It’s been said there are two certainties: death and taxes.  Well I’m not dead (yet) but I do owe taxes this year  - again.  Maybe I should become an enrolled agent and go work for the IRS.  In any case, if you find yourself in a similar pickle, here’s what to do:
The first thing to do is fill out a tax return so you know exactly how much you owe. Once your accountant  (or you if you do it on your own) verifies the amount,  prepare your return and submit it.  Bear in mind that there are penalties and monthly interest charges monthly the IRS charges if you pay after the deadline. The longer you wait the higher your debt. Once you know your current balance, there are several payment options.
  1. Full payment If you are within your means to pay the total of your debt, you will avoid most penalties and interest. You can do this in several ways: by sending a check or money order payable to the Internal Revenue Service at the address listed in the letter received, or by bank transfer from your bank account.  If you want to make your payment with a debit or credit card, you can use a third party site for that too – Official Payments Corporation at 888-872-9829, WorldPay, Inc. at 888-972-9829.These companies usually charge a fee for card payments.
  2. Payment terms If you need more time to pay, the IRS gives you a period of 120 days to pay your debt without charge, but interest will continue to accrue until the balance is paid in full.
  3. Installment Payment Agreement If you can not pay your entire debt immediately or within 120 days, you can make a payment agreement. You must determine the amount you can pay monthly. Once the agreement is made, payments can be sent in several ways: as a bank transfer from your bank account each month, automatic deduction from your paycheck, online payment or by telephone using your debit or credit card. You can also make your payment arrangement by calling the telephone number included on your bill.
  4. Settlement If you feel your financial situation does not allow you to pay your total debt and you do not think that will change to allow so in the future, you have the option to make an offer to the IRS. This offer will allow you to decide how much you can pay the total of your debt. An offer in compromise does not automatically mean your debt is reduced to the amount offered. The IRS will review your offer and decide if it is approved or rejected. The fee for processing your offer is $ 150, which is not refundable.
So there you have it – your options if you owe the IRS.  Or  go take an enrolled agent course and go work for the IRS

Prior to her recent assault on Ann Romney, Hilary Rosen led the war on Napster in 2002, The Daily Caller has learned.
Publicly available tax documents from 2002, obtained by TheDC, reveal that Rosen received a total compensation package of $2.8 million during her final year as CEO and President of the Recording Industry Association of America (RIAA).
Rosen earned a salary of $2.65 million dollars for 40 hours of work per week to head the Washington lobby group. In addition, she received $141,512 in contributions to her benefits package from the RIAA that year as well.
Rosen led the Washington lobby group when it sued music file-sharing service Napster in 1999 – 2001 for its facilitation of music copyright infringement. She left the RIAA in 2003.
A frequent Obama White House visitor, Rosen was on the receiving end of a firestorm of criticism Wednesday and Thursday for her remarks about Ann Romney, the spouse of presumptive GOP presidential nominee Mitt Romney. Rosen said Ann Romney had “never actually worked a day in her life” and implied she could not relate to the plight of mothers who did not have “means.”
Ann Romney fired back Wednesday evening on Twitter, and again Thursday during a live segment on Fox News Channel’s “America Newsroom.” Romney said that she made a choice to stay at home and raise her sons, and that women across America have expressed their concerns to her during her year on the campaign trail.


Rosen issued an apology to Romney Thursday afternoon. She did not immediately reply to The Daily Caller’s request for comment.

Debbie’s had a makeover! I’m all for women looking their best, but this just has to be the most preciously cynical thing I’ve ever seen. Looks like the Libs will throw their “trademark” hair under the bus as quickly as they do their own grandmas, friends, and consultant/strategists.

DAMAGE CONTROL: A recent ballot challenge hearing in New Jersey exposes a desperate strategy by Obama to distance himself from his forged certificate and induce the contrived value of his transient political popularity as the only “legitimate qualification” needed to hold the office of the presidency.

NEW YORK, NY – After a Maricopa County law enforcement agency conducted a six-month forensic examination which determined that the image of Obama’s alleged 1961 Certificate of Live Birth posted to a government website in April, 2011 is a digital fabrication and that it did not originate from a genuine paper document, arguments from an Obama eligibility lawyer during a recent New Jersey ballot challenge hearing reveals the image was not only a fabrication, but that it was likely part of a contrived plot by counterfeiters to endow Obama with mere political support while simultaneously making the image intentionally appear absurd and, therefore, invalid as evidence toward proving Obama’s ineligibility in a court of law.

Taking an audacious and shocking angle against the constitutional eligibility mandate, Obama’s lawyer, Alexandra Hill, admitted that the image of Obama’s birth certificate was a forgery and made the absurd claim that, therefore, it cannot be used as evidence to confirm his lack of natural born citizenship status. Therefore, she argued, it is “irrelevant to his placement on the ballot”.

Hill went on to contort reasoning by implying that Obama needs only invoke his political popularity, not legal qualifications, in order to be a candidate.

At the hearing, attorney for the plaintiffs, Mario Apuzzo, correctly argued that Obama, under the Constitution, has to be a “natural born Citizen” and that he has not met his burden of showing that he is eligible to be on the New Jersey primary ballot by showing that he is indeed a “natural born Citizen.” He argued that Obama has shown no authenticate evidence to the New Jersey Secretary of State demonstrating who he is and that he was born in the United States. Apuzzo also argued that as a matter of law, Obama is not a “natural born Citizen” because he was born to a father who was not a U.S. citizen.

As Obama’s legal argument becomes more contorted, he is being forced to avoid an ever shrinking legal space, and an increasing weight, of his failure to meet constitutional eligibility requirements.

Obama Adviser Wants Syrian ‘Resistance’ to Israel

In the Arab and Middle Eastern context resistance is, of course, a codeword for terrorism and war.
The adviser is Dalia Mogahed. Yet another example of the strange company Obama has kept and continues to keep, he appointed her to serve on the White House Office of Faith-Based and Neighborhood Partnerships. On March 10 she tweeted on her Twitter account:
To those siding w/Assad: he cannot deliver stability, protection of minorities, or resistance to Israel. He is a killer w/o legitimacy.
It wasn’t Mogahed’s first venture in radicalism. Two years ago she advocated Sharia law on British TV, saying it provided “gender justice” even though, as Robert Spencer noted at the time, Sharia prescribes wife-beating, permits taking the vows with prepubescent girls, and discriminates against women in matters of testimony, inheritance, marriage and divorce.
Indeed, the show was hosted by a member of Hizb ut-Tahrir—banned as a terrorist organization by many countries—and included two Hizb ut-Tahrir guests who denounced Western society and called to make Sharia “the source of legislation.” Hizb ut-Tahrir’s alumni include 9/11 architect Khalid Sheikh Mohammed and Jordanian jihadist Abu Musab Zarqawi, killed by U.S. forces in Iraq in 2006.
Mogahed was also coauthor with John Esposito of Who Speaks For Islam?: What a Billion Muslims Really Think—a book whose blatant distortions of poll data were exposed by Robert Satloff among others. Arabian Business magazine has named Mogahed one of the Arab world’s most influential women.
And what of her take on Assad? Does he indeed come up short on “resistance to Israel”?

