts to put ending Saturday delivery on the table as well as closing many rural post offices." The four postal unions are also challenging proposals to shutter processing centers or reduce post office hours, and to end no-layoff guarantees in future contracts.
Before the August default, one of the unions, the National Association of Letter Carriers,noted in a press release that the Postal Service "already has $45 billion set aside for future retiree health benefits – more than any other organization in America – and yet Congress wants to drain still more from the USPS."

'Real' Unemployment Rate Shows Far More Jobless

While the national unemployment rate paints a grim picture, a look at individual states and their so-called real jobless rates becomes even more troubling.

The government's most widely publicized unemployment rate measures only those who are out of a job and currently looking for work. It does not count discouraged potential employees who have quit looking, nor those who are underemployed — wanting to work full-time but forced to work part-time.
For that count, the government releases a separate number called the "U-6," which provides a more complete tally of how many people really are out of work.
The numbers in some cases are startling.
Consider: Nevada's U-6 rate is 22.1 percent, up from just 7.6 percent in 2007. Economically troubled California has a 20.3 percent real rate, while Rhode Island is at 18.3 percent, more than double its 8.3 percent rate in 2007.
Those numbers compare especially unfavorably to the national rate, high in itself at 14.9 percent though off its record peak of 17.2 percent in October 2009.
Only three states — Nebraska (9.1 percent), South Dakota (8.6 percent) and North Dakota (6.1 percent) — have U-6 rates under 10 percent, according to research from RBC Capital Markets.
Election battleground states paint a picture not much more flattering. Florida's U-6 number is an ugly 17 percent, though Pennsylvania and Ohio are both around 14 percent, below the national U-6 average.
The numbers come as the government prepares to release its latest reading, the July nonfarm payrolls number, on Friday. Economists expect the report show about 100,000 jobs created for the month and the traditional "U-3" rate to hold steady at 8.2 percent.
"The lack of improvement in state U-6 rates continues to be troubling," Chris Mauro, head of US Municipals Strategy at RBC, said in a research note. "While down from recent peaks, state U-6 levels remain dramatically higher than they were in 2007 and 2008."
Mauro used the numbers to demonstrate that investing in municipal bonds remains a challenge because high real unemployment rates will be a drain on local finances.
"We remain concerned about the corrosive influence that these stubbornly high U-6 rates may have on both consumer sentiment and state and local tax revenues," he said. "At current levels, these U-6 rates will continue to be a drag on credit quality."

JUDICIAL REFORM,

The opening statement of the Constitution declares that we, the people of the United States, as one of our main duties is to provide for the common defense. This means that the people are the government, not the government as a separate entity, so that we decide as taxpayers how our money meets the needs of domestic peace and tranquility.

Article I, Sec. 8 determines that the power to declare war resides with Congress, and that no appropriation shall be made longer than two years to raise and support an Army.

At this time, Vice President Joe Biden, Senator John McCain, and Senator John Kerry are authorized to sign a declaration of war jointly, or any emergency military order as required by military command or conference. Obama has been relieved of signature authority, Vice President Biden is acting Commander-in-Chief.

Given these provisions of the Constitution listed above, it is necessary to revisit our commitments to other countries that fall under diplomacy operations and those that actually fall under the regular defense budget. There has been a lot of political discourse regarding “unconstitutional wars, endless war spending, and endless wars”, but these are misnomers when it comes to approving an annual defense budget and defining our previous and current national security needs.

Our war has always been against the enemy Al Qaeda, and the bulk of our military spending has been in pursuit of that enemy going on eleven years. After ending the Iraq War, that has been likened to my generation’s Vietnam, it is also necessary that we promote a military budget that is reasonable and does not use sequester, an across-the-board percentage cut, without thorough examination of the 2013 defense bill and what our military is requesting to carry out operations.

A sequester is a default mechanism, usually used for annual business budgeting, but given that defense is the first priority of a Constitutionally-funded model budget and that the Senate has failed to produce an annual budget for 4 years straight and has been operating on a continuing resolution, we have averted 5 government shutdowns, and we pray to avert a 6th on 9/30/12.

*I would like to note that this process had gotten so political, so weighed down with ire and rhetoric for failure to even write a Constitutional budget, that the Tea Party and Paul Ryan took over this process. Paul Ryan wrote a deficit reduction budget called the Path to Prosperity, based on the works of Tom Coburn and others, which came forth from the very heated debate over the debt ceiling in the Summer of 2011, so the Tea Party drafted a working budget based on actual physical revenue trend, (in order to reach a target of deficit control and a path toward paying off our deficit annually).


After review, Bush Tax Cuts offset the inflation of the costs of the Iraq and Afghanistan Wars to avoid a tax revolt during times of conflict. However now that Afghanistan is considered a matter of diplomacy operations in alliance with Karzai, those costs must be monitored effectively for approval of the 2013 defense budget.  

The problem is, the Bush Tax Cuts caused us to borrow to pay Congress’ salaries over the past 10 years, and while this is not specifically about the 2013 defense appropriation bill, it is worth noting that Congress while in session works 12, 13, and 14 hour days at times, meets endlessly, and then while on break they meet with constituents.

We are not the part-time Congress of the Founding Fathers, who took off seasonally to manage domestic affairs and work. Congress may need to consider a reduction in their salary of $200 billion from last year to this year, to cause us not to borrow, unless those cuts are found.

Congress’ salary is $1 trillion annually, plus the $700 billion in interest that hits us every 5-6 months. While we would all like to get off of the continuing resolution model, it is imperative that everyone presents a budget to get a public consensus about how the government appropriates and carries out funding of each program. Failing to write a budget will be met by the wrath of voters, and Congress has been appealed to order misappropriation and remuneration charges over Obamacare, a $2 trillion tax increase that was just cremated by the House, for not providing any health insurance whatsoever.

