Rick Santorum visited Illinois last night stopping at Christian Liberty Academy in Arlington Heights, a Chicago suburb, for a 7PM rally that drew over 2,000 people who came to hear the presidential primary candidate speak.

The place was packed with all the gym bleachers filled and most of the balcony seating also filled, not to mention standing room only on the gym floor. The capacity seating of the place was 2,500, but one is tempted to think that they allowed a bit more than capacity to rally for Rick.
An array of elected officials and long-time activists appeared to support the candidate. The crowd was energetic and Santorum signs were waved enthusiastically at many moments during Rick’s address.
On the days before Sen. Santorum took the podium were such notables as Al Salvi and his wife Kathy, former Illinois politician Penny Pullen, State Rep. Tom Morrison, and New York Times writer Brad Thor.

Senator Santorum took the stage to raucous applause and gave a speech laden with allusions to the founding fathers, the economy, and religious freedom. He also bashed President Obama over Obamacare and his abject failure to fix this economy.
There was only one interruption when three gay activists near the entrance screamed out some inaudible taunts, gave each other a kiss, and were quickly escorted out by police. The disturbance lasted about a minute.
The speech was very well received, though it seemed obvious that the candidate was beginning to lose his speaking voice. Santorum’s voice was occasionally raspy.

Karl Rove says brokered convention won’t happenThe odds are greater that there’s life on Pluto than that the GOP has a brokered convention. And while there’s a better chance of a contested convention, it’s still highly unlikely,” Karl Rove writes in his Wall Street Journal column today. “Consider the calendar and the math. After Super Tuesday on March 6, a new candidate could still file for the Nebraska beauty contest, the Minnesota caucuses, and the primaries in New Mexico, California, Utah, South Dakota, New Jersey and Texas. Those eight contests have 519 delegates at stake: 238 awarded winner-takes-all, 241 split proportionally and 40 unpledged. If a new candidate gets all the winner-takes-all delegates (unlikely since 222 in California and New Jersey are awarded by congressional district, not statewide), plus half those awarded proportionally, he still would have just 378 delegates of the 1,144 needed for nomination. At least two current candidates are likely to have far more. Why would they step aside for a newcomer? Meanwhile, a brokered convention needs party bosses, and today there aren’t any.”

Sec. 201. Bribery of public officials and witnesses

(2) the term "person who has been selected to be a public official" means any person who has been nominated or appointed to be a public official, or has been officially informed that such person will be so nominated or appointed; and
(3) the term "official act" means any decision or action on any question, matter, cause, suit, proceeding or controversy, which may at any time be pending, or which may by law be brought before any public official, in such official’s official capacity, or in such official’s place of trust or profit.
(b) Whoever—
(1) directly or indirectly, corruptly gives, offers or promises anything of value to any public official or person who has been selected to be a public official, or offers or promises any public official or any person who has been selected to be a public official to give anything of value to any other person or entity, with intent—
(A) to influence any official act; or
(B) to influence such public official or person who has been selected to be a public official to commit or aid in committing, or collude in, or allow, any fraud, or make opportunity for the commission of any fraud, on the United States; or
(C) to induce such public official or such person who has been selected to be a public official to do or omit to do any act in violation of the lawful duty of such official or person;
(2) being a public official or person selected to be a public official, directly or indirectly, corruptly demands, seeks, receives, accepts, or agrees to receive or accept anything of value personally or for any other person or entity, in return for:
(A) being influenced in the performance of any official act;
(B) being influenced to commit or aid in committing, or to collude in, or allow, any fraud, or make opportunity for the commission of any fraud, on the United States; or
(C) being induced to do or omit to do any act in violation of the official duty of such official or person;

(c) Whoever—

A new report measuring states on the strength of their laws on public corruption and government openness ranks Georgia last in the nation, a grade state officials dismissed as a biased hit job.

The report, released today, scored states on 330 “corruption risk indicators” including open records law, campaign finance rules, and auditing and budgeting procedures. Georgia received an overall grade of 49 out of 100, an F.
The study was conducted by the Center for Public Integrity and Global Integrity, two Washington-based nonprofits that champion government reform, and Public Radio International, using journalists and academics from across the nation to compile the data. Representatives for the groups said it is the most thorough and wide-ranging study ever done on government accountability.
Georgia officials, who based on previous reports said they were surprised the state did so poorly, questioned the criteria used and the man selected to conduct the initial audit.
The report awarded no A’s, but most states passed the exam. New Jersey received the highest grade.
Officials with the CPI and Global Integrity said New Jersey’s ranking might seem “counterintuitive,” given the state’s history of public corruption cases. CPI Executive Director Bill Buzenberg said public scandals often prompt state legislatures to pass the toughest ethics laws, which is what the report attempts to grade.
“We’re not measuring actual corruption,” said Caitlin Ginley, the project manager for the report. “This is a look at the opposite: the laws, policies and procedures in place to prevent corruption and how effective they are.”
Georgia scored at or near the bottom in a number of categories in the study, including conflict-of-interest laws for civil servants, enforcement of ethics rules and government procurement laws.
House Ethics Committee Chairman Joe Wilkinson, R-Sandy Springs, said the report blindsided him, and he criticized the choice of author for Georgia’s report card. Jim Walls, a former Atlanta Journal-Constitution editor and owner of the website Atlanta Unfiltered, gathered, wrote and provided an initial score on the information on Georgia for the report.
“To have Georgia’s laws judged by a blogger instead of a regulatory official, as has been done in the past, is of great concern,” he said. “Based on previous discussions with the Center for Public Integrity, we were under the assumption that the 2012 rankings would show Georgia in the top five states.”
A prior CPI study on financial disclosure rules for state legislators ranked Georgia seventh in the nation. Wilkinson has trumpeted the ranking in recent months in rebuttal of calls for tougher ethics laws.
Wilkinson said he plans to ask the CPI to do a new audit on Georgia’s laws with another author.
“We have worked very closely with CPI over the years, followed their advice,” he said. “The problem is not CPI. The problem is that it was Jim Walls.”
CPI spokesman Randy Barrett said the organizations stand behind the report.
“The state has a multitude of weaknesses, not the least of which is the lack of an ethics commission with powers to broadly enforce state ethics laws, including conflicts of interest and nepotism,” he said. “Georgia ranks last in the investigation for a reason: The public trust is not being adequately protected.”
Walls said every one of the questions he was asked to address in the study was backed by news articles, government documents and interviews conducted over several months. He said his work was heavily fact-checked and edited for several more months leading up to today’s release.
“There were two or three layers of proofreading and peer review, and we’d go back and forth on some things,” he said. “Sometimes they would say, ‘We think this deserves a higher score or a lower score.’”
Rick Thompson, a former executive director of the State Ethics Commission, called the report biased and disappointing.
“All you have to do is read some of these opinions and how they’re answered to see there’s a whole lot of room to inject your opinion in,” he said. “The reports CPI used to do were campaign finance, disclosure and lobbying. This one seems to be more how does the government work in the view of a reporter.”
Of particular concern to Thompson were areas in which the report graded the state on how well laws worked “in practice.” Georgia scored low on many of those questions.
Officials behind the report said all the state report cards were fact-checked by another expert whose identity was kept from the original author. Global Integrity Executive Director Nathaniel Heller said Georgia officials who criticized the report last week had not seen the sources used to determine the state’s failing grade. Those details are scheduled to be released today with the report.
“These are essential, especially in the context of ‘in practice’ indicators, and may change their reaction,” he said.
William Perry, executive director for Common Cause Georgia, said he had seen a preliminary scorecard and found it “pretty accurate.”
“I think that some of the scoring is kind of generous,” he said. “I think this is true measurement of the law that the Legislature has been touting for the last two years.”
Common Cause is part of a coalition of groups advocating for tougher ethics laws, including a cap on lobbyists’ gifts to legislators.
Chuck Gabriel, an Atlanta attorney and former public corruption investigator for the FBI, said there is no doubt that the state’s ethics laws can be strengthened, but this report “misses the mark” by judging the state too harshly based solely on transparency laws. Criminal convictions are what really stops corruption, he said. Georgia has a pretty good track record when measured that way, he said.
“The conviction of dirty cops, corrupt legislators, unscrupulous business persons and political hacks is the true deterrent to corrupt behavior,” he said, “and those criteria ... ought to be the basis for grading this state.”