In fact, since becoming president in 2000, Bashar has continued his father Hafez Assad’s policy of making Damascus a headquarters for Hamas, Palestinian Islamic Jihad, and other anti-Israeli terror groups. It was in Damascus that—in a move many attribute to Israel—Hizbullah arch-terrorist Imad Mughniyeh was assassinated in February 2008. Under Bashar, Syria has continued its role as weapons-conduit from Iran to Hizbullah in Lebanon.
It’s only recently that Hamas—with Bashar’s largely-Alawite forces killing many of Hamas’s Syrian Sunni compatriots—appears to have left Syria. But Palestinian Islamic Jihad remains based in Damascus, and with Iranian and Syrian encouragement and assistance played the major role in last week’s bombardment of southern Israel from Gaza.
Seemingly, then, Bashar’s credentials on “resistance to Israel” aren’t bad.
And yet Mogahed may have a point. Since the 1973 Yom Kippur War, the Assad dynasty—while a hub of anti-Israeli terror—has kept Syria’s border with Israel quiet and avoided war. Even if the reason is deterrence, that leads many in Israel to think Assad could be a lesser evil than forces—especially if Islamist-dominated—that might ultimately topple him.
In other words, if one sees Bashar Assad as unable to “deliver” on “resistance to Israel,” it can only mean one favors an “upgrade” from mere terrorism to war. And that appears to be the stance of Dalia Mogahed, one of President Obama’s advisers on Faith-Based and Neighborhood Partnerships.

Dear Chairman Curry,
On behalf of the Florida Democratic Party I request that the RPOF immediately condemn Congressman Allen West’s egregious allegations that “78-81” Democratic Representatives in Congress are “communists” and demand an apology from Congressman West.  Each of us understands the hyperbole that surfaces during every political season. It is a long-standing practice in American politics. But there are and must be lines.  To suggest that elected Democrats share political views with Joseph Stalin, Mao Zedong or other communist dictators who murdered their people and suppressed the freedom of hundreds of millions for generations recalls the shameful practice of Joseph McCarthy. I am sure you proudly recall that it was a Republican Senator, Margaret Chase Smith, whose statement of conscience publically admonished McCarthy’s tactics of accusing unnamed persons of being “card carrying communists.”         
While our parties have marked political differences and separate visions for this State and Nation each of us must remember that both Democrats and Republicans shed their blood fighting for freedom. Both parties have a proud tradition of opposing fascism and communism no matter the cost. While Congressman West has clearly forgotten that lesson, I trust your party has not. Your silence will be read as acquiescence.
I look forward to your reply, and request that Congressman West apologize to our nation for his dangerous, inflammatory remarks.

Defense attorneys argued that the defendants, many of whom are refugees from Somalia, were juveniles at the time the alleged crimes occurred.

After selecting a jury last month, the trial was delayed last week when prosecutors turned over thousands of documents and audio recordings from the investigation to defense attorneys on the eve of trial. Both defense attorneys and federal prosecutors have repeatedly declined to comment about the case. (Of course not, when it’s about Muslims, mum’s the word)
The indictment, which was originally unsealed in 2010 and amended by a superseding indictment in 2011, says the defendants, many of them from the Somali MUSLIM immigrant communities in Minneapolis and Nashville, were members or associates of the three gangs. Four unidentified victims, some of who were under the age of 14, are listed in the indictment.The indictment accuses the gangs of finding and recruiting young girls for the purpose of prostitution in exchange for money and drugs between 2000 and 2010.
Out of the 30 individuals listed in the indictment, only 14 are going to trial this month in Nashville on charges of conspiracy to commit sexual trafficking of children by force, fraud or coercion and charges related to the sexual trafficking. Many of the individuals have remained in federal custody since their arrests in 2010.
Smith has been working with Jane Doe #2 in the case and said testifying against other Somali MUSLIMS will be very difficult for the victim, but she wants to have her voice heard. ”In the case of Jane Doe #2, she, as a minor, would typically be in a closed court, but she wants to have her story known and she wants to speak in public,” Smith said.
Many, but not all the defendants, are described as refugees who came to the United States as young children. Police have relied on immigration paperwork to determine their ages, but defense attorneys have argued in court that information in those documents are routinely incorrect due to cultural and language issues. (No, it is because Muslims lie. Period)
Courts in Minnesota, the state with the largest Somali MUSLIM population in the U.S., have seen similar issues in cases where defendants or victims are Somali MUSLIMS.
“When you are dealing with an insular inbred community, especially whose native language is not English, people are going to worry about the ramifications of testifying in court against community members,” Scott said. “The Somali MUSLIM community is a very insular community in Minnesota — everybody knows everybody (and most everybody is married to their own family members)

CARTAGENA, Colombia (Reuters) - A prostitution scandal involving U.S. security personnel in Colombia and an unprecedented regional push to end the isolation of Cuba threatened on Saturday to eclipse President Barack Obama's charm offensive to Latin America.
In a major embarrassment for Washington at the Summit of the Americas attended by more than 30 heads of state, 11 U.S. Secret Service agents were sent home and five military servicemen grounded over "misconduct" allegations in a hotel.
Prostitutes were taken to the hotel, according to a Colombian police source.
The widening controversy was overshadowing a host of weightier topics at the two-day summit that began on Saturday.
"I had a breakfast meeting to discuss trade and drugs, but the only thing the other delegates wanted to talk about was the story of the agents and the hookers," chuckled one Latin American diplomat in the historic city of Cartagena.
Locals were upset about the bad publicity for their city, and the scandal was raising eyebrows around the region.
"Obama's guards expelled in Colombia over prostitution - shame the gringos think that Latin America is a brothel and they act like it too," commented left-leaning Venezuelan political commentator Nicmer Evans via Twitter.
Obama's rapprochement with the region - already undermined by the titillating headlines from Cartagena - also faces a rare display of unity among both leftist and conservative-run nations in Latin America in allowing communist-run Cuba at the next summit.
Argentina's foreign minister said the final summit declaration was stalled over the issue of Cuba, with 32 nations supporting its inclusion in the next Summit of the Americas, but the United States vetoing that.
"We have decided not to participate in future 'Summits of the Americas' without the presence of Cuba," said the leftist ALBA block of nations, founded by Venezuela's theatrically anti-U.S. president, Hugo Chavez.
OAS UNDER STRAIN
Unlike at previous summits, backing for Cuba has also come from Colombia, Washington's strongest ally in South America.
Sunday's proceedings will add to strain on the Washington-dominated system of hemispheric diplomacy that is built around the Organization of American States but is struggling to evolve with changes in the region.
From Havana, Cuba's former president, Fidel Castro, weighed in with a withering newspaper column about the OAS and its "guayabera summit" - a reference to the loose-fitting Caribbean shirts being worn by many heads of state in Cartagena.
Making no reference to the scandal, Obama tackled head-on accusations he had neglected Latin America while dealing with conflicts in Iraq and Afghanistan and other faraway priorities.
"We've never been more excited about the prospect of working as equal partners with our brothers and sisters in Latin America and the Caribbean," he told business officials.
Obama also hailed the potential to boost trade between the "nearly a billion consumers" of North and South America.
The reality, though, is different: China has taken advantage of perceived U.S. neglect and is now the main trade partner for various countries, including regional powerhouse Brazil.
Running for re-election in November, Obama is also under pressure from domestic voters to show his foreign policies give priority to trade that creates American jobs.
Latin American leaders are also pressuring the United States for an overhaul of anti-drug policies, including possible narcotics legalization as a way to take profits out of the trade.
"Sometimes those controversies date back to before I was born," Obama said wryly.
"And sometimes I feel as if in some of these discussions, or at least the press reports, we're caught in a time warp, going back to the 1950s and gunboat diplomacy and Yankees and the Cold War, and this and that and the other."
OBAMA FIRM ON DRUGS
Many in Latin America feel a new approach is needed to the drug war - and a shift away from hard-line policies - after decades of violence, in producer and trafficking nations like Colombia and Mexico.
But Obama was firm in rejecting calls to legalize either growing or consuming drugs. "I don't mind a debate around issues like decriminalization. I personally don't agree that's a solution to the problem," Obama said.
Colombian pop star Shakira brought a splash of showbiz to the proceedings by singing her national anthem at the start of the summit.
Missing from the OAS' sixth such hemispheric gathering were Ecuador's Rafael Correa, who is boycotting the event over Cuba's exclusion, and Venezuela's Chavez, who is undergoing cancer treatment.
Brazilian President Dilma Rousseff gave Obama an earful on U.S. expansionist monetary policy that is sending a flood of funds into developing nations, forcing up currencies and hurting and other rich nations' competitiveness.
"The way these countries, the most developed ones, especially in the euro region in the last year, have reacted to the crisis with monetary expansion has produced a monetary tsunami," she said, as Obama listened.
"Obviously we have to take measures to defend ourselves. Note the word I chose - 'defend,' not 'protect,'" added Rousseff, whose government's actions to curb imports have been decried as protectionism by some in the region.
The host, President Juan Manuel Santos, is using the summit to showcase Colombia's new economic stability after decades of guerrilla and drug violence that scared off investors.
Although seeking to position himself as a regional mediator - particularly between conservative governments and the anti-American bloc led by Chavez - Santos nevertheless weighed in to support Brazil's position in front of Obama.
"In some way, (they) are exporting their crisis to us via the appreciation of our currencies," Santos said, referring to the damage done to local exporters as Latin American currencies gain strength. "I share President Dilma Rousseff's anxiety."