Without a budget, the Democrats leave their constituents’ voices unheard and misrepresented to a cacophony of shouting and wasted floor time debating bills that aren’t even at hand.

Seeking balance, the 2013 TEA PARTY BALANCED BUDGET $3.5 TRILLION ANNUAL REVENUE https://docs.google.com/spreadsheet/ccc?key=0Aq5m9QEGEZpOdFVCTlNEMTc1VW41bGZoOXRWdzlHVkE#gid=0 has been written to reflect the expiration and sunset of the Bush Tax Cuts, so that Congress is paid without having to borrow or pay the interest for their salaries. This will not only balance our domestic spending to our needs of national defense, this budget places us with a $25 billion down payment on our deficit, free and clear. This way the books are balanced going into 2013, and any additional revenue can be applied toward deficit reduction, as we begin to implement the Path to Prosperity proposals by March of 2013.

To discuss these matters specifically related to the 2013 defense budget, we ask that $600 billion be appropriated for general military operations, $200 billion for requiring anyone under 25 to get their Master’s degree for education/retraining purposes, and $200 billion for defense projects. The project list was due 8/1/12, when I attended the meeting, I did not hear of the projects or who had theirs ready for review.

  • We have abandoned the need for consideration of revisiting the military draft, unlike Israel. We want a volunteer Army, because we believe that our military works best that way, and we want our soldiers to function well in the private sector. We are making education a requirement, and we want no one under the age of 25 on front line duty, because the brain has not fully developed. This may cause some criticism from the military and how it chooses to operate, but we have to operate more wisely than we have in the past in recruiting, training, and retention of personnel.
  • Defense projects are to be submitted and approved by Allen West. He is an asset to be in a position of having served and to be able to communicate with military personnel with relative disclosure in being mindful that not everything must be left to public scrutiny.
  • I found the 2013 defense budget well constructed and easy to read, despite the repetition and long list of equipment, I was eventually able to tabulate the cost, but we need a different scoring system in the margin for legislation anyway.



In short, we ask that no defense cuts be made by percentage calculation or with respect to the annual budget, because we find that the 2013 defense budget takes taxpayer dollars into consideration, and that it is not asking for any increases but a preservation of operations.

We must take that into consideration as taxpayers, that our military has more than met their obligations and given us a 5 time renewal of Army to complete the task of our generation against Al Qaeda. We must also respect that our fight is not quite finished, that we have smoked out Al Qaeda in Yemen, and that with the help of Iraq, we now have Al Qaeda cornered in Syria. While we are looking forward to a time of peace and a time when the Middle East tension with neighbors subsides, we know that these are all factors of a delicate balance of operations and quality intelligence.

In order to prevent this sequester and to pay Congress, we are cutting $200 billion from the Judiciary, until they get serious and prioritize processing violent offenders and preventing abuse of tax dollars.
We also propose a measure that should sit well with those against capital punishment and those who
are tired of supporting terrorists, murderers, rapists and pedophiles to be housed for life sentences:
We will begin phasing out maximum security wards to isolating prisoners to Johnston Atoll.

With the invention or perfection of drones, we will be able to remotely secure prisoners on this deserted and abandoned military base. Johnston Atoll or Drone Island will function like exile, except we will know when the elements have taken a prisoner, as opposed to lethal injection costs and life sentencing housing costs:

We find that life sentencing is a cruel and unusual punishment to taxpayers, who are forced to subsidize violent criminals’ sustenance, and it is cruel and unusual to deny someone the punishment their offense such deserves, an injustice that carries with it enormous impunity and consequently the perpetuation of violent crime trends. With these reforms in place and implementation of “The Military Sequester Prevention Act of 2012”, we can not only help to reduce terrorism but other forms of violence in society, and in conjunction with the proposed use of Johnston Atoll, we ask that any existing law still in place for lack of a Senate vote taken on Obamacare, that the House begin redirecting funds appropriated to Planned Parenthood by Obamacare or H.R. 4872 to be implemented for the cost of plane travel and parachute for prisoners phased out to Johnston Atoll.

Failure to adhere to this budget or these proposals will bring further audit of federal prison costs and reforms, including deportations to country of origin to deserted areas like Johnston Atoll, for taxpayers do not have to sustain global terrorism through prison bases contrary to their well being, or gangs for twenty years to life.

We urge the Senate to act in passing the 2013 defense budget, as written, with the military to apply the reforms listed herein. If the Senate does not, we will pursue cutting the salaries of Senators by $200 billion, for creating a defense vacuum between now and 9-30-12, with our military unable to approve their project lists that were due on 8/1/12. The Department of Homeland security is also being considered for reductions, as well as other underperforming domestic agencies.