To Sahar Hekmati and Sue Everhart:

It is not enough that Sue Everhart has "tried" to do something regarding the past issues of Clayton County with the misappropriation and breach of public trust under former Sheriff Victor Hill, or that she has "tried" to straighten out the mess of all of the money missing from the HC GOP. I do understand your frustration and hers, because during the last election cycle, Karen Handel did not make businesses pay 25% of tax revenue, even though we were in a budget shortfall. Instead of investigating various counties contributing to straining our entire state's budget, she resigned when former Governor Perdue confronted her about it, and she lost the party nomination to Governor Deal. She failed to do the job that we hired her to do by electing her to the Secretary of State's Office. A lot of people feel the same way about Sue Everhart, for the GOP Chairmanship. They attribute Karen Handel doing this for votes or as political favors.

This could go either way for Sue Everhart, she can cooperate and assist investigating agencies to resolve these issues and eradicate those exploiting the party for their own personal gain, or she can depend on the very ones that she is friends with on Facebook, like Karen Handel and others, to vote for her again. I do not think the taxpayers or the GA GOP will be so inclined to support Sue Everhart, if Sue Everhart does not investigate HC GOP for misappropriation and breach of public trust for the districts who obviously never received the money for the get-out-the-vote when it was divided up amongst 6-10 people and never put back into the HC GOP trust for the party.


As you allege here, that there is only $2,600 left in the bank with $50,000 missing/handwritten receipts, and no physical receipts from the offenders listed below in previous communications within the HCGOP to show what they actually spent the money on, since they divided that $50,000 six to ten ways between themselves and have not proven to us what they actually spent the money on, as it seems we are left with $2,600 to make posters and for advertising, which is very embarrassing for Henry County and reflects badly upon the GA GOP as a whole:

Your concerns were forwarded to the Governor's Office, the GGT&CFC http://www.ethics.ga.gov, and the Inspector General's Office.

I can also assure that appropriate news and law enforcement agencies have this information, in order to hold them accountable or for prosecution of  possible criminal wrongdoing. You have done nothing wrong in telling me or showing me this information, but because of what is required to maintain my reputation as a lobbyist, I can't just sit on the information or write newsletters about it; it is my job to dutifully report it to those who have access to more information and authority over these matters.

You may also want to watch the WSB-TV2 news special today about businesses who got taxpayer money, in the form of loans or stimulus dollars that is GA's "Bridge to Nowhere". The Ethanol project failed, the funds were not used properly for it either, and no results were  procured. Taxpayers look at this, and this is what they remember when they vote their local leaders into office.

Taxpayers want results, and that is why many people do not feel as loyal to Sue Everhart anymore, because she did not perform the job as Chairperson that she was elected to do, to hold HC GOP accountable, by reporting those misusing funds for get-out-the-vote. She will need to convince the taxpayers that she deserves re-election. Do not be inclined to support her in the wrong things because you are her campaign assistant.

There was about 40K and 24 was or so was given to Charles to get the vote out.. Now the GOP in Henry has less then 2k.

Steve Davis found out about some funds that the state was giving to local Henry County to bid on.. He bid on it and took the money before anyone knew about it. He has a real estate company and he took 25k of county money and is not willing to give it back. He was not the only one, there was another Rep, but he returned it all back.  I will send you the story..

His son run for District 5 school board, and was only 19 at the time, but called his opponent and made threats against him. The opponent was recording him and it was on the news. The report is filed with Henry County police. His son name Ryan Davis.

Mike Eddy, current Henry County GOP chairman, at the time the money was given to Charles 24K, was the finance Chair.

Now as the Chair he makes all the copies for the GOP on the expense of Henry County Public School because he is the Principle at an Elementary School here, during our executive meetings when I was the Secretary, he would make a joke and say, gift from Henry County School System. That is not right when teachers are only allowed certain amount of copies per day. It is all about dignity.

Allisande Gelineau is the current Chair for 13 District, she has started lots of things and has made a name for her self, but yet the story is, not sure if it is TRUE. She made it to Major in the Army, but never moved up, after 18 years, she left the Army and got into politics. Was aid to Davis clan..

Sam Fleet, I don't know where she came from, but she is with them and now has a political consulting company called Tanner and Fleet I believe their on FB . And is making money from candidates running for office.

Tommy Smith started down this road on December 11th.  I have answered every open records request he has asked for yet he has not called one time to ask questions or discuss any of the following information.  Once Mr. Smith receives any information he then forwards it across the county without having any understanding of what he is talking about.  I was asked by Larry Stanley to explain/defend my actions as Tax Commissioner and I have done so.  Earlier this year, January 4th, I gave a presentation to the BOC (http://henryga.granicus.com/ViewPublisher.php?view_id=2) explaining the good work we are doing.  It has become a habit for Mr. Smith to insinuate someone is doing something wrong, yet never stating exactly what that something is.  If Mr. Smith has any suggestions as to better collect the taxes for Henry County perhaps he would like to share them.  I am always willing to listen.

On or about February 2, 2009, the Henry County Tax Commissioner attended a BOC meeting and asked them to approve a resolution delegating authority to him to make a final determinations regarding the wavier of assessed penalties and interest on unpaid Ad Valorem taxes.  The Tax Commissioner stated to the Board that he had an old lady that could pay her taxes, but could not pay the interest and penalties for being late. He also stated that he had a bank that inherited some land through no fault of their own.  He said that he really wanted to help them.  The BOC approved Resolution 09-18 approving the Tax Commissioner’s request.

I am in receipt of the spreadsheet provided to Tommy Smith. I do have a question about some of the 6,148 entries.  In residential developments I see a lot of individual addresses under the name of the developer. Are these houses that have not sold yet? I also see some rather large amounts waived for the same developers. Please give me some kind of response as I plan to raise queries in the newsletter -- I would rather have your direct explanation to accompany the article.  Thanks for your help in understanding this spreadsheet.

