Victor Hill sent to jail after 37-count indictment handed down

CLAYTON COUNTY, Ga. —
A grand jury indicted former Clayton County sheriff Victor Hill on 37 counts, alleging he used county cars for getaways and county credit cards for shopping sprees.

Hill’s charges include theft by taking, making false statements and violation of the Racketeer Influenced and Corrupt Organizations (RICO) Act, wrapping up a nearly year-long investigation.

A hearing was immediately held for Hill where a judge set bond at $50,000 and ordered the former sheriff to surrender his passport, remain in Georgia and not to contact any witnesses. Hill was still behind bars the next morning. His attorney said bonding companies want no part in the case.

“I’ve had them tell me they will not for fear that they will be decertified from being able to have bonds at the Clayton County Jail in the future,” attorney Musa Ghanayem said.

Channel 2 investigative reporter Mark Winne talked to Hill before he addressed the grand jury panel Wednesday. Hill maintained his innocence and said he still plans on running for sheriff again.

“Looking forward to defending myself. I think everyone knows it’s politically motivated and we’re ready to get back on the campaign trail,” Hill told Winne.

The grand jury started an investigation into Hill in April, and prosecutors finished their presentation on Wednesday afternoon. Hill then had the option to make a final statement before the panel voted on the charges.

Sources told Winne the special grand jury looked at the use of county credit cards, the handling of campaign finances, if there was personal travel using county equipment, if county employees engaged in campaign or personal business for Hill.

Clayton County Sheriff Kem Kimbrough has been critical of Hill, whom he won against in 2008. Kimbrough said he takes no joy in Hill’s downfall but considers it vindication.

“It is not politically motivated. It is all about accountability and the integrity of the offices we hold,” Kimbrough told Winne.

Kimbrough said he would be ready for Hill in another face-off.

“This is how I'm going to campaign against him,” Kimbrough told Thomas, holding a copy of the indictment against Hill. “Not only was he a poor sheriff, but he broke the law.”

Beatrice Powell, a former Clayton County corrections officer, was also indicted on perjury and theft by taking charges in connection with Hill’s case. Investigators said they contacted her last summer about her friendship with Hill.

Investigators said they wanted to know if Powell campaigned for Hill on county time and whether he allowed her to get paid on the county’s dime. Powell told investigators she committed no crime.

Hill's attorney, Steve Fry, said he will fight the charges and Hill has not violated the law.
Hill is currently being held in the Gwinnett County Jail instead of the Clayton County Jail for security reasons.

This disciplinary matter is before the Court on the Report and Recommendation of special master James E. Patterson who recommends that this Court accept the petition for voluntary discipline which was filed by Respondent, Joseph A. Maccione (State Bar No. 462925) after the Bar filed a Formal Complaint. In his petition, Maccione requests the imposition of a Review Panel reprimand with conditions for his admitted violations of Rules 5.3 and 8.4(a)(4). Although the maximum sanction for a single violation of either rule is disbarment, the State Bar has indicated that it has no objection to the requested discipline.
In his petition Maccione, who was admitted to the Bar in 1976, admits that he is a solo practitioner who for several years regularly used the services of an employee/contractor as an investigator and paralegal. Maccione was aware that the employee/contractor had no license as an investigator, no education in paralegal studies, and an extensive criminal history. Maccione nevertheless allowed the employee/contractor to use business cards and letterhead that indicated he was an investigator and paralegal associated with Maccione's firm. Maccione also allowed the employee/contractor to prepare correspondence to clients and others, to communicate with clients, to collect retainer funds for Maccione's firm, and to generally represent to the public that he was working on cases with Maccione.
In early June 2005, Maccione agreed to represent a client on a drug charge and in a civil action the client wished to file regarding the death of his dog. After accompanying the client to a meeting with a county official about the civil matter, Maccione referred the client to the employee/contractor so that he could prepare the civil complaint which Maccione then had filed as a pro se complaint. Maccione did not clearly inform the client that he would not be handling the civil matter himself; he did not monitor the employee/contractor's activities regarding preparation of the complaint; and he did not take any action to assist the client with his civil suit. In mid-June 2005, the client was arrested and charged with murder. Maccione and the employee/contractor met with the client and advised him that Maccione and another attorney would defend the client for a flat fee of $30,000, which included attorney fees for Maccione and the other attorney. The employee/contractor then prepared a document titled “Affidavit” to be signed by the client. The affidavit authorized Maccione's law firm, generally, and the employee/contractor, specifically, to take all of the client's personal property from his home, to be applied to the cost of his defense. Maccione signed the document as a notary notwithstanding the fact that the document had been left undated and that the signature line for the witness was blank. Maccione admits that he cannot say with any certainty that he observed the client executing this affidavit.
In late June 2005, while the client was confined in a mental hospital following a suicide attempt, the employee/contractor entered the client's home and took numerous items of personal property, purportedly pursuant to the above described affidavit (and apparently as payment for the employee/contractor's services). Maccione had not discussed with the client any fee for the employee/contractor's work on his case, nor did he provide the client with any billing statements or accounting for the employee/contractor's services. The value of the property taken by the employee/contractor was not credited toward the client's quoted legal fees. The client subsequently discharged Maccione and during the course of these disciplinary proceedings, Maccione severed his relationship with the employee/contractor. As a result, Maccione no longer uses the employee/contractor's services in any capacity and asserts that he will not use those services in the future.
Based on these admitted facts and having reviewed the record as a whole, we agree with the special master that Maccione violated Rules 5.3 and 8.4(a)(4) of the Georgia Rules of Professional Conduct, See Bar Rule 4-102(d). However, we disagree with the special master that a review panel reprimand is the appropriate punishment under the circumstances presented here. In light of the serious nature of the facts presented in this case, and in light of Maccione's prior disciplinary history (he received an Investigative Panel reprimand in 1989), we conclude that a review panel reprimand is not the appropriate level of punishment to impose on Maccione for his actions. Although Maccione has ended his relationship with the employee/contractor, who the Bar believes to be the “primary wrong-doer in this matter,” that does not change the fact that Maccione supervised or otherwise acquiesced in the wrongful conduct of this employee/contractor to the detriment of his client.
Accordingly, we reject Maccione's petition for voluntary discipline.
Voluntary Discipline Rejected.