An End to the War on Drugs?

As a normally pro-forma gathering of hemispheric leaders gets under way in Cartagena, Colombia, this weekend, Latin America could instead be approaching its declaration of independence from the United States. For the first time, the region might come out against a US policy. The change in what seemed to be an immovable subservience has come gradually, but the immediate cause is drugs, and the surprising agent is Otto Pérez Molina, retired general, former intelligence chief, graduate of the Pentagon’s School of Americas, and now the new president of Guatemala.
Pérez Molina is no stranger to the War on Drugs. He campaigned for president promising to bring out the country’s dreaded Kaibil Army special forces against the drug trade; Guatemalan voters, judging crime and insecurity to be their greatest concern, elected him in November. But less than a month after taking office in January, Perez Molina asked his Central American colleagues to consider a unilateral cease fire and ways to legalize drugs.
The all-but-instant, and strikingly favorable response to Pérez Molina’s proposal has upended the agenda for this weekend’s Summit of the Americas in Cartagena, a gathering of the leaders of 35 Western Hemisphere nations. Unimpeachable allies of the United States, like Costa Rican president Laura Chinchilla, and Colombia’s Juan Manuel Santos, who is the meeting’s host, have expressed their support for legalization. And, as is not infrequently the case in matters concerning Washington’s home hemisphere, the US has been caught unaware.
It shouldn’t have been. Despite billions of enforcement dollars spent by Washington, the overall amount of drugs being trafficked worldwide has remained more or less constant over the last forty years. Profits are higher. Many more countries are involved in the trade than even ten years ago, including, most worryingly, several of the most vulnerable African states. The trade’s ability to insinuate itself into every branch of government in drug-afflicted countries continues apace. Candidates to every elected post in Mexico, to name just one critically important country, are ruthlessly wooed by traffickers offering financing. Trafficking organizations not only grow and increase their connections to global mafias and terrorist networks, they have branched out into ever more sordid sidelines, including human trafficking. It’s a sorry record.
In fairness, the Guatemalan president’s announcement surprised just about everyone outside his immediate circle. Otto Pérez Molina is a retired brigadier general who was in charge of one of the most brutalized areas during the most nightmarish years of an anti-guerrilla war that tore his country apart throughout the 1980s. He has been repeatedly accused of large scale human rights violations committed during that time. He is a wealthy man who won the presidency with the fervent support of Guatemala’s highly conservative, if not reactionary, private sector. He is, in other words, Nixon in China: the least likely, and therefore the best candidate to call for an end to the drug war that the real Richard Nixon declared in 1973.
And indeed, when it happened, on February 11, Pérez Molina dropped the bomb as if he had just thought of it. He was at a ribbon-cutting ceremony for the opening of a new thoroughfare on the outskirts of Guatemala City when he commented that bloody confrontations with the drug trade would continue as long as the United States continued to provide a consumer market that made the drug business profitable, adding that at an upcoming meeting of Central American presidents [i.e., not the Summit] he would propose “the possibility of legalizing and regulating the production, transportation, and commercialization of drugs.”
“All the technology and resources and millions of dollars the United States have contributed have not managed to diminish the drug problem,” he said on Guatemalan radio later that day. On February 27, US Homeland Security Secretary Janet Napolitano flew to Guatemala for what someone present at that conversation called a “concerned” meeting with Pérez Molina. She left the same day. Pérez Molina stuck to his guns.