The DEC Program trains police officers and other approved public safety officials as drug recognition experts (DREs) through a three-phase training process:
  1. Drug Recognition Expert Pre-School (16 hours)
  2. Drug Recognition Expert DRE School (56 hours)
  3. Drug Recognition Expert Field Certification (Approximately 40 – 60 hrs)
The training relies heavily on the Standardized Field Sobriety Tests (SFST’s), which provide the foundation for the DEC Program. Once trained and certified, DREs become highly effective officers skilled in the detection and identification of persons impaired by alcohol and/or drugs. DREs are trained to conduct a systematic and standardized 12-step evaluation consisting of physical, mental and medical components.
Because of the complexity and technical aspects of the DRE training, not all police officers may be suited for the training. Experience has shown that training a well-defined group of officers proficient in impaired driving enforcement works well and can be very effective.
The DRE classroom training is designed to assist the student achieve three broad goals and eight specific learning objectives.
Goals:
  1. Determine if an individual is under the influence of a drug or drugs other than alcohol, or the combined influence of alcohol and other drugs, or suffering from some injury or illness that produces similar signs to alcohol/drug impairment;
  2. Identify the broad category or categories of drugs inducing the observable signs and symptoms of impairment; and
  3. Progress to the Field Certification Phase of the training.
Objectives:
  1. Be able to describe the involvement of drugs in impaired driving incidents;
  2. Name the seven drug categories and recognize their effects;
  3. Describe and properly administer the psychophysical and physiological evaluations used in the drug evaluation and classification procedures;
  4. Prepare a narrative drug influence evaluation report;
  5. Discuss appropriate procedures for testifying in typical drug evaluation and classification cases, and;
Maintain an up-to-date DRE curriculum vitae.

ARIDE: A Training Option Bridging the GAP Between SFST and DRE

The Advanced Roadside Impaired Driving Enforcement (ARIDE) program was developed by the National Highway Traffic Safety Administration (NHTSA) with input from the International Association of Chiefs of Police (IACP) Technical Advisory Panel (TAP) and the Virginia Association of Chiefs of Police. ARIDE was created to address the gap in training between the Standardized Field Sobriety Testing (SFST) and the Drug Evaluation and Classification (DEC) Program.
The SFST program trains officers to identify and assess drivers suspected of being under the influence of alcohol while the DEC Program provides more advanced training to evaluate suspected drug impairment. The SFST assessment is typically employed at roadside, while an officer trained as a drug recognition expert (DRE) through the DEC Program conducts a drug evaluation in a more controlled environment such as a detention facility.
ARIDE is intended to bridge the gap between these two programs by providing officers with general knowledge related to drug impairment and by promoting the use of DREs in states that have the DEC Program. One of the more significant aspects of ARIDE is its review and required student demonstration of the SFST proficiency requirements. The ARIDE program also stresses the importance of securing the most appropriate biological sample in order to identify substances likely causing impairment.
ARIDE is a 16-hour training course and may be taught by DREs, DRE instructors or SFST instructors who are also DREs. The training will be conducted under the control and approval of the DEC Program state coordinator. NHTSA and IACP highly recommend that principal instructors for this course be state-qualified and IACP-credentialed DRE instructors; that is, they (1) hold currently valid certificates as DREs; (2) have completed the NHTSA/IACP DRE Instructor Training Course; and (3) have completed the required delivery of both classroom and certification training, under the supervision of credentialed DRE instructors. At minimum, a qualified DRE with instructor credentials in other fields of occupational competency (not necessarily a DRE instructor) can be utilized to present ARIDE materials if instructor resources are limited and can not be resolved at the state coordinator’s level without undue hardship.
A qualified SFST instructor could instruct segments one through three leading to the preparation and evaluation of participants during the SFST proficiency examination. In addition to their occupational competencies, all instructors must be qualified trainers. They need to understand, and be able to apply, fundamental principles of instruction. Perhaps most importantly, they need to be competent coaches. Much of the classroom training is devoted to hands-on practice. The quality of coaching will have a major impact on the success of those practice sessions.It is highly recommended that every instructor be a graduate of the NHTSA/IACP DRE Instructor Training Course.
Some agencies may wish to enlist instructors with special credentials for certain blocks of instruction. For example, a physician would be well qualified to assist or teach session IV, and a prosecutor might be a good choice for session VIII.
The training also promotes interaction with representatives from the state’s prosecution community. Part of the course is intended to be taught by a local prosecutor or the state’s traffic safety resource prosecutor (TSRP).
The ARIDE program was successfully piloted in Connecticut, Kentucky, Washington and West Virginia. These states were selected based on NHTSA’s desire to have representation in the pilot study from states with, and without, the DEC program. Seven pilot courses trained 205 law enforcement officers, prosecutors and toxicologists. Law enforcement represented 186 (90%) of the participants. Sixty-seven percent were from local law enforcement and 23% from state police agencies.

Prosecuting the Drugged Driver: A Trial Advocacy Course

The Prosecuting the Drugged Driver is a curriculum developed in cooperation by NHTSA and the National Traffic Law Center. This course is designed to create a team building approach between prosecutors and law enforcement officers to aid in the detection, apprehension, and prosecution of impaired drivers. Prosecutors and law enforcement officers participate in interactive training classes taught by a multidisciplinary faculty.
The course begins with an overview of the drug-impaired driving problem in the United States and the substantive areas of training that police officers receive to be certified as a drug recognition expert (DRE). Learning about drug categories, signs and symptoms of drug influence, the role of the DRE in establishing impairment, and the role of toxicology in these cases will assist the prosecutor in developing methods for effectively and persuasively presenting this information in court. The course also addresses how to qualify the DRE as an expert witness in court and how to respond to common defense challenges.
Each participant has the opportunity to prosecute a mock case including the opportunity to conduct a direct examination of a DRE and a toxicologist. Each phase of the trial is videotaped. Participants receive critiques of the live and videotaped presentations from experienced faculty. Throughout every stage of the course, participants receive direct feedback on their courtroom skills with assistance in how to compose more persuasive arguments and deliver more dynamic presentations.

Article I, Sec. 8 of the Constitution declares that the power to establish uniform rules of naturalization and bankruptcies remain with Congress, under the power to lay and collect taxes.

Congress retains that Immigration policy is in place, and because of rampant tax evasion, other reforms were proposed last year when Obama’s Dream Act was determined to be an illegal amnesty program, and not true Immigration Reform:

Congress also retains that state Governors are not compelled to uphold any decree, declaration, or policy of the Obama Administration that does not originate or pass as law from Congress.