I, Aja Brooks, and Anthony Richard Bruce will be happy to remind him of what Victor Hill had done while he was Sheriff, going back to 2006 and prior:

Along with evidence tampering:
  • unethical use of confidential informants,
  • not following due process of law by arranging sales cases with informants,
  • taking the drug money profits and gambling the drug money profits and county funds in stock market schemes;
  • violating oath of office in following the laws he was supposed to enforce
  • WHILE HE WAS SUPPOSED TO BE MANNING THE JAIL!

In addition to the County's findings that he ran up a credit card for an unapproved Vegas trip, Hill held onto County funds $1.5 million or so, that he never should have taken out of County allotment/misuse of funds, AND HE FREQUENTED APARTMENT COMPLEXES TO SLEEP WITH UNDERAGE GIRLS, AND HAD HIS BODY GUARDS STAND LOOKOUT.

Victor Hill now also looks like he got off the crack rock, for once, after going throw lengthy bankruptcy, becoming a used car salesman, and losing a bid for District 34 Senate seat.

Yet these things above, he most certainly did while Sheriff, in addition to his male arresting officer conducting an inappropriate search on me as a female, telling me to shake out my bra, without calling a female officer to search my person.

Victor Hill also collaborated with Henry County without notifying FBI, in regards to unethical use of confidential informants, and HCPD violated my Habeas corpus, who had 5 officers threaten me, even though my insurance, registration, and license was legitimate, that we could "do this the easy way, or the hard way".

Let Victor Hill deny the grand juries charges because HE IS LYING; unlike Victor Hill, both I and Anthony Richard Bruce can both pass lie detector tests !!!!

MOVING ONTO THE MATTERS AT HAND:


Book Review: Ameritopia: The Unmaking of America


Ameritopia: The Unmaking of America. By Mark R. Levin Threshold Editions A Division of Simon & Schuster, 208 pages, $16.02 Buy from Amazon.com, Barnesandnoble.com
The trickiest part to nurturing society is education. How do you motivate citizens to read the words of the great philosophers? How do you meld that knowledge into government? The Founders knew the difference between utopianism and American exceptionalism. Patrick Henry opened the first Continental Congress in 1774 as a delegate from Virginia with these words; “I am not a Virginian—I am an American.” No doubt this was the first time in history that any inhabitant of these colonies referred to themselves as Americans. This is the fundamental difference between this nation and others, we were the first to embrace a Constitutional Republic that recognized the individual.


In his new book “Ameritopia: The Unmaking of America” Mark Levin says; “… too many people remain oblivious to the perilousness of their surroundings, not realizing the precariousness of their Liberty and the civil society …” This is a unremarkable observation, but very true. In Georgia the average voter turnout is ~approximately 25% of registered voters for primaries. Few understand exactly what is at stake and “they go through the motions of electing their guardians, deluding themselves that they and their fellow citizens remain free for they participate in self-government.” They don’t think about utopianism or Americanism.