Mr. Curry’s response:
On December 10, 2010, Tommy Smith sent an open records request letter to Henry County. The request sought information concerning all penalties and interest that had been waived since February 2, 2009 from this office, Henry County Tax Commissioner’s office. I answered his request and sent the information on February 21, 2010.  Before I begin I would like to give a little background.
The authority to make the decision (O.C.G.A. 48-5-242) to waive penalties and/or interest is nothing new to Henry County nor is it different from most of the larger counties in Georgia. The past administration had an oral understanding it was okay to waive penalties and interest when he found it necessary. However, I did not feel comfortable making those financial decisions without having the support and written permission from the BOC. Therefore, on February 2, 2009 I stood before the Board of Commissioners, attendees, and the viewers of Channel 14 and asked for the authority to waive penalties and/or interest as I saw reasonably fit. Over the last 2 years there have been instances it was necessary to do so and I will explain in detail later in this e-mail.  Since Mr. Smith received our response to his open records request there have been numerous e-mails sent back and forth and most of them reiterate my opinion, I believe Mr. Smith does not understand what he is reading.  I want to address some of the language being used in the e-mails and some of the misconceptions.
First - Never, have I or this office waived taxes. Taxes cannot be waived. When taxes are due, it is the responsibility of this office to collect them. We use every available resource to do so (O.C.G.A. 48-5-234). When money was waived it was the penalty portion only and not the tax portion.
Second - Permission was given to waive penalty and interest. With that said I met with my leadership team and we discussed how we could help our taxpayers. I did not want to create a mindset that supported the idea of paying your taxes when you felt like it, however I vowed to help our taxpayers. We needed to have a plan to help while also promoted the idea everyone needed to pay their taxes on time. While penalties and interest may have been waived prior to me taking office I decided it was in the best interest to all not to waive the interest portion of the bill. The interest is 1% monthly, 12% annually.
Third – On February 2, 2009, one of the commissioner’s asked how I would determine who would or would not receive a penalty waiver. To be honest, this question was not easy to answer then nor is it any easier today. We look at each case separately. With that said, there are those instances where we simply cannot by law charge a penalty. We tried to explain that in our response to Mr. Smith but apparently it fell on deaf ears.
Here are some of the reasons we cannot charge a penalty.
1. FDIC collections (FDIC 12 U.S.C. 1811, et seg., section 15 of FDIA (d) –
In 2009 we had a record number of local community banks fail in Henry County. When the FDIC came in, the assets were typically turned over to another bank, for example Regions, and the liabilities would be handled through the FDIC. As we all know 2009 was the worst year Henry County has experienced in a long time for builders and developers. Nearly every one of them lost their companies and the banks were forced to take back their inventory, land, and lots. Once the FDIC came in we were forced to play by their rules and not ours. Simply put the FDIC is the Federal Government and they do not pay penalties, only interest when secured by a lien.
2. Changes in Assessment from the Assessor’s office –
If it is determined there has been a mistake made in the assessment of a piece of property, for example, the property owner was being assessed for having 4 bedrooms and there were only 3 or if a land owner was assessed as having 20 acres and he/she really only owned 15 acres we would re-bill the owner with a new due date. Since the penalty goes on the bill 90 days past the original bills due date we often find ourselves re-billing after the 90 day period with a new amount owed. It can sound a little confusing; however, it is neither fair nor legal for me to charge a penalty on a bill that is incorrect. Once the assessment is correct, a new bill is issued and the penalty is applied if not paid within 90 days.
3. Postmark of payment submitted –
We post payment according to the postmark. A lot of taxpayers wait until the last minute to pay their tax bills. As I mentioned in the above explanation, penalty is applied 90 days past due. If the postmark is on or before the due date and we receive it the next day we remove the penalty. At this point the taxpayer is paying the 1% interest each month the bill is not paid.
4. Certain Bankruptcy cases –
Under Bankruptcy court taxes are paid; however, depending on the type of bankruptcy filed we must get in line with the other creditors and wait our turn to be paid.
5. New Owner notification –
The Assessor’s office must have a date in which they work off of; January 1 is the date. Often the current year’s tax bill is sent to the owner on record as of January 1, 2010. By the time the tax bill is sent out in September the property may have been sold or foreclosed upon. If this is the case, once the assessor’s receive the new address, we send out a new bill.  Again, we cannot charge a penalty because the assessor’s office does not have the new owner’s address.
6. Appeal Resolutions –
It appears many of those selected in your e-mail were either paid by a bank or an appeal had been resolved. Once the appeal is resolved we must wait until the file is given to us from the assessor’s office. Often these are property tax bills that have been taken to Superior court. This process is very lengthy and once resolved, if the appeal resolution pre-dates the application of the penalty, we remove the penalty, as it is not applicable. Again if the bill is not paid within 90 days, the penalty is automatically re-added to the bill.  Mr. Stanley I hope I have addressed your questions. In this sample list roughly two-thirds were from the same developer.  As you can see from my response I worked with Mr. Jones as well as Wachovia to collect $402, 837.63. We did however collect over $58,000 in interest on these 156 parcels. We stuck by what I said I was willing to do. Wachovia and Mr. Jones have been told not to expect the penalty to be waived in the future. I stated earlier in this e-mail, we have a plan to help those willing to help themselves. We are desperately trying to do just that.  I will share some other information we learned last month. We are audited quite often and as of last month Henry County has the best collection rate of personal and delinquent taxes it has had in over 15 years. Our collection rate for 2009 is 96.50% for Personal property, 98.78% for Mobile homes, 97.22% for Real property. Our 2010 is also shaping up to follow 2009. I am very proud of the efforts made by this staff to collect delinquent taxes.  I have placed explanations beside all of the entries. (** Spreadsheet sent to The Citizen) I truly hope this helps. This office has nothing to hide and has always offered an open door policy to anyone who has genuine questions and concerns. There is no “gatekeeper” here. If you have questions, I want you informed. I do find it disappointing that someone would ask for
information from this office and not take the time to understand it or ask questions before sending it out to the masses. Clayton police burn $12M in drugs

Clayton County police burned more than $12 million worth of drugs that had accumulated in the departments crowded evidence room, authorities said.

Police received a court order from a Superior Court judge to allow them to burn nearly 10,000 pounds of marijuana, crystal meth and other assorted narcotics, Clayton County police spokeswoman Lt. Tina Daniel said.

"This is in response to the audit of the police department," Daniel said.

As part of a scathing indictment of former Police Chief Jeff Turner's management of the department, county Chief of Staff Alex Cohilas cited a narcotics evidence room that was "in shambles."

The burns happened on two different occasions, last week and Tuesday, in an undisclosed, secure location, Daniel said.

"This is just a small part of the police department's aggressive efforts to fight illegal drug use and sales in Clayton County," police chief Timothy Robinson said.

The burn was done with the aid of the Clayton Fire and Emergency Services, the Clayton County Sheriff's Office and the Clayton County District Attorney's Office.

The stem cells from aborted bodies used to mass manufacture vaccines or to treat diabetes, MS, or AIDS have not been successful; however, aborted stem cells have been proven to cause rejection as manifesting in intestinal inflammation, autism in a certain percentage of vulnerable people, or causing cancer!

Voters in north Georgia had tired of politics as usual. They demanded something different.

Now they have it — a 9th District congressional race that, instead of ending on Tuesday, will go on and on like a painful but riveting summer soap opera.

The featured player is certain to be former state House member Tom Graves of Ranger, whose lush black hair, easy manner and tea party credentials made him the man to beat in a May 11 special election to fill out the final six months of former congressman Nathan Deal’s term.