In fact, the Guatemalan leader’s proposal turned out to be not nearly as impromptu as it seemed. A highly-trained military man, Pérez Molina likes success, and the War on Drugs, he seems to have realized has been a dismal failure. In 1993 Pérez Molina was responsible for the capture and extradition to Mexico of Joaquín Guzmán, still considered today the most powerful drug trader in the world. As a result, Guzmán spent almost eight years in jail in Guadalajara, but the presence of his trafficking group, and that of his bitterest rivals, the Zetas, ballooned, as did corruption and violence. In a poor and stratified country further devastated by a decade-long war, Pérez Molina watched social structures and institutions crumble under the impact of the drug trade. The homicide rate raced upwards from an already high 24 per 100,000 in 1999 to a staggering 41 in 2010. (By comparison, the overall rate in Mexico, whose violence receives far more international press, was 18 last year; in the US it was about 5.) The optimism felt by those on all sides of Guatemala’s civil conflict when peace was finally signed in 1996—Pérez Molina was among the negotiators—was shattered as the country’s immigration, security, justice and social services felt the subversive impact of drug money.
Of course, money is at the very heart of any discussion about drugs: the amount to be made from it, the amount it costs governments to defend themselves against the trade, the amount made by banks from laundering it. For Latin American governments, increasingly, it just hasn’t been adding up. Colombia, for example, has been spending six per cent of its GNP on internal security—more than any other country, according to former president César Gaviria—in an attempt to deal with another country’s problems.
“[The United States] still measures success by the number of arrests, or the number of kingpins in jail, or the amount of drugs interdicted, or the street price of drugs in Los Angeles,” President Gaviria told me in a phone conversation this week. “But what use is that to us?” President during the years of Pablo Escobar´s war against the state, Gaviria had an opportunity to observe at brutally close-range the futility of the drug war, and its costs. Three years ago he joined former Mexican president Ernesto Zedillo and Fernando Henrique Cardoso, the esteemed former president of Brazil, on a commission that has set out to study the failures of the War on Drugs, and to establish alternative ways to fight the drug mafias, reduce consumption, and mitigate the harm done to drug-growing countries. Former Mexican President Vicente Fox has also supported these ideas.
For his part, Pérez Molina’s move appears to have been carefully discussed with Juan Manuel Santos, President of Colombia. As Minister of Defense in the administration of Alvaro Uribe, Santos used the funds provided by the United States under Plan Colombia to wage war against powerful guerrilla groups that control a large part of the Colombian drug trade. Santos is a sophisticated man, and he has spent the last thirty years observing how drug traffickers wield their profits like explosives that have been carefully placed to blow up as much of the edifice of state as possible. He is under no illusions that Colombia’s apparent success in reducing drug-related violence has had much effect on the actual volume of cocaine produced or traded in the Andean region. (It has not.)
Santos has kept track of the number of Colombian lives lost in drug-related violence; it now stands in the hundreds of thousands. Over the years he has become increasingly outspoken. “A new approach should try and take away the violent profit that comes with drug trafficking,” he told The Observer in November. “If that means legalizing, and the world thinks that’s the solution, I will welcome it. I’m not against it.” In that same interview he lamented that many leaders who agree with him will not speak out about drugs for fear of being“crucified.” Once Pérez Molina shouldered the cross, Santos made sure that a discussion of legalization was on the Cartagena Summit agenda.
The debate is framed as a discussion of whether the current US-led War on Drugs policy has worked or not, and if not, whether there are viable alternatives. The first part of the question should not take very long to answer: It is hard to think of a single lasting accomplishment. In Colombia, for example, after all the years of bloodshed and devastation, cocaine production and export have gone down so slightly as to make no difference, and it would seem that Peru is now taking up the slack. Again.
The second part of the question is harder: is there a better way? Blanket legalization of an illegal substance has only been tried once before, with alcohol, in the United States. Neither Santos nor Pérez Molina, nor the many leading political figures around the world who have been pushing for an alternative to the current policy, favor a legalization like the one that ended Prohibition.
Suggested alternatives range from an acknowledgment that marijuana is already all but legal in the United States and much of the rest of the world, and should be officially so (it is generally estimated to be the largest moneymaker for the illegal trade), to a sort of universal legalization of drugs that would ban advertising, restrict distribution to government outlets, and tax the profits heavily.
Everything is open for discussion, and it seems likely that against all odds—and to the great discomfort of the many institutions whose budgets have depended for decades on a warrior stance—the discussion will begin in Cartagena this weekend. It’s hard to imagine a road map for what comes next. One hundred eighty-two countries have signed the United Nations Convention Against Illicit Traffic in Narcotic Drugs of 1988, which propounds the criminalizing of drug use (the European Union is among the few that did not sign). Although there is growing agreement that criminalization is precisely what has led to the current havoc—overstuffed prisons, irresistibly high profits—it’s hard to imagine a majority of these countries voting to repeal the Convention.
Drug policy is an ideological live wire: it’s not even certain that Latin American leaders will achieve anything other than a mealy-mouthed agreement to discuss the possibility of a discussion. But it will be a start.

Gov. Nathan Deal asks GBI to take over sex offender board

ATLANTA — Gov. Nathan Deal is asking the Georgia Bureau of Investigation to take over a state board that reviews cases on the sex offender registry amid concerns about a backlog of work.
WSB-TV reports that the sex offender registry review board has a 4,000-case backlog.
The governor's chief of staff, Brian Robinson, says the backlog deals with determining threat levels of offenders. Robinson says the backlog does not involve identifying the offenders.
Georgia's Sex Offender Registry Review Board is run by the Department of Behavioral Health and Development Disabilities. The board determines which offenders pose the highest risk of offending again.

It’s a joke. He’s just playing. She’s being funny. He’s flirting. She wants the attention.

Time and again we hear these misguided perceptions of sexual harassment that occurs between adolescents and teens — a broad category of behavior that includes unwanted touching and groping, sharing lewd images and spreading sexually charged rumors about classmates.
While the behavior doesn’t always lead to more extreme forms of sexual violence, it can overlap with bullying and be so subtle that adults may not even detect it. And many youth and adults may believe these acts are a normal part of enduring the adolescent and teenage years.
But sexual harassment happens every day among Georgia youth. It takes many forms, has clearly defined perpetrators and victims, and needs to be addressed at an early age to prevent it and other forms of sexual violence.
Peer-to-peer sexual harassment is not unique to Georgia. Nationally, nearly half of seventh- through 12th-grade students experienced some form of sexual harassment electronically or in-person during the 2010–11 school year.
The same study found perpetrators often thought they were being funny. Their actions, however, affected their victims’ study habits, fueled their reluctance to attend school and even drove feelings of physical illness.
Gov. Nathan Deal has signed a proclamation designating April as Sexual Assault Awareness Month in Georgia. Rape crisis centers, advocates and survivors are providing opportunities to collaborate with state and local partners to highlight sexual violence as a major public health, human rights and social justice issue.
Last year, for instance, sexual violence victimized nearly 14,000 children and adults in Georgia, according to the Criminal Justice Coordinating Council. With one in six Georgia girls and women between the ages of 15 and 44 having been forced to have sex against their will at least once in their lifetime, this month serves as a crucial moment in elevating awareness and understanding about sexual assault — and the more subtle behaviors that can lead to it.
It’s also an opportunity to understand perpetrators, so communities can prevent sexual assault. Seventy-two percent of sexual assault assailants in Georgia, for example, knew their victims as acquaintances, family members, spouses, boyfriends or friends. Most offenders arrested for forcible rape were between the ages of 17 and 39.
Communities can play a role in teaching adolescents and teens about the parameters of behavior that occur within healthy relationships and correcting offensive behavior early.
The messages to our youth can be simple: Stop touching and groping others. Stop gossiping about sexual acts. Stop spreading rumors about someone’s perceived sexual orientation. Stop sending lewd messages to others.
It’s not funny, and the behavior is not tolerated in our school, in our household or in our community.

Cobb educators fired for failing to report suspected sex abuseBy Ty Tagami

A delay cost a Cobb County school principal and counselor their jobs.

The school board voted Wednesday to fire Jerry Dority, who was principal at Tapp Middle School in Powder Springs, and counselor Yatta Collins.
Both had been recommended for termination by tribunals comprising three school board members. They were accused of failing to report an incident of suspected child sexual abuse to authorities in a timely manner.
Under state law, school employees and other professionals have 24 hours to tell police, prosecutors or state child protective services after learning of a possible incident. Both were arrested in early March and charged with failure to report child abuse.
School system records, obtained by The Atlanta Journal-Constitution under the Georgia Records Act, indicate a student told Collins on Jan. 30 that she tried to hang herself in her closet. The girl had marks on her neck, but would not explain herself to Collins, the records show. However, another student claimed that day that the girl had been sexually abused by her stepfather.
Collins told Dority that day, but waited two days to notify the Georgia Division of Family and Children Services. She asked the girl's mother on Jan. 30 to take the girl for a mental evaluation.
Collins informed DFCS on Feb. 1 after the student missed the next two days of school.
State law requires lower-level school employees to notify "the person in charge of the facility" if they suspect child abuse. Collins informed Dority about the suicide attempt immediately, but it's unclear from the records when she told the principal about the sex abuse allegation.
But a Cobb County police detective, who tried to investigate, complained later that Collins would not help her arrange interviews with students and even told her to leave.
Neither Collins nor Dority attended Wednesday's vote, and the school board did not discuss it publicly before voting on it and other matters discussed behind closed doors.
Cerrone Coker, a lawyer who represented Collins at her tribunal hearing, did not return several messages seeking comment.
In a statement to the school system, Dority, an educator for 28 years, doesn't say when she learned of the suspected abuse. But she apologized for a decision she acknowledged "was not the best one at the time" for the student's "safety and well-being."
"I made an error in judgment," Dority wrote. "At the time, I thought the attempted suicide was the most pressing matter." She said she should have focused on the reported reason for the suicide attempt.
"I love what I do as an educator, and my hope is that a bad judgment call will not cost me my life-long career as an educator," Dority wrote.
Both educators were charged with failure to report child abuse, a misdemeanor that can bring up to a year in jail. Georgia lawmakers this year voted to expand the mandate. When it becomes law July 1, just about anyone who works with children -- even volunteers -- could go to jail for failing to report suspected child abuse, which includes beatings, neglect and sexual abuse.