Ameritopia reads like Cliff Notes of the great philosophers and for that reason alone this book is worth reading. If you haven’t the motivation to read Plato’s Republic, Thomas More’s Utopia, or Montesquieu’s Spirit of Laws read Mark Levin’s book. The 110 pages in Ameritopia dedicated to the great philosophers will save you years of plowing through the original texts.  It is a wonderful summation of these great works.

Levin concludes; “The American founding was an exceptional exercise in collective human virtue and wisdom – a culmination of thousands of years of experience, knowledge, reason, and faith.” I think we all agree with this statement, but Mark goes on to say; “The Declaration of Independence is a remarkable societal proclamation of human rights, brilliant in its insight, clarity, and conciseness.” This interpretation of the Declaration of Independence is exactly what started this nation down the road to Ameritopia. You hear Hannity say it all the time, “I believe America is a force for Freedom” around the world. Truth is The Declaration of Independence was simply a document drafted in order to secede from the British Empire. The middle portion is a list of charges against the King. The Preamble is simply a justification for secession written to entice the people in the counties to agree to secede. More for propaganda reasons than a “remarkable societal proclamation”. Next Levin writes; “The Constitution of the United States is an extraordinary matrix of governmental limits, checks, balances, and divisions, intended to secure for posterity the individual’s sovereignty as proclaimed in the Declaration of Independence.” Again the Declaration of Independence didn’t proclaim anything except that the colonies were declaring their freedom from the British Empire. The Founders seceded from the British Empire and they wrote King George declaring this simple fact. Now lets address Mark’s interpretation of the Constitution.
The Constitution is a form of government, limited in nature, written down so not to be misconstrued. The Bill of Rights are further restraints on the federal government for the states feared that the people sent to Washington DC would misconstrue the original intent. Case in point, FDA, EPA, HHS, DOE, DOT, and the myriad of other agencies and bureaus set up to pilfer the wealth of the people of this nation. Hannity and Limbaugh should take note that nowhere in the Constitution does it give the power to the federal government to be a “Force for Freedom around the world.” The Constitution does not give the power to the federal government to send us around the world to grow the American Empire.

Ameritopia is not utopianism, it’s actually the result of the criminals we the American people have sent to Washington DC since the election of 1860. The first Guardian was Abraham Lincoln. Successive Congresses and Presidential administrations since Lincoln have sought to impose their vision on America in order to steal from the American taxpayer. Republicans are as guilty as the Democrats and in fact government has grown larger under Republicans than Democrats over the decades.

The Tea Party’s understand the problem and many of them are scared, because they don’t know what to do about it. There is only one solution, because Washington DC can’t be fixed. There is absolutely no reason for any state to remain in this union. The federal government is now net-net a negative on the states and the people.

Everyone should read Mark Levin’s book, Ameritopia: The Unmaking of America, because for an education it is a shortened version of the great philosophers, but more importantly it illustrates the misconceptions about our Founding that started us on the path down into the pits of Ameritopia.

ABC Insider: Marianne Gingrich Interview Likely To Air Before Primary; Gingrich Daughters Respond

CHARLESTON, S.C. -- The Drudge Report began teasing political reporters Wednesday that a network's holding a "bombshell campaign interview." And soon, Drudge revealed that the network in question, ABC, had conducted a two-hour interview with Marianne Gingrich, ex-wife of Newt Gingrich, that may not run until after the South Carolina primary. The decision, Drudge reported, sparked a "civil war" at the network.
ABC staffers were caught by surprise at the news, telling The Huffington Post that if there was a "civil war," they hadn't heard about it. That doesn't mean there wasn't any debate among ABC executives over when to air the interview, but simply that the war certainly wasn't raging through the newsroom.
It also looks like the interview will air before Saturday's South Carolina primary after all. One ABC insider said that the Gingrich interview, conducted with Brian Ross, will likely air on Thursday's "Nightline."
Marianne Gingrich, the former Speaker's second wife, of 18 years, hasn't been shy about her feelings toward her ex-husband's presidential ambitions, telling Esquire in 2010 that there's "no way."

"He could have been president," she said. "But when you try and change your history too much, and try and recolor it because you don't like the way it was or you want it to be different to prove something new ... you lose touch with who you really are. You lose your way."
"He believes that what he says in public and how he lives don't have to be connected," Gingrich added, in the Esquire interview. "If you believe that, then yeah, you can run for president."
In the Esquire interview, Marianne also dismisses the conversion to Catholicism during his current, and third, marriage. She said it "has no meaning."
It's unclear who leaked the story to Drudge -- perhaps an ABC staffer who didn't want the interview to possibly get held until next week or rival campaign operative hoping to get Gingrich's baggage front-and-center on the influential conservative aggregator. Whoever the source, they got the political tongues wagging just 72 hours before the primary.
Gingrich's two daughters from his first marriage pushed back Wednesday, writing in a letter to the network's leadership that "ABC News or other campaigns may want to talk about the past, just days before an important primary election [but] Newt is going to talk to the people of South Carolina about the future."