Graves walked away with 35 percent of the vote. Odds are good that he’ll win the Tuesday runoff against former state senator Lee Hawkins of Gainesville, a dentist.

Under normal circumstances, the fairy tale would end there. Graves’ defeated opponents would gracefully exit — offering only token, underfunded resistance leading up to a July 20 primary and a full, two-year term in Congress. (No Democrat remains in the contest.)

But we are done with politics as usual, and have shifted to politics of the bizarre — courtesy of an extended-stay motel in Calhoun, nicknamed by its current proprietor as the Methamphetamine 6. In honor of the habits of its clientele.

At the crack of Memorial Day weekend, news broke of a lawsuit filed by the Bartow County Bank, which alleged that Graves and Senate Majority Leader Chip Rogers (R-Woodstock) had defaulted on a $2.2 million loan used to purchase the establishment.

The business case for the Oglethorpe Inn is unclear. But Georgia offers some tasty tax breaks for on-scene movie companies, and perhaps a series of slasher flicks was contemplated.

The 32-year-old motel and debt, Rogers and Graves say, now belong to another company owned by a fellow who wears an electronic monitor on one ankle.

Moreover, Rogers and Graves accuse the bank of reneging on a deal. The bank allegedly made a promise to two sitting state lawmakers — Graves resigned his seat this spring — that it would convert the obligation to a 2.5 percent, interest-only loan. On $2.2 million.

The most damaging feature of the lawsuit is the bank’s accusation that Graves fraudulently transferred two properties — including his residence in Ranger — to a trust in an attempt to frustrate the bank’s efforts to collect on the debt.

Graves supporters say times are hard everywhere, but especially in north Georgia — where real estate has plummeted like a red-tailed hawk on a doomed pigeon.

Graves denies any wrongdoing. “This country has a judicial system in place where business disputes like this lawsuit can be successfully and fairly resolved,” he said.

But the crucible of Washington is not famous for patience.

Assume a Graves victory next Tuesday. His supporters are enthusiastic, and last-minute developments rarely have a significant impact on campaigns.

Graves will be sworn in as soon as the vote is certified. Just as quickly, a complaint against him — third parties can be found, so the author does not matter — will be lodged before a congressional ethics committee to force a speedy assessment of the facts.

Which means that regardless of what happens Tuesday, many of the combatants of the 9th District will refuse to leave the field.

Hawkins took 23 percent of the vote last month. In a statement issued Wednesday, the former senator would not concede defeat in next week’s balloting . But he added this: “Mr. Graves has obviously used some very bad judgment in his financial dealings, and that controversy now apparently won’t end on Tuesday regardless of who wins.”

Likewise, Steve Tarvin of Dalton, a self-made textile executive, declared Graves’ financial situation “unfortunate,” but said he would not withdraw. Tarvin won 15 percent of the vote in May.

“I’m in it. I feel like I’m the true heart of the 9th District. I feel like in July, it’s going to be a different story,” Tarvin said. Of seven candidates who signed up for the July 20 contest, only two have said they would withdraw.

But none have sent the necessary notarized statement to Secretary of State Brian Kemp. As of now, all seven names will appear on the Republican ballot — a near guarantee that a runoff will push the soap opera into August.

The contest is already forcing signs of a split within Georgia’s Republican delegation.

Graves has the support of U.S. Rep. Lynn Westmoreland of Coweta County. But U.S. Rep. John Linder this week accused Graves of lying about the amount of campaigning he’d done on behalf of the Fair Tax.

Kate Monaghan, communications director for the Graves campaign, said her candidate expected a strong showing on Tuesday, equal to the vote in May. And she pointed out that U.S. Rep. Eric Cantor of Virgina, the House minority whip, endorsed Graves this week.

Monaghan singled out the dentist in Gainesville — the population center in the district is weighted toward that city — for criticism.

Georgia last in public corruption laws

A new report measuring states on the strength of their laws on public corruption and government openness ranks Georgia last in the nation, a grade state officials dismissed as a biased hit job.

The report, released today, scored states on 330 “corruption risk indicators” including open records law, campaign finance rules, and auditing and budgeting procedures. Georgia received an overall grade of 49 out of 100, an F.
The study was conducted by the Center for Public Integrity and Global Integrity, two Washington-based nonprofits that champion government reform, and Public Radio International, using journalists and academics from across the nation to compile the data. Representatives for the groups said it is the most thorough and wide-ranging study ever done on government accountability.
Georgia officials, who based on previous reports said they were surprised the state did so poorly, questioned the criteria used and the man selected to conduct the initial audit.
The report awarded no A’s, but most states passed the exam. New Jersey received the highest grade.
Officials with the CPI and Global Integrity said New Jersey’s ranking might seem “counterintuitive,” given the state’s history of public corruption cases. CPI Executive Director Bill Buzenberg said public scandals often prompt state legislatures to pass the toughest ethics laws, which is what the report attempts to grade.
“We’re not measuring actual corruption,” said Caitlin Ginley, the project manager for the report. “This is a look at the opposite: the laws, policies and procedures in place to prevent corruption and how effective they are.”
Georgia scored at or near the bottom in a number of categories in the study, including conflict-of-interest laws for civil servants, enforcement of ethics rules and government procurement laws.
House Ethics Committee Chairman Joe Wilkinson, R-Sandy Springs, said the report blindsided him, and he criticized the choice of author for Georgia’s report card. Jim Walls, a former Atlanta Journal-Constitution editor and owner of the website Atlanta Unfiltered, gathered, wrote and provided an initial score on the information on Georgia for the report.
“To have Georgia’s laws judged by a blogger instead of a regulatory official, as has been done in the past, is of great concern,” he said. “Based on previous discussions with the Center for Public Integrity, we were under the assumption that the 2012 rankings would show Georgia in the top five states.”
A prior CPI study on financial disclosure rules for state legislators ranked Georgia seventh in the nation. Wilkinson has trumpeted the ranking in recent months in rebuttal of calls for tougher ethics laws.
Wilkinson said he plans to ask the CPI to do a new audit on Georgia’s laws with another author.
“We have worked very closely with CPI over the years, followed their advice,” he said. “The problem is not CPI. The problem is that it was Jim Walls.”
CPI spokesman Randy Barrett said the organizations stand behind the report.
“The state has a multitude of weaknesses, not the least of which is the lack of an ethics commission with powers to broadly enforce state ethics laws, including conflicts of interest and nepotism,” he said. “Georgia ranks last in the investigation for a reason: The public trust is not being adequately protected.”
Walls said every one of the questions he was asked to address in the study was backed by news articles, government documents and interviews conducted over several months. He said his work was heavily fact-checked and edited for several more months leading up to today’s release.
“There were two or three layers of proofreading and peer review, and we’d go back and forth on some things,” he said. “Sometimes they would say, ‘We think this deserves a higher score or a lower score.’”
Rick Thompson, a former executive director of the State Ethics Commission, called the report biased and disappointing.
“All you have to do is read some of these opinions and how they’re answered to see there’s a whole lot of room to inject your opinion in,” he said. “The reports CPI used to do were campaign finance, disclosure and lobbying. This one seems to be more how does the government work in the view of a reporter.”
Of particular concern to Thompson were areas in which the report graded the state on how well laws worked “in practice.” Georgia scored low on many of those questions.
Officials behind the report said all the state report cards were fact-checked by another expert whose identity was kept from the original author. Global Integrity Executive Director Nathaniel Heller said Georgia officials who criticized the report last week had not seen the sources used to determine the state’s failing grade. Those details are scheduled to be released today with the report.
“These are essential, especially in the context of ‘in practice’ indicators, and may change their reaction,” he said.
William Perry, executive director for Common Cause Georgia, said he had seen a preliminary scorecard and found it “pretty accurate.”
“I think that some of the scoring is kind of generous,” he said. “I think this is true measurement of the law that the Legislature has been touting for the last two years.”
Common Cause is part of a coalition of groups advocating for tougher ethics laws, including a cap on lobbyists’ gifts to legislators.
Chuck Gabriel, an Atlanta attorney and former public corruption investigator for the FBI, said there is no doubt that the state’s ethics laws can be strengthened, but this report “misses the mark” by judging the state too harshly based solely on transparency laws. Criminal convictions are what really stops corruption, he said. Georgia has a pretty good track record when measured that way, he said.
“The conviction of dirty cops, corrupt legislators, unscrupulous business persons and political hacks is the true deterrent to corrupt behavior,” he said, “and those criteria ... ought to be the basis for grading this state.”