WASHINGTON (Reuters) - The fate of a new package of sanctions on Iran proposed by U.S.lawmakers may hinge on whether Iran and six major world powers can make any progress at high-level talks this weekend toward resolving a dispute over Tehran's nuclear ambitions.
There is broad support among Democrats and Republicans in the U.S. Congress to add more oil- and banking-related sanctions aimed at pressuring Tehran to abandon its nuclear program.
But the proposed package of sanctions stalled in the gridlocked U.S. Senate in late March, just before lawmakers left Washington for a two-week break.
Lawmakers, who return to Congress on Monday, will be watching to see what comes from the talks in Turkey for clues about where to take the proposed new sanctions.
"Maybe the talks actually increase the pressure when we're back in session next week," said oneSenate aide, who spoke on condition of anonymity.
If the talks accomplish little, there will be renewed pressure on Senate Majority Leader Harry Reid to make a deal to advance the new sanctions, said a senior Republican congressional aide.
"If there's a real credible agreement there, then the need for further sanctions will be diminished. If it collapses, and is a joke like last time, then certainly the Reid position will weaken very rapidly," the Republican aide said.
The West accuses Iran of seeking to develop a nuclear weapons capability. Tehran denies that, saying its program is intended to produce only electricity and medical isotopes.
Israel, believed to be the only Middle East state with an atomic arsenal, has hinted at pre-emptive strikes to prevent its foe from obtaining such arms.
TIGHTENING THE NOOSE
The new proposals come as the Obama administration implements tough new sanctions passed by Congress last year targeting Iran's central bank and countries that fail to make "significant" cuts to oil purchases from Iran.
The new batch of measures seeks to close loopholes, focusing on foreign banks that handle transactions for Iran's national oil and tanker companies.
The Senate Banking Committee's version of the bill has already had an impact. The panel proposed that the Society for Worldwide Interbank Financial Telecommunication, or SWIFT, shut out Iran's central bank and other financial institutions from the system used to move money between banks around the world.
European regulators ordered Belgium-based SWIFT to disconnect designated Iranian financial firms from its messaging system last month, the first time the electronic payment system had ever expelled banks.
Some lawmakers want to tweak the bill to extend sanctions to other financial services providers to Iranian banks.
"We wouldn't want to see any backfilling by current or new messaging companies," a Senate aide said.
Republican Senator Mark Kirk has a package of amendments he wants to propose, including one that would ban insurers from covering shipments of Iranian oil except for those importing nations, such as Japan, that have been granted exemptions by the U.S. government.
Senators on both sides of the aisle have other proposals they would like to add to the Banking Committee's package.
"The administration has been willing to meet and discuss it," a Republican aide said.
But when Reid brought the bill to the floor last month, he said that to speed its passage he would not allow any amendments. He sought unanimous consent for the bill, but Senator Rand Paul formally objected.
"Senator Reid believes that we need to get additional sanctions in place as soon as possible so we can keep the pressure on Iran and help stop their nuclear program," a spokeswoman said on Friday.
"The best way to move forward quickly is to pass this bipartisan bill through the Senate without amendment."
The Republican aide said there was bipartisan support for most of the ideas that lawmakers want to add to the package.
"Most of this is negotiable, most of this is not controversial," the Republican aide said.
"If the Democratic leadership allowed it, it would probably take a day to negotiate compromise language on all of it, put it all into a manager's package, which could win unanimous consent on the floor, and go straight to conference."
The Republican-led House of Representatives passed its version of the new sanctions package last December.
That bill would ban ships that have recently visited Iranian ports from entering U.S. ports, a measure that so far is not part of the Senate bill.

The UN Secretary-General Ban Ki-moon met the Joint Special Envoy of the United Nations and the League of Arab States for Syria, Kofi Annan, on Saturday evening in Geneva, Switzerland.

They had an in-depth exchange of views based on an analysis of the situation on the ground in Syria by the Joint Special Envoy’s team.

The Secretary-General and the Joint Special Envoy welcomed the adoption of Security Council Resolution 2042 to authorize the dispatch of the advance team of UN observers to Syria and they committed to do their best to deploy the team as quickly as possible.

Mr. Annan briefed the Secretary-General on his contacts with the Syrian government and with the opposition, as well as with countries of influence. He elaborated on the efforts to secure the full implementation of the 6-point plan, and to launch a political process that would address the concerns and aspirations of the Syrian people.

They discussed the status of the cessation of violence in Syria, including reports of sporadic violence and the continued presence of the Syrian Armed Forces in population centres.

The Secretary-General  reiterated that it is the Government of Syria which has the primary responsibility to stop the violence and withdraw its forces.

They also reiterated their call on all stakeholders including the Friends of Syria to exercise their influence in encouraging the opposition to take reciprocal steps in ensuring the cessation of violence.

Both emphasized the need for the international community to speak and act with one voice in the coming days and months.

The Secretary-General and the Joint Special Envoy also discussed the need to address the humanitarian situation in Syria, where over one million people are in need of assistance.