And as the only candidate in the race, including Obama, who has actually helped balance the national budget, create jobs, reform welfare, and cut taxes and spending, Newt felt compelled to run -- to serve his country and safeguard his grandchildren's future.

Newton Leroy Gingrich entered Washington politics as a Georgia congressman in 1979 and exited in 1999 after resigning his position as speaker of the House.

His four-year speakership is most frequently noted in conservative circles for his success in pressuring President Bill Clinton to sign a conservative welfare reform package into law and overseeing a short period of balanced or near-balanced budgets. He also received a large share of the blame for the 1995 government shutdown, when the public saw him as a stubborn politician more willing to allow the government to run out of funds than to compromise.

But beyond the capital he's cultivated in the conservative movement, Gingrich's real political credentials have always been undercut by his personal history. He's had three wives. He reportedly brought divorce papers to his first wife while she was in a hospital bed recovering from uterine cancer (though this narrative was denied by both Gingrich and his daughter, Jackie Gingrich Cushman, in a recent report). His eventual separation from his second wife was less dramatic, but no less memorable. According to anextensive profile in Esquire, he told Marianne Gingrich that she was a "Jaguar" and that "all I want is a Chevrolet." That brought him to his third marriage to Callista Gingrich, who was a House staffer when she began an affair with her eventual husband.

More than 143,000 FL GOP voters have cast ballots -- 20,000 more than Iowa caucus

More than 138,000 Florida Republicans have cast mail-in absentee ballots already of the 455,622 requested so far and another 5,000 have voted early at the polls in some counties, according to Republican Party of Florida's spokesman, Brian Hughes.
For context, consider that the total ballots cast in the Iowa caucus was 122,000.
And there's more. The Iowa caucus was essentially botched. Rick Santorum was just declared the official winner -- not Mitt Romney. That has some Florida Republicans wondering why Iowa gets such a focus. Not only are Democrats and independents allowed to vote in the party's election -- the caucus is run poorly.
Our first election in the nation is in a state that lets people vote on construction paper," said David "DJ" Johnson, former Republican Party of Florida executive director and adviser to Jon Huntsman's now-scuttled presidential campaign.
"There are third-grade elections for class president that are run better than Iowa's caucus," Johson said.

GOP officials: Santorum edges Romney in Iowa count

COLUMBIA, S.C. — Rick Santorum edged front-runner Mitt Romney by 34 votes in a surprise flip to the final tally of the Iowa caucuses, but no winner will be declared because some votes remain missing in the event's closest finish ever, Republican officials said Thursday.

Romney had initially been considered the winner — by just 8 votes — of the first contest in the GOP presidential nomination contest.
Iowa GOP Chairman Matt Strawn is scheduled to announce the certified vote totals Thursday morning. Republican officials, speaking on condition of anonymity because they weren't authorized to pre-empt his announcement, said Strawn wouldn't declare a winner because some votes can't be counted. Votes from 8 of the state's 1,774 precincts are missing.
Although the final tally from the Jan. 3 caucuses remains excruciatingly close, the new numbers could give a boost to Santorum and other candidates trying to undermine Romney's dominance over the field as South Carolina primary voters go to the polls Saturday.
An Iowa GOP source, also speaking on condition of anonymity, confirmed that the certified results would show Santorum with 29,839 votes and Romney at 29,805, a difference of 34. Ron Paul finished third with 26,036 votes.
In a statement, Romney called it a "virtual tie." The former Massachusetts governor praised Santorum's "strong performance" in the state.
Santorum, a former Pennsylvania senator, and other GOP candidates are vying to attract voters seeking a more conservative alternative to Romney, who followed Iowa with a solid victory in New Hampshire, the second contest of the race.
The Des Moines Register first reported the certified caucus totals on Thursday.

Newt Gingrich lacks the moral character to serve as President, his second ex-wife Marianne told ABC News, saying his campaign positions on the sanctity of marriage and the importance of family values do not square with what she saw during their 18 years of marriage.
In her first television interview since the 1999 divorce, to be broadcast tonight on Nightline, Marianne Gingrich, a self-described conservative Republican, said she is coming forward now so voters can know what she knows about Gingrich.