Adams was employed at the City and County of Honolulu Elections Division from May 2008 through September 2008.
His position was senior elections clerk, overseeing a group of 50 to 60 employees responsible for verifying the identity of voters at the Absentee Ballot Office. It was in this capacity that Adams became aware of the search for Obama’s birth-certificate records.
“During the course of my employment,” Adams swears in the affidavit (viewable in full as part 1 andpart 2), “I became aware that many requests were being made to the City and County of Honolulu Elections Division, the Hawaii Office of Elections, and the Hawaii Department of Health from around the country to obtain a copy of then-Senator Barack Obama’s long-form, hospital-generated birth certificate.”
As he inquired about the birth certificate, he says, his supervisors told him that the records were not on file at the Hawaii Department of Health.
“Senior officers in the City and County of Honolulu Elections Division told me on multiple occasions that no Hawaii long-form, hospital-generated birth certificate existed for Senator Obama in the Hawaii Department of Health,” Adams’ affidavit reads, “and there was no record that any such document had ever been on file in the Hawaii Department of Health or any other branch or department of the Hawaii government.”

In a recorded telephone interview, Adams told WND that it was common knowledge among election officials where he worked that no long-form, hospital-generated birth certificate could be found at the Hawaii Department of Health.
“My supervisor came and told me, ‘Of course, there’s no birth certificate. What? You stupid,’” Adams said. “She usually spoke well, but in saying this she reverted to a Hawaiian dialect. I really didn’t know how to respond to that. She said it and just walked off. She was quite a powerful lady.”
Moreover, Adams was told that neither Queens Memorial Hospital nor Kapi’olani Medical Center had any records of Obama’s birth at their medical facilities: “Senior officers in the City and County of Honolulu Elections Division further told me on multiple occasions that Hawaii State government officials had made inquires about Sen. Obama’s birth records to officials at Queens Medical Center and Kapi’olani Medical Center in Honolulu and that neither hospital had any record of Senator Obama having been born there, even though Governor Abercrombie is now asserting and various Hawaii government officials continue to assert Barack Obama Jr. was born at Kapi’olani Medical Center on Aug. 4, 1961.”
“We called the two hospitals in Honolulu: Queens and Kapi’olani,” Adams stressed. “Neither of them have any records that Barack Obama was born there.”
In 2009, WND documented that Obama and his supporters had first claimed he was born at Queens Medical Center in Honolulu, before the story changed to Kapi’olani Medical Center in Honolulu.
After WND’s report on the two conflicting hospitals, online news sites including the United Press International and Snopes.com scrubbed their websites to eliminate any reference to Queens Medical Center, substituting instead that Obama was born at Kapi’olani Medical Center without explaining the discrepancy or the correction.

Hawaii Gov. Neil Abercrombie

In 2010, then-candidate for governor Neil Abercrombie was involved in an Obama birth controversy when he read a letter at a Kapi’olani Medical Center centennial dinner in Honolulu that supposedly was authored by President Obama, claiming Kapi’olani as his birth hospital.
As WND reported, the letter read by Abercrombie and initially displayed on the Kapi’olani website turned out to be a computer-created likeness of a letter using HTML code, the building blocks of Internet websites, not an actual paper letter.
The White House has still not confirmed it wrote or sent the letter.
Moreover, Adams claims, the Hawaii government was engaged in a cover-up designed to tell the American public through the Obama-supporting mainstream media that Obama was born in Hawaii, even though no long-form, hospital-generated birth certificate for Obama could be found on record in the Hawaii Department of Health.
In the affidavit Adams swears, “During the course of my employment, I came to understand that for political reasons, various officials in the government of Hawaii, including then-Governor Linda Lingle and various officials of the Hawaii Department of Health, including Dr. Chiyome Fukino, the director of the Hawaii Department of Health, were making representations that Senator Obama was born in Hawaii, even though no government official in Hawaii could find a long-form birth certificate for Senator Obama that had been issued by a Hawaii hospital at the time of his birth.”
Adams further swears his supervisors told him to quit asking about Obama’s birth records.
“During the course of my employment,” Adams states in the affidavit, “I was told by senior officers in the City and County of Honolulu Elections Division to stop inquiring about Senator Obama’s Hawaii birth records, even though it was common knowledge among my fellow employees that no Hawaii long-form, hospital-generated birth certificate existed for Senator Obama.”
“I can go get my long-form, hospital-generated birth certificate,” Adams told WND. “And so I don’t understand, this whole controversy should have been settled three or four years ago in about five minutes.”
Nor does Adams feel the short-form Certification of Live Birth is authoritative documentation proving that Obama was born in Hawaii.
“My basic assumption is that he wasn’t born there,” Adams said. “Certifications of Live Birth were given to people who were born at home, or to people who were born overseas and whose parents brought them back to the islands. If his parents were U.S. citizens, or if one parent was a U.S. citizen, as was the case with Obama, the family would apply for a Hawaiian birth certificate when the parents came back from overseas. That’s normally how you would have gotten on [a Certification of Live Birth] in the 1960s.”
WND has reported that in 1961, Obama’s grandparents, Stanley and Madelyn Dunham, could have made an in-person request at the Hawaii Department of Health for a registration of a Hawaii birth, even if the infant Barack Obama Jr. had been foreign-born.
In the past few days, Abercrombie has represented that there is a registration of Obama’s birth in the state archives.
But the state registration of birth in 1961 theoretically could prove only that the grandparents had registered Obama’s birth, even if Obama was not born in Hawaii.
Similarly, the newspaper announcements of baby Obama’s birth do not prove he was born in Hawaii, since the newspaper announcements could have been triggered by the grandparents appearing in-person to register baby Obama as a Hawaiian birth, even if the baby was born elsewhere.
WND has documented that the address reported in the birth announcements published in the Hawaii newspapers at the time, 6085 Kalanianaole Highway, was the address where the grandparents lived.
WND has also reported that Barack Obama Sr. maintained his own separate apartment in Honolulu at an 11th Avenue address, even after he was supposedly married to Ann Dunham, Barack Obama’s mother, and that Ann Dunham left Hawaii within three weeks of the baby’s birth to attend the University of Washington in Seattle.
Dunham did not return to Hawaii until after Barack Obama Sr. left Hawaii in June 1962 to attend graduate school at Harvard University in Cambridge, Mass.
It’s possible the yet-undisclosed birth record in the state archives that Abercrombie has discovered may have come from the grandparents registering baby Obama’s birth, an event that would have triggered both the newspaper birth announcements and availability of a Certification of Live Birth, even if no long-form record exists.
WND has confirmed with Glen Takahashi, elections administrator for the city and county of Honolulu, that Adams was indeed working in their elections offices during the last presidential election.
“We hire temporary workers, because we’re seasonal,” Takahashi told WND.
Adams told WND he supported Hillary Clinton during the 2008 presidential election campaign.
He described himself as a libertarian who wants less government spending, fewer laws that restrict personal freedoms, more adherences to the Constitution and an end to foreign wars.
“I’m interested in individual liberty and upholding the Constitution,” he said. “I want to get American troops out from foreign countries, and I want to see the federal budget balanced.”
He said he might be inclined to support former-Arkansas Governor Mike Huckabee or former-Massachusetts Governor Mitt Romney in 2012 to run against President Obama, but he has not yet made up his mind.
“It depends on how fiscally conservative Huckabee and Romney turn out to be on economics,” he said. “But from what I know right now, they would probably be better than Obama.”