Article I, Sec. 9 maintains that only 1,808 shall be admitted into the states, and a duty imposed of $10. While this is an old policy, it was never meant to be undone without amendment, by the laissez-faire enforcement during the days of Speaker Gingrich.
Any state, not adhering to these guidelines will be subject to federal funding cut to their Judiciary for failure to preserve the integrity of elections and prevent tax evasion. Any submissions to the federal government past the limitations of the Constitution will be investigated for fraud, and penalized in federal court.

Any person, attempting to defraud the United States of a fair and free election as was done in 2008, will serve five years in jail, or to be determined by the judge in the form of probation fines and fees, and their voting rights and citizenship will be delayed for a period of 10 years for circumventing current laws regarding elections, taxation, and citizenship.

Every state must disqualify from the ballot and strike Obama’s name for not meeting the natural born citizen clause requirements. Vice President Biden’s name may remain, but Obama’s name must be removed until he provides proof of his hospital records to each state, as Kapi’olani records have been forged.

NO SOCIAL SECURITY IS TO BE DISTRIBUTED TO ANYONE WHO IS NOT A NATURAL BORN CITIZEN, TO CIRCUMVENT TAXATION REQUIREMENTS FOR REMUNERATION, NOR ARE ANY VOTER ID CARDS ARE TO BE ISSUED TO ANYONE WHO CAN NOT PROVIDE PROOF OF CITIZENRY, (not just a residential address and driver’s license, as Obama’s immigration policy tries to circumvent current election laws for remuneration and purposes of fraud.)

In summary, any portion of Obama’s proposed Immigration policy is null and void, as set forth by the Constitution and the current laws of Congress, and any state participating in these acts of fraud will be penalized to the fullest extent of federal law.
IMMIGRATION REFORM WE DID NOT HAVE THE MONEY TO ENACT FOR DIPLOMATIC BORDERS:

In accordance with current federal immigration laws and standards of citizenship, it has been brought to our attention routinely that President Barack Obama is not authentically a citizen of the United States, but of Kenyan birth. Even Africa has responded on the matter, sufficing to say that they knew about Obama’s ways before we did, to misrepresent himself and motives for campaigns, and Africa cites his cousin Raila Odigna’s election issues and violence. Africa also complains that Obama has recently dumped $60 million taxpayer dollars into an abortion clinic in Uganda, for idol worship purposes of child sacrifice. Obama entered into a contract with the goddess Mami Wata, titled H.R. 4872, for the mass federal funding of abortions, and he justified this by saying the abortions would pay for themselves with the money made off of carcass harvesting, with the bodies being sold for stem cell research.

Therefore, with our moral and lawful objections to Obama’s Presidency and the Impeachment Decree being drafted presently, we must uphold and enforce current federal laws, up to applicable fines, imprisonment, and deportation. It is difficult for America to be respected when the President refuses to honor the laws he is sworn to uphold.

Funding has been a challenge, and the laissez-faire policies of former Speaker Newt Gingrich contributed to Georgia alone losing $20 million dollars in immigration fees and lost tax revenue of 2-3% over the past decade. Amnesty is not an option, with the money being left unpaid.

Additionally, current laws in Mexico that respect personal use amounts of illegal drugs are different than American laws which are outdated on drug policy reforms, according to current Mexico law and Canadian studies. Therefore, the role of state governments is to report to the federal government agencies handling immigration and deportation matters, or ICE. Restricting state laws meant to comply with existing federal laws is not only ludicrous, but shows a blatant disregard for the citizens who do pay taxes.

While Georgia has lost over $20 million dollars in immigration fees and 2-3% in tax revenue annually, this is not necessarily an issue of Amnesty or naturalization that Obama has politicized for votes and his own lack of citizenship; it is an issue of willful law breaking, tax evasion, and a strained system resultant from ineffective coordination of state government costs with respect to federal enforcement that is both cooperative, collaborative, and truly diplomatic in our relationship to Mexico.

States may sue the federal government for the lost immigration fees, or they may levy the appropriate fines upon those who have not registered for citizenship or upon those who do not have VISAS: usually the financial burden is enough to encourage people to go back to Mexico without us having to foot the cost of imprisonment or for a one-way deportation.

Now, based on arrests and the costs of processing those arrests: the message is simple... either comply with the federal immigration program in ENTIRETY and PAY UP, OR GET OUT!! It is up to each state to report these findings of judicial costs, to be monitored for waste, with this Act. The Southern States have six months to analyze this, and report to Congress by 6-1-2012 their findings for Florida, Georgia, Alabama, Mississippi, Louisiana, Texas, New Mexico, Arizona, and California, who all share an immigration burden outside lawful federal requirements, in varying proportions, but especially Texas and Arizona who are victimized by cartel violence with California having a 15% unemployment rate, and the federal government will have to take this into consideration for states adhering to budgetary law and proper appropriation to remedy these issues. The proposal has been put on the table that everyone who does not have a US Driver’s license that they can verify with a passport, must apply for a Temporary Federal ID card. We had originally discussed equipping this with a bar code, charging 10% sales tax to buy items in the United States, so that we could retain revenue for services used. Driver’s License numbers or the TFID number could be entered into the cashier’s system, like it is for alcohol or the birthdate for a citizen OR BY SWIPING THE BAR CODE for all purchases, those buying domestically and those here visiting or working. We want to create a border that is not dysfunctional; one that operates lawfully and provides revenue, while properly protecting citizens and safeguarding the immigration process.
The ID cards would prevent useless waste of inquiries or expenditure of law enforcement’s time, prevent harassment by police, and it would give the federal government access to track who is coming in and out of the United States and for what purposes they are here and by monitoring commerce. This would also be without criminalizing legitimate workers or discriminating needlessly through undue scrutiny, with this system in place.