BEIRUT (Reuters) - Syrian government forces shelled the city ofHoms on Sunday and rebels attacked a police station in Aleppo province, resident opposition activists and a rights group said, in more violence four days after a ceasefire was meant to come into effect.
The fighting comes hours before an advance party of United Nations ceasefire monitors is due to arrive in Syria after Russia and China joined the rest of the Security Council on Saturday to authorize their deployment.
"Early this morning we saw a helicopter and a spotter plane fly overhead. Ten minutes later, there was heavy shelling," said Walid al-Fares, an activist living in Khalidiya, one of the neighborhoods where mortars bombs have landed.
Another resident said government loyalists were using heavy machine guns to shoot into the area.
Rami Abdelrahman, head of the British-based Syrian Observatory for Human Rights, said shells were being fired at a rate of one a minute. He said there had also been overnight clashes in rural Aleppo.
"People said they heard explosions and shooting after rebels attacked a police station and then clashed with police," he said.
Syria blames the violence on "terrorists" seeking to topple President Bashar al-Assad and has repeatedly denied journalists access to the country, making it impossible to independently verify the reports.
Although violence has persisted throughout the ceasefire, there has been a significant drop in the daily death toll in fighting which has often killed more than 100 people a day.
On Saturday, 14 people were killed in the violence, Abdelrahman said and the state news agency SANA said "armed terrorists" killed five people in ambushes around the country.
ADVANCED MONITORING TEAM
The United Nations Security Council voted on Saturday to authorize the deployment of up to 30 unarmed observers in the first resolution on Syria the 15-nation council has managed to approve unanimously since the uprising erupted in March 2011.
Russia and China have previously blocked Western attempts to pass Security Council resolutions on Syria.
A spokesman for U.N.-Arab League envoy Kofi Annan said on Saturday an advance team of six monitors would arrive in Syria within 24 hours and deploy within 36 hours, with more to follow within days.
"I will make sure that this advance observer mission will be dispatched as soon as possible and try to make concrete proposals by the 18th of April for an official observer mission," U.N. Secretary-General Ban Ki-moon told United Nations radio separately in Geneva.
France's foreign ministry, while welcoming the U.N. vote, said it was now up to Syria to respect its commitments by withdrawing troops and heavy arms from populated areas.
"If this is not the case, it will be the responsibility of all the Security Council members to reflect on the measure that should be taken," it said in a statement.
VIOLENCE AND DIPLOMACY
The Security Council resolution condemned the "widespread violations of human rights by the Syrian authorities, as well as any human rights abuses by armed groups".
It said those responsible would be held accountable and called on "all parties, including the opposition, immediately to cease all armed violence in all its forms".
The text included a vague warning to Damascus, saying the council would "assess the implementation of this resolution and to consider further steps as appropriate".
"The Syrian government must ensure that the monitoring team has freedom of movement and access, and it must not obstruct communication between the monitors and headquarters," said British Foreign Secretary William Hague.
U.S. ambassador to the United Nations Susan Rice condemned what she said was Syria's "murderous rampage" over the last year. Asked if Syrian government shelling of Homs on Saturday was a violation of the ceasefire, Rice said: "Absolutely".
The U.N. estimates Assad's forces have killed more than 9,000 people in the uprising. Syrian authorities say foreign-backed militants have killed more than 2,500 soldiers and police.

ISLAMABAD (Reuters) - Pakistan will deport the widows and children of former al Qaeda leader Osama bin Laden to Saudi Arabia next week after their jail sentence for illegal residency ends, their lawyer said on Friday.
The three women and two children were detained by Pakistani security forces after a secret U.S. special forces raid killed bin Laden in the Pakistani town of Abbottabad in May last year.
Earlier this month a Pakistani court sentenced the women to 45 days in prison for illegally staying in the country. It ordered their deportation after the prison term which began on March 3 when they were formally arrested.
"They are likely to be deported to Saudi Arabia on April 18, as their sentence ends on April 17," the family's lawyer, Aamir Khalil, told Reuters.
The three widows and the children were among the 16 people detained after the U.S. raid. Two of the wives are Saudi nationals, and one is from Yemen.
The family is being held at a house in the Pakistani capital Islamabad.
Analysts had said Pakistan may have preferred a lengthy prison sentence for the family to prevent them from discussing details of their time in the country.
Once outside Pakistan, bin Laden's relatives could reveal details about how the world's most wanted man was able to hide in U.S. ally Pakistan for years, possibly assisted by elements of the country's powerful military and spy agency.

DERA ISMAIL KHAN, Pakistan (AP) — Taliban militants armed with automatic weapons and rocket-propelled grenades battled their way into a prison in northwest Pakistan on Sunday, freeing close to 400 prisoners, including at least 20 described by police as "very dangerous" insurgents, authorities and the militants said.
The raid by more than 100 fighters was a dramatic display of the strength of the insurgency gripping the nuclear-armed country. The escaped prisoners may now rejoin the fight, giving momentum and a propaganda boost to a movement that has killed thousands of Pakistani officials and ordinary citizens since 2007.
The attackers stormed the prison before dawn in the city of Bannuclose to the Afghan border, said police officer Shafique Khan. They used explosives and hand grenades to knock down the main gates and two walls, said Bannu prison superintendent Zahid Khan.
"They were carrying modern and heavy weapons," said Zahid Khan. "They fired rockets."
Once inside the building, the attackers headed straight to the area of the prison where death-row prisoners were being kept, he said. They fought with guards for around two hours, setting part of the prison on fire before freeing the 380 inmates, including at least 20 "very dangerous Taliban militants," said Shafique.
One escaped prisoner, Adnan Rashid, was on death row for his involvement in an assassination attempt against former Pakistani President Pervez Musharraf, said Zahid Khan.
The prison in Bannu housed 944 inmates.
A Taliban spokesman, Asimullah Mehsud, claimed the movement's fighters freed 1,200 of their comrades. The group is known to make exaggerated claims.
Pakistan's military has launched a series of operations against the Pakistani Taliban group in the northwest, where it is strongest and has forged alliances with al-Qaida and other transnational militant movements based there along the Afghan border.
The movement is closely linked to the Afghan Taliban, which is battling U.S. and NATO troops in Afghanistan.
Soldiers and police have killed or arrested hundreds of militants, but the insurgency has proved resilient. Insurgents have carried out suicide bombings and other attacks across the country in retaliation, raising doubts in some quarters over whether the county can survive. Prison breakouts like the one Sunday have been rare.
Bannu city is the main gateway to North Waziristan, the most militant-infested region along the border.

Georgia's 'Stand Your Ground' Law Challenged

    ATLANTA (CN) - A Baptist minister sued Gov. Nathan Deal and the Georgia attorney general, challenging the state's "Stand Your Ground Law," which allows people to use deadly force outside their home if they feel threatened.
    The Rev. Markel Hutchins, 32, a minister and civil rights leader, claim's Georgia's law, enacted in 2006, violates constitutional rights of due process and equal protection, and civil rights laws.
    So-called Stand Your Ground laws have come under scrutiny since the shooting death of 17-year-old Trayvon Martin in Sanford, Fla. Martin's killer, Neighborhood Watch volunteer Georgia Zimmerman, was charged with second-degree murder on Wednesday, the day after Hutchins sued Gov. Deal and Attorney General Samuel Olens, in Federal Court.
    Under Georgia's law (O.C.G.A. 16-3-23.1), a person is justified in using force intended or likely to cause death or great bodily harm to prevent the commission of a "forcible felony" if "he or she reasonably believes that such threat or force is necessary to defend himself or herself or a third person against such other's imminent use of unlawful force," according to Hutchins' complaint.
    Hutchins claims the law is unconstitutionally vague and wants its enforcement enjoined.
    At issue is what constitutes a "reasonable fear," Hutchins says in the complaint.
    "It is without question that the determination of the reasonableness of one's fear in the invocation of self-defense will differ in application if the decedent is an unarmed elderly white woman as opposed to an unarmed young black man," the complaint states. "Thus the reasonable person standard with regards to the use of self-defense when an individual is standing one's ground offers different levels of protection to individuals based upon their race."
    Before Georgia's law took effect as part of S.B. 396, critics "argued that law-abiding citizens already enjoyed sufficient protection under Georgia law and the Act will 'do nothing except make it more difficult to prosecute the overly trigger-happy among us.' For these reasons no African-American Senator voted in favor of SB 396 which created the Act," Hutchins says in the complaint.
    "Critics further voice concerns regarding the 'reasonable person' standard. They feared that the Act's reliance on a victim's reasonable perception would lead to the unnecessary use of lethal force, especially when the alleged aggressor is of a different race, and that jurors will be sympathetic to that perception where they share a common race with the victim.
    "SB 396 never defined what a reasonable perception constituted," the complaint states.
    It continues: "By not defining what actions create a reasonable perception justifying the use of deadly force, the Act, potentially deprives all Georgians' of the right to life without due process of law in contravention of the 14th Amendment of the United
    States Constitution as the law is so vague as to not apprise a person of common intelligence of the bounds of lawful behavior.
    "Further, as the act does not define what evidence can be used to establish a person's reasonable fear it creates the risk of arbitrary enforcement in violation of the equal protection clause of the 14th Amendment of the United States Constitution.
    "Because the Act infringes upon the fundamental due process right of life it must be reviewed under strict scrutiny. United States v. Carolene Products Co., 304 U.S. 144, 58 S. Ct. 778, 82L. Ed. 1234 (1938)."
    The complaint adds: "(B)y statutorily codifying the right to stand one's ground outside of an individual's residence or place of business, the Act created a new right for individuals to use deadly force based upon their 'reasonable fear' that a violent encounter may happen without first attempting to withdraw and without regard to the proportionality of the response. This new right allows individuals to respond to what they believe to be a threat with deadly force even where no deadly threat existed without the need to first attempt to escape the threat.
    "By creating a right to kill based upon an individual's reasonable fear without defining what circumstances would demonstrate 'reasonable' the Act will potentially deprives individuals of their lives without due process of law.
    "As 'reasonable' is not defined there is no way for an individual to comport his action within the confines of the law and as to prevent being slayed due to the reasonable fear of another. ...
    "Additionally, courts around the country have accepted that the race of an individual is relevant evidence in determining the reasonableness of a claim of self-defense. See People v. Goetz, 68 N.Y.2d 96 (2001)."
    Hutchins is represented by Robert H. Patillo II of Atlanta.