Questions have been raised about Barack Obama’s eligibility to be president since before his election, but with a mainstream media leading cheers for him there have been a lot of Americans who haven’t realized the seriousness of the situation – the possibility that the sitting president is ineligible and constitutionally devoid of authority to sign bills, set foreign policy or even host lavish parties for friends in the White House.
That’s changing and a large part of the reason is that Sheriff Joe Arpaio of Maricopa County, Ariz., conducted a six-month Cold Case Posse investigation and revealed that there is probable cause to believe there was forgery in the creation of the image of Obama’s “Certificate of Live Birth” and fraud in its presentation to the nation as a genuine document.
The evidence that the word has been reaching Americans comes in the latest WND/Wenzel Poll conducted exclusively for WND by the public-opinion research and media consulting company Wenzel Strategies.
It reveals that almost 40 percent of Americans – that would be somewhere in the range of 130 million or 140 million or so – now think the nation is facing a constitutional crisis because of a lack of documentation regarding Obama’s eligibility.

The scientific telephone survey was conducted March 10-13 and has a margin of error of 3.72 percentage points.
The poll reveals that 25.8 percent of respondents say they strongly agree with the statement that the country now is facing a constitution crisis on the issue of an eligible president. Another 13.7 percent say they somewhat agree.
Critics long have raised the question about the impact on the nation should Obama be proven to be ineligible. There would be many issues to consider: Are the laws he’s signed still laws? What about the money he’s spent? And how about the commitments he’s made to allies overseas? What about significant social changes he’s brought about, such as opening the U.S. military to open homosexuality?
Could any of those be reversed. And who would pay for that?
Or does anybody care?
Arpaio’s investigation, done by experienced law enforcement investigators as well as attorneys, was released only a few weeks ago, and has been serving to wake people up on the issue, Wenzel said, despite mainstream media efforts to keep the information under wraps.
The poll showed 11 percent of respondents are very familiar with the conclusions in Arpaio’s report, and another 19 percent are somewhat familiar. Still, nearly 70 percent were not very or not at all familiar, a tribute to the work of mainstream and influential media outlets to conceal the facts of the dispute.
The poll also showed that because of Arpaio’s report, 40 percent of the respondents now concede they are more likely to believe Obama in ineligible to hold the office of president. Another 20 percent said they weren’t able to express an opinion on that question.
Also, more than 46 percent said they agree that now there needs to be more extensive investigative work done into Obama’s eligibility to determine the facts, while 39 percent said they disagreed with that.
And then there was the key question about the nation facing a constitutional crisis.
At issue would be consequences like the fallout of court decisions made by judges appointed by Obama. There are two new U.S. Supreme Court judges, Elena Kagan and Sonia Sotomayor, who owe their lifelong appointments to Obama.
But if Obama was ineligible to start, what about those appointments, and what about the decisions in which those judges have participated?
Respondents also were divided, with 30 percent saying media coverage that did occur of the Arpaio report was favorable to Obama and another 25 percent who said it opposed Obama. Significantly, 30 percent were “not sure.”
Wenzel suggested that the issue needs to be in the news, so people know about it, can do their research and make up their minds.
“This issue is very much like the government takeover of the national health care system engineered in the first two years of the Obama term in that it produces a visceral and negative reaction from many voters, but it requires constant discussion to keep it in the minds of voters. This is not a subject on which voters want to dwell, but forced to think about it, many react in a negative way,” Wenzel said.
“This may be the very reason Obama’s supporters in the mainstream media do not want this topic discussed, and there has been a concerted effort to marginalize those who raise questions about this issue,” he said.
“But the truth is that if Americans came to realize just how many of their neighbors harbor the same skepticism about Obama’s eligibility that they share, the political and societal ramifications could bring dramatic change to this nation,” he said.
He did note his concern is that Americans so far mostly have been content to “sit idly by while an apparent imposter raids their national treasury and runs their once-great nation into the ground.”
The issue is that while the Constitution requires a president to be a “natural born citizen” the documentation that would reveal that for Obama remains unrevealed.
Obama has refused to allow access to whatever original documentation there might be in the state of Hawaii, where he said he was born, as well as many other documents, such as passport records, kindergarten records, Punahou school records, Occidental College records, Columbia University records, Columbia thesis, Harvard Law School records, Harvard Law Review articles, University of Chicago articles, Illinois State Bar Association records, Illinois State Senate records and schedules, medical records, Obama/Dunham marriage license, Obama/Dunham divorce documents, Soetoro/Dunham marriage license and adoption records.
There also are his critics who say that “natural born citizen” at the time the Constitution was written would have meant the offspring of two citizens of the country, and since Obama’s father was a foreign national, he would not qualify under that standard.
WND previously reported that some of the silence from the media may be due to threats that were issued to intimidate them.
Lead Cold Case Posse investigator Mike Zullo told WND, “During our investigation, we actually were told [that media] had been threatened with FTC investigations. Commentators [had been] threatened with their jobs.”
The threats were so intimidating that some individuals quit their positions over safety concerns for their families, he said.

Sheriff Arpaio’s report found that there is probable cause to believe Barack Obama is NOT eligible to serve as president, and that the birth certificate he released last year was a forgery. Rep. Paul Ryan's budget plan, with Medicare changes, is back

A backlash from seniors buried the Republican proposal last year, but the Wisconsin congressman insists his deficit-slashing ideas are on the right track.

    For a moment last year, Republican Rep. Paul Ryan's star shone brightly as he unveiled his party's bold deficit-whacking budget proposal — that is, until seniors rebelled over his plan to dramatically change Medicare.

    The backlash was swift and decisive. Democrats attacked theGOP, saying the plan would destroy the Medicare safety net, and the earnest Wisconsin wunderkind slid from the spotlight. When he walked the halls of the Capitol, he popped in his iPod earbuds, tuning out the noise.

    Now Ryan, the House Budget Committee chairman, is returning to center stage as the GOP doubles down on his conservative budget priorities — including tax cuts for the wealthy and a new version of his plan for major changes in Medicare.