Until this Photo ID system can be implemented, it is NOT very wise to have an unmanned border with drones. It is a murderous electric fence, and it does nothing to protect citizens from immigrants already here, who go crazy over hearing their loved ones were killed on the border by our government. After all, by our penchant for importing 50% of Mexico’s drugs, we are half the problem, as Mexico is as well. Both countries are equally to blame for not coming to such diplomatic conclusions proposed in this Act.

While we are in a deficit, we can analyze the revenue figures, and approve implementation for July 1st, 2012, after getting the federal budget on a sustainable track of adhering to a $2.5 trillion annual revenue figure and a debt payment plan for deficit reduction.

Purpose: This concerns the exploitation of health care costs by health insurance companies for profit, companies who are dictating the cost of care that hospitals must charge patients. This legislation is piloting standards for Medicare and Medicaid costs, to prevent the government from being overcharged for services that taxpayers fund for the general welfare. Costs that could better be served creating a program to cover those that are uninsured at state levels, which did not occur with any of the legislation passed under Obama health reform.

While a legitimate funding mechanism was proposed for health care for the uninsured, in order to maintain the solvency and guarantee of retirement for aging Americans through Social Security Reforms proposed August of 2010 as repeal legislation:

The consensus is the only two provisions remaining from the dead legislation and mountain of dysfunctional legislation package known as “Obamacare”  are requiring insurance companies to keep children on parents’ insurance until 26yrs. of age and non-exclusion of pre-existing conditions. While these are great, these two provisions are not enough to keep H.R. 4872 as a means of reconciling the entire health care industry by a federal government buyout. Health insurance companies should ‘insure’ and the federal government should regulate and govern the market, not violate the Commerce Clause by requiring purchase of insurance or medical services, devices, products, or care that is inappropriate, unused, or misappropriated and unaccounted for tax increases.

With that said, the Tea Party supports the Republican initiatives to adhere to this budget, budget balancing, with consideration and concession of government spending in accordance to Constitutional priorities. Diplomacy spending on food stamps has increased 100% since Obama took office, which has further compounded the amount of time left to reverse this deficit and prevent government shutdown, little time to reform federal programs past their sunset that are bloated for their inefficiency with their strain on the overall budget. This all equals less money is actually making it to the poor and those needing health care;

Hospitals and insurance companies have played a highly elaborate game of ping-pong when it comes to overcharging for services and supplies in order to write-off indigent care to profit off of the health care industry. FOR CONSUMERS TO REPORT SUSPECTED GOUGING AND FRAUD OF GOVERNMENT TAX DOLLARS:
1) REQUESTED AN ITEMIZED BILL: I received a list of shorthand descriptions of services that I couldn’t understand. For example: a $403.68 charge for “IV SUPPLIES”. What were the IV Supplies? The needle? The tubing? The gauze? The piece of tape that kept it all in place on my arm? I called to find out. I was referred to three people, but nobody in the hospital billing department could tell me.

2) DETERMINED FINANCIAL RESPONSIBILITY OF MY INSURANCE COMPANY: Blue Cross assured me that they paid out their maximum reimbursement amounts to the hospital for the services I received, and would not be paying any more. They sent me an Explanation Of Benefits form (EOB) and went over it with me to my satisfaction. They said that they were able to negotiate a lower rate with the hospital on my behalf, and covered costs that exceeded my deductable. They suggested that I contact the hospital to see if they would lower my costs, since the hospital determines their own charges.

3) FOUND A PATIENT ADVOCATE: I went online to find people who have gone through this before and discovered a number of Patient Advocacy groups. A couple of them are: Hospital Victims.org (http://www.hospitalvictims.org/) and The Southwest Medical Review and Recovery. (http://www.southwestmedreview.com/) Southwest Medical Review has over 20 years of hospital billing experience under their belt, and left the industry when they realized that they could help people with their knowledge of billing systems. I found them to be very patient and extraordinarily knowledgeable.

4) REVIEWED BILL FOR CORRECT CODING: I sent my itemized bill to my patient advocate for review. A billing code is assigned to each item being charged. This is what is read by the insurance companies to determine how much the hospital will be paid. I learned that up to 90% of all hospital bills are coded incorrectly. My patient advocate told me that there is supposed to be transparency in the billing system – and that there are definitive coding guidelines that apply to each hospital. However, this hospital administers their own coding system – making it impossible to determine exactly what is being charged. Despite this, my patient advocate was able to figure out three incorrect codes in my bill, resulting in over $300 of erroneous charges. They forwarded me the proper verbiage from the most recent coding manual. I went back to the billing department at the hospital and had them amend my bill. The billing specialist apologized for her oversight and resubmitted my bill with the proper coding. I can only wonder how many more codes were erroneous, had they been using a transparent billing system.

5) REQUESTED ALL BILLING AND DOCTOR RECORDS FROM HOSPITAL – PARTICULARLY THE UB-04 FORM: It is the patient’s right, under the Health Insurance Portability and Accountability Act, (HIPAA) to receive a copy of all medical and billing records from the hospital. The UB-04 form is used to determine the cost of services. The billing department at the hospital first told me that they would look into releasing my UB-04 form. After repeated requests, I was told that it was not their policy to release this form to the patient. This is typical. Know your rights as a patient. Every hospital has a HIPAA officer on the premises. I called theirs. She said she would look into it for me. I didn’t hear back. She didn’t return my messages. I then contacted the California Office of HIPPA Implementation. They agreed to contact the HIPPA officer at the hospital. A day later, the HIPPA officer called me to get my address and let me know that my UB-04 form was being sent to me. Release of my U-04 form took me a full year.