New legislation awaiting signature

Gov. Nathan Deal is expected to sign into law this week a raft of legislation adopted by the Georgia General Assembly, and a number of bills have already made it past his desk.

Local lawmakers spoke about several initiatives that generated interest in Northwest Georgia:

Tougher restrictions on dangerous dogs and stricter penalties for negligent owners will go into effect July 1 under House Bill 685.

The measure passed both chambers by wide margins and is awaiting the signature of Gov. Nathan Deal.

State Rep. Christian Coomer, R-Cartersville, said the measure is a combination of two bills that stirred up a lot of heat on both sides.

“At first the debate was a ban on all fighting breeds versus no restrictions on how owners deal with their animals,” he said. “What we came up with in the end is a valid, reasonable set of laws that will help owners know what their rights and responsibilities are.”

The law doesn’t target specific breeds. Rather, dogs can be classified as “dangerous” or “vicious” if they attack people or other animals or destroy property. The classifications come with increasing restrictions.

An owner of a vicious dog that injures someone a second time may be convicted of a felony. Punishment would be jail-time of one to 10 years, a fine of $5,000 to $10,000, or both.

The Floyd County chief magistrate and probate court judge positions will no longer be partisan elections under Senate Bill 533, which has been signed by the governor.

None of the other local judgeships are decided by party.

“The Rome Bar Association particularly wanted that bill passed, and the judges have wanted it for a long time,” said state Rep. Katie

Dempsey, R-Rome. “And I agree. Judges should be elected nonpartisan and serve nonpartisan.”

It’s unclear if the change will take effect in time for the July 31 nonpartisan elections because the U.S. Department of Justice must sign off on the change. The Justice Department has as many as 60 days to review the law, although a request for expedited consideration could speed the process.

The state formula for determining equalization grants to school systems, revised under House Bill 824, also reduces the money allocated for the school grants.

Both the Rome and Floyd County school systems are planning additional teacher furlough days in the 2012-13 school year to absorb cuts expected to top $500,000 each.

Local delegates voting against the measure were Dempsey, Coomer and state Rep. Barbara Massey Reece, D-Menlo. The other two, state Sen. Barry Loudermilk, R-Cassville, and state Rep. Rick Crawford, D-Menlo, supported the bill.

Reece said she initially voted in favor of the change because there is an inequity in the way state money is distributed. She changed her vote, however, after the Senate added minimum levels for local millage rates.

“I felt it would result in many of our poorer systems having to raise their tax rates to be eligible,” Reece said. “I know it’s a cut to Floyd County and Rome schools, but we are not the poorest areas in the state. It bothered me, but I felt the (new) formula was much fairer.”

But she said the loss won’t be as great as it appears on paper because it’s been several years since the state has fully funded the equalization grants.

Legislation aimed at job creation focused on tax breaks and restructuring.

Dempsey said the tax reform package will help level the playing field for small businesses with a provision that requires sales tax to be collected by online sellers with a presence in the state.

“Our retail businesses in Rome will be competing in a more fair way with Internet sales,” she said.

The lawmaker also labeled as “citizen-friendly” the creation of a Georgia Tax Tribunal where taxpayers can appeal a state assessment or a denial of a refund claim.

Dempsey and Reece also praised a new tax exemption on energy used in manufacturing, but Reece said most of the business boosts went to large corporations.

“There were bills to help Delta and Gulf Stream. I voted against them,” she said. “I really expected more directed toward small businesses. I think they need breaks more than those making huge profits at this point.”

The criminal justice reform bill expanded the use of alternative sentencing.

“That’s a big deal,” Coomer said. “It changes how we deal with petty crimes in Georgia. We’re trying to focus more on prevention, getting to the root cause of the crimes, instead of just dealing with the punishment angle.”

The Special Council on Criminal Justice Reform pushed the state measure, which reduces sentences for non-violent crimes such as thefts, burglaries and forgeries — and gives drug offenders a better chance at treatment programs.

“(I)nmate population growth is due in large part to policy decisions about who is being sent to prison and how long they stay,” reads the Council’s final report. “The data shows that drug and property offenders represent almost 60 percent of all admissions. Importantly, many of these offenders are identified as lower-risk.”

The idea is to help criminals who can be rehabilitated and save the prison space for violent or career offenders, Coomer said.

Chairman Kevin Abernathy opened the meeting Wednesday of the Georgia Government Transparency & Campaign Finance Commission by announcing that the pending investigations remain ongoing. He was responding to Tuesday’s story in The Atlanta Journal-Constitution reporting that the commission’s executive secretary used her authority to administratively close a case alleging the governor made an improper appointment to the commission.
“The other three are currently pending before our agency and are being worked on very diligently by our agency,” Abernathy said. “To date, the Governor’s Office and the governor’s lawyer have been extremely cooperative with us and our staff, and it’s our expectation that they will continue to be cooperative. We have the internal goal of having resolution by the end of the calendar year.”
However, he declined to offer specific information about the status of the probes.
“Rest assured that it is absolutely at the top of our priority list and it is being handled correctly, with due diligence and a deliberative fashion to make sure we have all the facts we need,” he said.
Executive Secretary Holly LaBerge said she understands the questions the public might have about the progress in the cases.
“I realize it may not be apparent to the public because, if it’s an ongoing case, we do not comment on the status of it. It may appear that nothing has been done on these cases because nothing has been presented in a commission meeting yet,” she said, adding that a commission attorney had continued to press them along with the rest of the backlog of complaints about other officeholders and candidates.
The remaining cases against Deal, one filed two years ago, stem from his 2010 campaign for governor. One alleges he overcharged his campaign for use of a plane he owned as a way to funnel donations into his pocket at a time when he had money problems. Another questions whether he improperly accepted money from donors who had exceeded their contribution limits, and the third charges he used campaign funds to pay lawyers defending him in an ethics case over his former congressional campaign.