    With an edgy new campaign-style video and a flurry of Ryan appearances timed with his upcoming budget release, Republicans believe theirs is a winning strategy: one that will showcase the GOP as willing to make tough choices to reduce federal deficits and present voters with a contrast toPresident Obama. Democrats believe just as strongly that the Ryan strategy will be a winner for them.

    A Medicare overhaul, in particular, is a risky move in an election year when the GOP is trying to topple Obama, defend its House majority and win the Senate. Ryan won plaudits from some budget hawks and think tanks for being willing to tackle the difficult politics of Medicare cuts. But average voters overwhelmingly support keeping Medicare as is. They also favor Obama's approach of taxing wealthy Americans more heavily to bring budgets into balance, rather than offer more tax cuts, polls show.

    "We're just going to keep doing it and doing it, to show that we're serious and we're committed and we have a vision and a plan," said Ryan, whose Medicare proposal was initially dismissed by Republican presidential hopeful Newt Gingrich as "right-wing social engineering" but has since drawn backing from Gingrich, rival candidate Mitt Romney and others.

    "People are ready to be talked to like adults, not like children. They know that something is wrong. They know this government's off its rails," Ryan, 42, said between fast bites of cafeteria takeout lunch in his budget committee office. "And I really think the politics, if we help push it, will turn to rewarding the people who are bold in taking on the problems — and penalizing the people who don't."

    Democrats are thrilled with the political opportunity. Ryan's original proposal would eventually have replaced Medicare's guarantee of medical coverage with a plan that would have provided future seniors a fixed amount with which to buy their own insurance. Democrats see that as a prime example of the GOP's rightward overreach since taking the House majority.

    Ryan's new budget is expected to include a revised provision backed by Sen. Ron Wyden (D-Ore.) that addresses some of the criticisms. It would still give future seniors a fixed amount, but it would allow them to use the money to stay in the traditional Medicare program. They would have to pay out of pocket if the costs of the program were higher than the government subsidy — or buy an alternative plan. Wyden is likely to oppose the Ryan budget's other provisions, limiting the patina of bipartisanship the GOP hoped for.

    Democrats are unimpressed with the change. "You can dress up a pig, but it's still a pig," said Rep.Steve Israel of New York, chairman of the Democratic Congressional Campaign Committee. "The problem with Republican budgets is they consistently ask seniors to be the first to sacrifice their Medicare without asking millionaires to give up a nickel."

    Israel's committee is circulating a horror-movie-style poster with Ryan's image, alongside that of House Speaker John A. Boehner (R-Ohio) and Majority Leader Eric Cantor (R-Va.), and the tagline: "Just when you thought Medicare was safe — They're back — This time they want to finish it for good."

    Less partisan budget experts say Ryan deserves credit for being willing to talk about Medicare spending, but that most seniors under his plan would face considerably higher costs for healthcare, in some cases many thousands of dollars a year. Some also call his proposals unrealistic for refusing to consider any increase in tax revenue to rein in the nation's debt. Of concern to some, the budget is expected to avoid agreed-upon Pentagon cuts in favor of deeper reductions to other domestic programs.

    Ryan dismisses such challenges. To him, losses such as the one the GOP suffered in last year's special election are merely bumps along a career path trying to avert a national debt crisis. A protégé of Republican Jack Kemp, Ryan calls himself a next-generation supply-sider who matches the earlier conservatives' zest for lower taxes with a new emphasis on deficit reduction.

    "To me it's sort of a moral issue. There is right and there is wrong. There are absolutes in life, and it is wrong to knowingly do nothing to prevent a catastrophe from happening," said Ryan, a Roman Catholic who says he prays daily for the country to be on better fiscal footing.

    Too many politicians fear the so-called third rails of politics, he says, adding, "I've been hugging these third rails for years now, and I didn't die. I'm trying to show my colleagues you can do this."

    Within the GOP's own ranks there is dissent over the party's approach, but it is mostly from conservatives who want even steeper cuts. They could force a showdown that would pose a new challenge to Boehner's control of the House majority.

    Conservatives never supported the debt ceiling deal Boehner made last summer in a compromise with the Democratic-led Senate. They refuse to be held to it.

    But reneging on that agreement could derail the budget process and lead to another threat of a government shutdown when the new fiscal year begins Oct. 1. Republican leaders hope to avoid that outcome after earlier standoffs proved politically toxic for their party. They have struggled ever since to convince voters they can competently run the country.

    "Our members want to show the American people a path forward," Boehner said recently. "And we will."

    GOP Budget Proposal May Include Federal Workforce Cuts

    House Budget Committee Chairman Paul Ryan (R-WI) is releasing a budget blueprint for the federal government next Tuesday, March 20, and it is expected to include proposed cuts to the federal workforce.
    One of the goals of the budget will be to avoid defense spending cuts mandated by sequestration. This has been a primary goal of Republicans who have said they want to keep defense off of the negotiating table.
    Defense Secretary Leon Panetta has said that further defense cuts would be devastating. Speaking recently in Louisville, Kentucky, Panetta said, "Additional deficit reduction must be made through a comprehensive and balanced deficit reduction plan, which will involve making decisions not just on defense but on every other area of federal spending and revenue."
    In other words, no more defense cuts. So if cuts to defense are off the table, that means cuts have to be made elsewhere to come up with savings.
    Readers may recall a couple of past legislation proposals that would directly affect federal employees.
    One was introduced back in December by Congressman Buck McKeon (R-CA). It was called the Down Payment to Protect National Security Act and would impose a 10% reduction in the federal workforce through attrition and then apply the savings to pay for one year of sequestration for both defense and non-defense categories. A 10% reduction will be achieved over 10 years by only hiring one federal employee for every three who retire.
    A bill introduced on the Senate side in February did something similar. Known as the Down Payment to Protect National Security Act of 2012, the proposal would extend the pay freeze on federal employees through June 2014 and also would restrict hiring to only two employees for every three leaving until the size of the federal workforce is reduced by 5%. The freeze would also apply to members of Congress.
    The National Journal is reporting that the forthcoming budget proposal is expected to contain some aspects of either one of these two proposed bills. And that would mean that federal workers can expect more proposed cuts in one form or another.