· The sections of the HIPAA legislation that the state officer referred to were two federal 45 CFR codes: The Designated Record set was under code 164.501 and the Right of Access was 164.524 (a)(1)



6) DESPITE REMAINING IN GOOD STANDING WITH THE HOSPITAL, I WAS SENT TO COLLECTIONS: I kept meticulously close contact with the billing department, who insured me that I was in good standing with them. Every month, when I received a new bill, I called them and assured them that I wanted to settle the balance, and that I was investigating charges that were in question. Each month, I told them that is was my priority to remain in good standing with them. I even paid them $50 in good faith. But when I went out of town, and didn’t get my mail for a week, I was sent to collections. This was also during the time that I was being told that they were “looking into sending out” my UB-04 form. My challenge here was to keep the perspective that it wasn’t personal. Even though I was on a first name basis with many people in the billing department at that point, the overall billing system didn’t know or care about who I was. I needed to be reminded of this – because I was assured that I was kept in good standing with them.

7) KEPT COLLECTIONS DEPARTMENT FROM PURSUING FURTHER PAYMENT: Diligent effort through close communication and refusal to pay any overcharges for my services kept them at bay. I assured them that I would keep them posted to each and every new bit of information that I received – and kept them in the loop every step of the way. I kept telling them that it was my utmost interest to settle the bill – but that I would only be paying fair and reasonable charges, as determined by industry standards.

8) DETERMINED THE COST OF SERVICES: With the codes on the UB-04 form, my patient advocate taught me how to figure out the cost of services. There is an industry standard for determining cost of services. It is simply what Medicare would reimburse for each line item. The reason why they use Medicare as the guideline is because Medicare reimburses between 92 cents and $1.12 on the dollar. So, for example, if Medicare would reimburse a hospital $1.00 for a box of tissues, it is understood that the cost of the box of tissues is between 92 cents and $1.12. My patient advocate and I went over, code by code, the line items on my UB-04 form. They showed me how to track down, on the internet, the reimbursement amount for each charge. Remember the $403.68 charge for “IV SUPPLIES” on my itemized bill? Well, it turns out that Medicare doesn’t reimburse that cost code – those supplies are not billable. Those supplies are included in numerous other services – like the cost for the antibiotic, the cost for administering the IV, etc. After the reimbursement for each line item was determined on my UB-04 form, I had a total – as calculated by industry standards. The total cost of services being billed to me for my emergency room visit came to a little less than $400!

9) CALCULATED FAIR AND REASONALBE CHARGES: There is an industry standard for calculating fair and reasonable charges. Fair and reasonable charges ensures the hospital receive a profit on their cost. Here is the formula: The amount that Medicare would reimburse the hospital + 25% to 50%. So, in my case, we know that the cost of services were – and we’ll round it up - $400. Add to that, 50%, which is $200 - and the industry standard, for fair and reasonable charges for the services that I received, was $600.


10) OFFERED A SETTLEMENT: Between what my insurance company and I had paid, the hospital had already received $905 at this point – already recouping a 125% profit – as determined by industry standards. I went back to the hospital and insisted that I settle with them, not the collections agency. They complied. I chose to offer an additional 100% profit, giving them a 225% profit on cost of services, to ensure that the hospital does well. They denied it. Instead, they offered me an application for financial assistance.

The silver lining is that I somehow qualified for an 80% discount on my bill. They offered me a settlement of $348. I took it. This does not get them off the hook for their enormous over charges, but it does allow me to settle with them what I considered to be fair and reasonable.

“We can charge anything we want”, I was told by Crystal Crowe, Financial Supervisor at the hospital. Cedars-Sinai Medical Center netted in excess of 190 million dollars in 2007 - which I applaud. I feel secure knowing that there is a reputable, well funded hospital nearby. I just want to pay fair and reasonable charges for the services I receive from them.

I know that there is much talk of overhauling the health care system – but until it is changed, this is what we have to encounter. Here’s hoping that this information can help other people navigating through the existing system.

Given these facts and our budget constraints, each state must require the state interviewer to include in each recipient’s file their source of income at the time of renewal by verbal verification of answers to questions on the application to prevent robosigning of  applications and that an actual person still is unemployed or has no other means to pay bills, or who is experiencing various hardship requiring use of the program. We are not requiring extra hoops or trying to demean anyone, merely verifying a real person is using the program who is not connected to criminal activity who possesses a legitimate and verified need.

The interviewer will pose a general question and is required to verify source(s) of income, and failure to answer those questions honestly on the application or over the phone, means that a person may be expelled from the program for the period of one year. Subsequent violations mean permanent expulsion after the third suspension.

* The interviewer will also record for the physical file a person’s weight. We will begin to exempt those from the program who weigh above 175 lbs. for women and over 200 lbs. for men, except in the case of pregnancy, as verified by doctor’s note. Additionally, the weight requirement can easily be added to the online application as a form of security purposes to verify identity.

Interviewers at local offices are required to verify identity, current mailing address, weight, and source(s) of income for their household address for the interview and date/time recorded for the corresponding file.

Any file open for one year is subject to I.R.S. audit if recipient is unemployed or receives unemployment benefits (or both), receives any other state or federal health care forms of insurance, or is not paying in annually to Social Security.

Any or all of these are red flags that are indicative of fraud, misrepresentation of income, abuse of the program or programs, and tax evasion.