The state ethics commission dismissed a complaint against Gov. Nathan Deal in February, the Atlanta Journal-Constitution has learned, but others -- including one more than two years old -- are still pending.  And the commission refuses to say whether the outstanding cases are close to being resolved.

Commission staff on Feb. 24 told government watchdog George Anderson that his complaint regarding Deal's appointment of a commission member had been dismissed. A letter from commission executive director Holly LaBerge explained the case had been dismissed because "there is no basis for proceeding with this complaint" under the state's ethics laws. The complaint was filed in September.
But a number of other complaints, including one Anderson filed in March 2010, have yet to be acted upon. LaBerge, in an email to The Atlanta Journal-Constitution, last week said the "other complaints filed against Deal are still open cases and therefore it is not appropriate for me to comment on the status of them."
Those complaints dealt with a variety of allegations, all centered around Deal's successful bid for the office in 2010. The complaints question whether Deal personally profited from his campaign's aircraft rentals, whether he improperly used state campaign funds for legal bills related to a federal ethics investigation and whether he accepted campaign contributions that exceed limits for political contributions. Violations of the state ethics laws typically result in fines, although criminal charges can be brought in extreme cases.
Deal's campaign lawyer, Randy Evans of the McKenna Long law firm, has called the complaints frivolous. Based largely on reporting by the AJC, the complaints ultimately led to a shake-up at the commission that delayed the investigations.
May 3 is the one-year anniversary of an attempt by former commission executive director Stacey Kalberman and her top deputy to issue subpoenas to Deal's campaign for records. The commission itself, however, never agreed to sign the subpoenas and they were never served. The dispute between staff and the commission led to Kalberman agreeing to resign while her chief investigator's job was eliminated.
The commission hired LaBerge in August. Three of the five members of the commission are appointed by the governor, one is named by Senate leaders and one by the speaker of the House.
Instead of issuing the subpoenas, the commission asked the Deal campaign to voluntarily turn over records. Evans said last week that the campaign has complied.
"Yes, we are providing information as requested," Evans told the AJC. "As you know, many complaints (none meritorious) were filed. As we move through the process and work through the claims, we provide information as requested. Our commitment remains that the same since information validates our position on the various claims."
But Evans would not provide details about what has been provided. A spokesman for Deal referred questions to Evans.
It's time for the commission to act on the complaints, and beyond time for it to update the public on their efforts, said William Perry, executive director of Common Cause Georgia, a government watchdog group.
"It’s in the best interest of everyone involved, especially the governor, to quickly and thoroughly resolve the cases," Perry said. "Certainly, because so much public information is out there that makes these particular cases unique and it would seem appropriate for the commission to give some sort of update."

Perdue's phony claim comes back to haunt

A year and a half ago, then-Gov. Sonny Perdue triumphantly toured Georgia to brag about having improved the state’s graduation rate.
Not even a Russian circus contortionist could accomplish such protracted back-patting. Perdue claimed in visits to several schools that the graduation rate, since he took over the governor’s mansion from former Gov. Roy Barnes, had increased 17 percentage points.
It was no coincidence that Perdue’s triumphant trip was timed to land just a couple of weeks before the general election, in which Democrat Barnes was up against Republican Nathan Deal.
Deal won the race, and inherited the education system that Perdue claims to have rescued. Just one problem, as we saw last week: Perdue’s numbers were faked, and he knew it.
In fact, everyone knew it. I said so, right here, in this space, on Nov. 3, 2010. In a column titled “After Perdue comes the fall,” I pointed out that Perdue and the state Department of Education were using a system to calculate the graduation rate that was designed specifically to make the numbers look better than they actually are.
“Perdue knows not only that his claim of improvements is based on smoke and mirrors, but he knows it will disappear next year when the state uses a more honest assessment,” I wrote.
So here we are. As we saw last week, state officials were forced to replace Perdue’s congratulatory tour with a tap-dancing act when Georgia was forced to report its graduation rate using a formula dictated by the federal government.
As a result, Georgia’s graduation rate appears to have plummeted. Keep in mind, there really isn’t any significant difference, either way, in the number of students failing to finish high school. This is only about how that number is calculated and reported, using a “cohort rate” vs. a “leaver rate.” The difference between the two methods equals exactly who cares.
In a nutshell, Perdue and state education officials were using a formula that overstated the graduation rate. They knew they were doing so, and Perdue did it just to preen.
And now, the new governor and new state school superintendent are having to use the same formula as everyone else in the country – one that quite possibly exaggerates the rate in the other direction.
Based on this switch in methods, Columbia County’s graduation rate also dropped – to frightening levels at some schools. But I have zero confidence in even those numbers. It’s not because the calculation is still phony, but because it just lacks common sense.
When it really comes down to it, we don’t need to report the “graduation rate.” We need to track the “dropout rate.” In other words, we should be able to determine how many students, as a percentage of the school population, quit school and never earn a diploma or GED. Those are the people who ought to be targeted for help, not kids who take an extra semester to finish.
And in addition to targeting dropouts, we should target lying politicians who screw up the school system while claiming to fix it.

Schneiderman assists in DOMA challenge

Attorney General Eric Schneiderman has filed an amicus brief supporting a challenge to the federal Defense of Marriage Act.
“The federal Defense of Marriage Act clearly violates the principle of equal justice under law as enshrined in the U.S. Constitution and improperly intrudes on the traditional role of states in defining marriage,” said Attorney General Schneiderman. “The State of New York has long recognized out-of-state, same-sex marriages and the enactment of the Marriage Equality Act further cements our state’s position on this critical civil rights issue My office will fight every day to defend the fundamental guarantee of equal protection under law for all New Yorkers.”
Schneiderman’s filing supports Edie Windsor, a lesbian who married a woman in Canada but was denied tax benefits related to her inheritance when she passed away. She, and now Schneiderman, contend this violates Windsor’s due process rights under the Fifth Amendment.
The filing is below. Earlier this year, Barack Obama directed the Department of Justice not to defend against lawsuits challenging DOMA. Legislators are also working toward its repeal.

Little was traveling northbound on I-85 near Buford Highway around 12:30 a.m. when she was stopped by Atlanta police, who clocked her at 91 mph -- 36 mph over the speed limit.
The former DeKalb County prosecutor refused field and chemical sobriety tests, according to an APD spokesman, resulting in a charge of DUI Less Safe. That charge requires the arresting officer to testify he or she noticed unsafe driving patterns that would signal impairment due to alcohol or drug use.
APD spokesman Curtis Davenport said Little presented an expired DeKalb DA’s identification card at the time of stop, saying she had just left the office two months ago.
Little, 33, and law partner Doug Chalmers were hired by Andrea Sneiderman in mid-March during the trial of her former boss, Hemy Neuman, who was sentenced to life in prison for killing the Dunwoody woman's husband.
Sneiderman may soon face criminal charges herself. ADeKalb County grand jury has subpoenaed Channel 2 Action News for the entirety of her testimony given during the Neuman trial. DeKalb D.A. Robert James told the Atlanta Journal-Constitution he believes Sneiderman was involved in her husband's death.
Chalmers declined comment Thursday when reached by the AJC.
Little, former president of the DeKalb Bar Association, posted bond and was released early Thursday morning.
The arrest is not expected to affect her standing in the Georgia Bar Association. According to the bar's ethics counsel, Bill Smith, attorneys are typically not sanctioned for misdemeanor DUI charges.