The five tax hikes in Obamacare that most hurt seniors

The jobs-killing Obamacare law contains 20 new or higher taxes on American families and employers. Many of these tax increases fall on families making less than $250,000 — a direct violation of candidate Obama’s promise not to raise “any form” of taxes on these families. In less than a week, the third anniversary of Obamacare being signed into law will take place. The Supreme Court will be hearing oral arguments about the constitutionality of Obamacare next week.
Out of the 20 new or higher taxes in Obamacare, there are five that fall most directly on seniors.
The first is the excise tax penalty for failure to comply with Obamacare’s individual mandate. Many seniors face a coverage gap between retirement and Medicare eligibility. Obamacare raises taxes on these younger seniors by punishing them if they don’t purchase “qualifying health insurance.” Set to go into effect in 2014, the excise tax penalty for mandate non-compliance will in 2016 rise to 2.5% of adjusted gross income for a senior couple (or $1,390 for those making less than $55,600).
Why does Obamacare raise taxes on seniors just as they are entering retirement? Many of these seniors will face this “stick” but find themselves with too much income to qualify for the “carrot” of tax credits to purchase Obamacare health insurance plans in an exchange. Many will be forced to keep working just to avoid paying this tax.
The second tax hike on seniors is the so-called “Cadillac Plan” excise tax. Starting in 2018, Obamacare imposes a whopping 40% excise tax on high-cost (“Cadillac plan”) health insurance plans. This is defined for seniors as a plan whose premiums exceed $29,450 for a family plan, or $11,500 for a single senior. Seniors often face higher costs in health insurance premiums due to chronic health conditions and other risk factors. This tax will fall almost exclusively on the seniors with the greatest health insurance needs.
Third is Obamacare’s dividends tax hike. Starting in 2013, the top tax rate on dividends is scheduled to rise from 15% today to 39.6%. In addition, Obamacare imposes a dividend “surtax” of 3.8% on families making more than $250,000 per year. That would create a top dividend tax rate of 43.4%, nearly triple today’s rate. This will fall very hard on seniors. According to the Tax Foundation’s analysis of IRS data, 70% of households over age 55 receive dividend income. Seventy-one percent of all dividends paid flow to these households. To raise taxes on dividends is to raise taxes on seniors.
Then there’s the medical device excise tax. Obamacare imposes a new excise tax on medical device manufacturers in 2013. These companies will surely build the cost of this new tax into the price of what they sell. Who buys medical devices? Who buys pacemakers, wheelchairs and other costly medical devices? Seniors do.

Finally, Obamacare reduces allowable medical itemized deductions. Under current law, medical itemized deductions can be claimed on tax returns, but they must be reduced by 7.5% of adjusted gross income. Obamacare increases this “haircut” to 10% of AGI in 2013. This will mean that millions of Americans claiming medical itemized deductions will no longer be able to. The same IRS data as above tells us that 60% of all tax filers claiming this deduction are over age 55.
All of the tax increases in Obamacare will hurt seniors, but these five fall on them directly and hardest.

A Sound Currency Standard Keeps Inflation Quiet

In 2010, China had more than one reason to unpeg its currency from the US dollar. Certainly the Chinese were under pressure from US officials to allow the yuan to appreciate. The Americans had all but officially accused the Chinese of currency manipulation, of keeping the yuan undervalued. But even without this pressure, Chinese officials had reason to question their choice of standard to which to peg their currency.
The Chinese were in a position similar to that of the Germans 50 years earlier. In 1960 the German mark had a fixed exchange rate with the US dollar which, in turn, was officially fixed to gold. But as the US began the inflation that would ultimately lead to its break with gold, it transmitted that inflation to all those currencies, such as the mark, that were fixed to the dollar.
During 2010, the Chinese consumer-price inflation rate was rising. It peaked out at 6.5 percent in mid-2011. That was a year after the Chinese released the yuan from its dollar peg in June 2010 when its managed appreciation began. With this, and higher bank reserve requirements, inflation has dropped to 3.2 percent year-on-year for February.
In the past year, the yuan has appreciated about 4.4 percent against the dollar and 9 percent against the euro. Not surprisingly, Chinese trade surpluses have diminished. In February, their trade balance with the rest of the world went into deficit.
Last week, Chinese Premier Wen Jiabao announced his government’s 2012 “growth target” of 7.5 percent, down from 8 percent. Such projections usually understate their true expectations, but the reduced target is consistent with deliberate currency strengthening. The pegged exchange rate required the regular purchase of a large quantity of dollars and the issue of a commensurately large quantity of newly created yuan. The reduction of such monetary inflation generally results in a slowdown and the temptation to reflate.
The premier’s justification of the diminished growth target seemed to recognize that the continuation of such inflationary stimulus might possibly result in a worse slowdown. He said a reduction would help improve the quality of growth and better facilitate a needed economic restructuring. The implicit hint is that inflation and fiscal stimulus can yield a low-quality growth that is unsustainable.
Just as the economic gains of the past 30 years were made possible by a relaxation of the communist chokehold, future gains will depend increasingly on further deregulation and extension of property rights. Premier Wen spoke of the need to improve the security of rural land rights and the need to deregulate the financial sector by finding a way to legalize what is now an underground finance market.
The extension and clarification of land rights would enable more productive use of that land and make it available as collateral to attract financing. Deregulation of the financial sector would open up opportunities currently ignored in a marketplace dominated by large state-owned banks.
A less-regulated economy always adjusts more quickly to the after effects of inflation. As in any economy, the real limits to growth and adjustment are legal, not physical. The economy will continue to grow as long as the state continues its evolution from a restrictor of private action to a protector of private property rights.
Any hesitation in this evolution will make the prospect of any “hard landing” that much harder to take.

If you believe what the President Barack Obama is saying, drilling for more oil won’t affect the price of gasoline, and there aren’t enough oil reserves in the United States to satisfy or growing energy needs.
I’m not opposed to securing all the foreign oil reserves we can. The sooner the Islamic nations are out of oil the sooner we will see the end of the Islamic goal of a worldwide caliphate. So let’s keep buying up Arab oil.
But while we’re draining the oil reserves out of the Middle East, we should be developing our own domestic supply. But to hear President Barack Obama’s take on American oil reserves, we don’t have much of it. Here’s what he said when he was running for president:
“Even if you opened up every square inch of our land and our coasts to drilling, America still has only 3% of the world’s oil reserves.”
How can anyone know this? “All reserve estimates involve uncertainty, depending on the amount of reliable geologic and engineering data available and the interpretation of those data.”
There is a long history of claims that we are running out of oil. Consider the following from the Manhattan Institute for Public Policy:
“Almost since the first discoveries of oil in the U.S. in 1859, people have been saying we’re running out. In 1874, the state geologist of the nation’s leading oil producer, Pennsylvania, warned the U.S. had enough oil to last just four years. In 1914, the federal government said we had a ten-year supply. The government announced in 1940 that reserves would be depleted within a decade and a half. The Club of Rome made similar claims in the 1970s.”
In an April 18, 1977 speech, President Carter said that “Within ten years we would not be able to import enough oil — from any country, at any acceptable price.”[1]
President Obama wants to go back to the malaise years of the Carter administration and turn America into a nation dependent on foreign interests. In reality, the United States has more than 22 billion barrels of proved reserves. “Proved reserves” are what companies are currently extracting. This does not count untapped supplies. Consider the following from Investor’s Business Daily:
  • At least 86 billion barrels of oil in the Outer Continental Shelf yet to be discovered, according to the government’s Bureau of Ocean Energy Management.
  • About 24 billion barrels in shale deposits in the lower 48 states, according to EIA.
  • Up to 2 billion barrels of oil in shale deposits in Alaska’s North Slope, says the U.S. Geological Survey.
  • Up to 12 billion barrels in ANWR, according to the USGS.
  • As much as 19 billion barrels in the Utah tar sands, according to the Bureau of Land Management.
  • Then, there’s the massive Green River Formation in Wyoming, which according to the USGS contains a stunning 1.4 trillion barrels of oil shale — a type of oil released from sedimentary rock after it’s heated.
Obama, who’s said to be our nation’s “smartest president,” certainly knows all of this. So why isn’t he telling the American people the oil that’s available to us? Why is he lying to us? Does he want to make America vulnerable to a foreign takeover?