Because the Judiciary has abused the Patriot Act for politics and greed, they will pay the price for the use of confidential informants and other abuses: by budget reform techniques and cuts to state and local law enforcement agencies guilty of breaking laws that they have been charged to enforce. The Judiciary must adapt correctional officers to deal with the violent only/addressing and dissolving gangs, and others to become counselors, others to get a degree in something else that actually contributes to society in the private sector.

Military sequestration will likely be restored, but redirected to education, training, technology, and restrictions on defense contracts.

For too long, education has been shuffled as the last bit of funding from shaving off from all 4 umbrellas of budgeting, and we may create a 5th umbrella, a purple one, that must share funding with courts and patents. In order to be a millennial society, we must seriously appropriate for education because it drains revenue from all areas of government when people are lazy, ignorant, uneducated, or unable to find work because they are unskilled or not trained. We can no longer relegate education to states and the individual, we must upgrade our government and our society to require students to get their Bachelor’s Degree by age 25.

These state reforms will help us to control costs, especially those related to health care and in being compliant with Social Security Reform.

A 10 year audit must be performed by the I.R.S. for tax analyses/accountability, so these state files must be current and available to the I.R.S. for reporting purposes at ages 18, 28, 38, 48, 58, 68, 78, 88, and 98 with a two-year grace period to the next even-numbered year, to be compiled by each decade.

Additionally, any person not paying in 7% of their annual wealth is subject to being cut from federal programs, as they are not paying in 30% in federal income taxes nor are they paying in anything to sustain their own individual use of these programs.
This is regardless of income amount, if you want to use the program, you must contribute: these programs are not free, they are funded by taxpayers but not to feed leeches.

Federal programs are not entitlements or benefits when it is not beneficial to create debt, and you are only entitled to what you pay in, or you are defrauding taxpayers and depriving others who are truly needy of federal programs.

This reform will supplement Judicial Reforms already proposed, and others being composed for 2012, in conjunction with the 2012 Judicial Reform Act.

Part of the 2012 Judicial Reform Act will seek to treat tax evasion as more serious of an offense than drug abuse, and drug abuse will be considered as a class of reformed law to be handled by drug courts in each state, as a matter of individual health with respect to the entirety of other laws and spirit of the law.

Our jails should be reserved for the violent only, with tax evaders sentenced to probation, fines, and community service with drug offenders sentenced to treatment programs, not prison.

Anyone in prison is not paying taxes, so we need for people to stop evading paying taxes or being too unhealthy from addiction, who are unable to work and pay taxes.

This 2012 Welfare Reform Act is effectively immediately 7-29-12, to be enforced by Governors at state level, to counter the misappropriation, remuneration, and reckless leadership of the rogue Obama Administration that has no authority respectively over federal funds or the administration and requirements of these programs that belong to the state.

States not in compliance will be reported to Senators and subject to budget cuts proportionately, for failure to adhere to these requirements set forth herein this day for Welfare Reform.

This petition to act is issued to the Governor of every state, the respective 50 states of the United States. While every state may not choose to enact this, half of the states or the majority possessing Conservative policies and leadership may act accordingly to their state budget issues to promote fiscal responsibility.

As of 10/1/11, a Balanced Budget Amendment has not been introduced for an up or down vote, nor has the repeal bill https://docs.google.com/document/d/1jK6-kGCB_Dbb5K98YSS9o9kSNBwLJsSb7XQ5GQSvTks/edit?authkey=CIS_je8I&hl=en_US been introduced in place of H.R. 4872. Therefore, even though there has been this repeal bill submitted since August of 2010, Congress has been occupied with federal funding issues, the debt ceiling, and the interest on the deficit.

As we push for entitlement reform, this Act should work as a stabilization mechanism to absorb the shock of sustained unemployment, and from Congressional tug-of-war. State governments can not be held in the balance of whether or not the federal government faces shutdown again in March, before addressing these issues now at state level. It is imperative that we consider other legislation or ideas that we can apply to budgetary finance to alleviate these burdens, to prepare a plan for faltering recovery and lack of positive change.

Every Governor should write Congress with a copy of this letter or link, in support of the Balanced Budget Amendment. States by law, are required to balance the budget yearly without carrying a deficit. The same should be true of Congress and the federal budget, as states can not print more money against the Federal Treasury and value of gold to manipulate the dollar, nor can states engage in the buying and selling of debts for profit, or in exchange for lucrative favors from constituents for campaign financing. We are ending and withdrawing from the wars and occupation of Iraq and Afghanistan, less concerned with fighting more ground wars, and though Pakistan has presented its own challenges with seeming coup, the success of drones and our smoking out the Taliban by driving them from their strongholds to Yemen has changed our location, tactics, and appropriations. We are putting everything on the table to deal with the deficit.

Furthermore, we may begin to audit our own state budgets for weaknesses or deficits, and then fine leadership accordingly for not adhering to federal law. California is the most glaring abuse of federal law, and it has the most state debt, carrying an unlawful deficit of nearly $10 billion. A circular and audits are to be sent to the federal government by 1/1/12, to develop a consensus on how to strengthen the state of California, or if they will have to be put on federal probation until new leadership is elected.

With Cut, Cap, and Balance narrowly now passing in the House, now is not the time to let go of the Congressional rope, and we must hold fast to fiscal responsibility and supporting the House GOP and Tea Party Freshmen in their endeavors.

Here are several other ideas that we can use to restrict federal gluttony that Democrats call “deficit spending”: the Balanced Budget Amendment must be more than  just a declaration to balance the budget and reconcile the deficit. Congress has tried for the better part of 20-30 years to balance the budget.

For once, Senator Harry Reid is right: the debt ceiling is not an issue not unknown to Congress and senior leadership, during their tenure, and it will still be an issue after they’re gone. Yet, whomever has had majority control of the House or Senate in the past has been able to make the concessions necessary to move past gridlock. Only in recent years, we have been at an impasse. With as much as Senator Harry Reid blames the Tea Party, he can not blame them for the money that has been wasted since he raised the debt ceiling in 2006, while Obama was a Senator. Both of them were against it then, but they have gone against their own principles in raising the debt ceiling and Congress, and in making open declarations of war.


With that said, the Balanced Budget Amendment must have four components, or it is not even worth voting for, as it will only be a symbolic or roll call vote. (Taken from Glenn Beck’s “Broke”)
1) Spending can not be higher than the prior year’s amount, plus the rate of inflation and population growth.
2) If, at the end of a given fiscal year, the estimates were wrong and the budget is still not balanced, the difference would automatically be cut from the next fiscal year according to a very specific predetermined formula.

3) An exception can be included for a war declared by Congress, or a national calamity. The benchmark for meeting the definition of the latter would need to be quite high, think something in the range of 90% of the members of Congress agreeing. That may seem like an unrealistic bar, but how many politicians would have voted against declaring 9/11 or Hurricane Katrina a national calamity?
4) Federal expenses can not be pawned off on the states.

Without these 4 provisions being spelled out on paper, a Balanced Budget Amendment is useless, as Congress has quibbled and puckered about how to handle funding for years, and Congress must restrict itself to the four umbrellas of original design, and these cuts will be in another Act, on the model of governance. The audits will determine which programs are proposed to be cut based on that model, in accordance with these Conservative principles of the Balanced Budget Amendment.

Other legislation that Conservative leaders have in their quiver are:
1) Passing a line-item Veto amendment - which Clinton successfully used as a scalpel to cut out spending. While Obama talks about it, it is necessary to place it in his hand as a tool, to see if he would use it. So far, his OMNIBUS BILL PACKAGES have yielded economic disaster, and he is not the President who possesses the bipartisanship or leadership integrity to use it, yet we may certainly pass it for his successor as we press to impeach him for constitutional abuses.
2) the S.A.F.E. Act of 2010 - gives us all the provisions of the BBA without the controversy of an up or down vote on it, without having to sandwich the BBA as tagline legislation, when it is a constitutional amendment. The S.A.F.E. Act forces everyone to put their cards on the table about spending. Nothing is left to the imagination of taxpayers, nothing is hidden in subcommittee decisions, and nothing is decided by a controversial or super delegation or a dozen appointed legislators or Super Congress. I propose the S.A.F.E. Act as an alternative, if we are not satisfied with the outcome by Thanksgiving of this year and the automatic spending cuts scheduled to kick in, already this January 2012.
3) The GWB JR. VETO - would give Obama’s successor the power to freeze spending line-by-line, rather than outright deny it. This gives Congress and the President the ability to approve bills and delay funding, as needed, rather that starting from scratch on legislation no one finds makes the grade.
4) Return Impoundment Authority - Jefferson, using this, returned money to the budget deemed frivolous or unnecessary expenses. This authority gives the President the ability to seize and return funds to the Treasury. This gives the President authority to not automatically fund entitlements, while keeping pork out of bills.
5) Expand PAY-GO to include all budgetary items for funding review, rather than just non-discretionary selective items. This expands the current “YOU CUT” programs to keep integrity in entitlements, when they are subject to taxpayer cuts. We call this: “fund what you want to have”, rather than the government functioning as a financing machine off of Social Security and Federal Reserve IOU’s. (The debtor credit, where our debt is sold to other countries).
6) Pass a “Common Sense Lobbying Act” with these provisions, it prevents lobbying abuses of nepotism, favoritism, and grant preference given to large donors. This Act, next to repealing over 200 regulations from Obama, would be the icing on the cake to give us a course of action on financial reform legislation already passed. In other words, after four years you can become a lobbyist after leaving public office, and no family members of current Congress members can lobby.
7) No war or funding for war, unless it is appropriated for intelligence that can be issued except through Congress as a declared act of war. This restores our dealings and transparency with other countries, while keeping the amounts appropriated readily viewable to the taxpayers. This way, we don’t have the military lobbying the President; the military would go through an appropriations committee that oversees Homeland Security, and the President would adjust his budget accordingly to balance that with defense cuts or other cuts.
8) Commission Appointees - in the future, Congress must select private sector, educated, business people to Financial Reform Committees. That way, they are not politically motivated in making cuts or have vested interests in protecting programs.
9) Implement California’s Prop. 11 - to prevent gerrymandering and reduce inequality in voting districts and representation by Citizen Appointed Commission, like a jury.
10) No bonds issued to foreign countries - debt would then be locally managed and controlled.
11) SEIU ACT - Unions can not control the entire job market and monopoly rules would apply.
12) Congressional Reform Act - it used to be that Congress was a part-time endeavor, and they actually farmed or worked, which made them public servants, not political harlots. We should elect members of Congress who work, pay in, and run their own business. Prohibit fundraising during session, which reduces the time and money to investigate fraud, and place term-limits.
13) Introduce the Legislation Integrity Act - no more omnibus bills, fine the leadership for not having a yearly budget on time, and if the bill doesn’t fit a parameter of reasonable length, purpose, and funding amount in clear view, it does NOT get brought to the floor, period!

Where wealth is not bestowed the Lord makes the little much by the contentment which the sanctified heart feels in a portion of which the tithe has been dedicated to the Lord. Selfishness looks first at home, but godliness seeks first the kingdom of God and His righteousness, yet in the long run selfishness is loss, and godliness is great gain. It needs faith to act towards our God with an open hand, but surely He deserves it of us; and all that we can do is a very poor acknowledgment of our amazing indebtedness to His goodness.