In her most provocative comments, the ex-Mrs. Gingrich said Newt sought an "open marriage" arrangement so he could have a mistress and a wife.
She said when Gingrich admitted to a six-year affair with a Congressional aide, he asked her if she would share him with the other woman, Callista, who is now married to Gingrich.
"And I just stared at him and he said, 'Callista doesn't care what I do,'" Marianne Gingrich told ABC News. "He wanted an open marriage and I refused."
Marianne described her "shock" at Gingrich's behavior, including how she says she learned he conducted his affair with Callista "in my bedroom in our apartment in Washington."

"He always called me at night," she recalled, "and always ended with 'I love you.' Well, she was listening."
All this happened, she said, during the same time Gingrich condemned President Bill Clinton for his lack of moral leadership.
She said Newt moved for the divorce just months after she had been diagnosed with Multiple Sclerosis, with her then-husband present.
"He also was advised by the doctor when I was sitting there that I was not to be under stress. He knew," she said.
Gingrich divorced his first wife, Jackie, as she was being treated for cancer. His relationship with Marianne began while he was still married to Jackie but in divorce proceedings, Marianne said.
There was no immediate comment from Gingrich on his ex-wife's allegations. Gingrich has said during the campaign he has "no relationship" with Marianne.
While she had been quoted earlier as saying she could end his career, Marianne Gingrich defended Newt's ethics while he served in Congress and came under several ethics investigations.
"At the time, I believed him to be ethical," she said in the interview.
The former Mrs. Gingrich says Newt began to plan a run for President at the time of the divorce and told her that Callista "was going to help him become President."
In a statement to ABC News provided by the campaign, Gingrich's two daughters from his first marriage said, "The failure of a marriage is a terrible and emotional experience for everyone involved."
The daughters, Kathy Lubbers and Jackie Cushman said they would not say anything negative about Marianne and said their father "regrets any pain he may have caused in the past to people he loves."
Marianne Gingrich said Newt has never expressed any such regrets or apologized to her.

Upholding the present definition of marriage does not depend on anyone’s religious beliefs. Washington State’s present law defining marriage as “a civil contract between a male and a female” is grounded not in faith, but in reason and the experience of society. It recognizes the value of marriage as a bond of personal relationships, but also in terms of the unique and irreplaceable potential of a man and woman to conceive and nurture new life, thus contributing to the continuation of the human race. A change in legislation would mean that the state would no longer recognize the unique sacrifices and contributions made by these couples, thereby adding to the forces already undermining family life today.
For these reasons, we the Catholic Bishops of Washington State call on the citizens of this state to maintain the legal definition of marriage. We ask all to join in praying with us for married couples and families and to do everything possible to support them.

An effective, targeted solution to online copyright infringement
WASHINGTON, DC – Today, Rep. Darrell Issa, R-Calif, officially introduced H.R. 3782, the Online Protection & Enforcement of Digital Trade Act in the U.S. House of Representatives. This bill delivers stronger intellectual property rights for American artists and innovators while protecting the open, accessible Internet Americans deserve. This bipartisan, bicameral bill protects American artists and innovators through the International Trade Commission (ITC), by applying due process to investigate intellectual property infringement claims against foreign "rogue" websites and cuts off funding to sites found to be willfully and primarily trafficking infringed material. Senator Ron Wyden, D-Ore., has introduced the OPEN Act in the U.S. Senate.
"OPEN is a targeted, effective solution to the problem of foreign, rogue websites stealing from American artists and innovators," said Issa. "Today's Internet blackout has underscored the flawed approach taken by SOPA and PIPA to the real problem of intellectual property infringement. OPEN is a smarter way to protect taxpayers' rights while protecting the Internet."
Issa and Wyden released the draft OPEN Act at www.KeepTheWebOpen.com last year, using the Madison platform to open up the legislative process to taxpayers for the first time. Since then, OPEN has received more than 150 substantive comments and crowdsourced suggested improvements, many of which were included in the formal bill introduction. To date, nearly 300,000 Americans have visited the website.

Today is an unusual day at RedState.


Many websites around the nation and the world are going dark today in solidarity against SOPA, the Stopping Online Piracy Act (SOPA) pending in Congress. Many of this site’s good friends, like Marsha Blackburn of Tennessee and Marco Rubio of Florida (a co-sponsor of the Protect IP Act in the Senate, which is the Senate version of SOPA) are supporters of this horrible legislation that would give Eric Holder and future attorneys general the right to shut down websites with minimal, if any, due process.


While it pains us to do so, we are committed to working against the re-election of each Republican co-sponsor of SOPA and Protect IP, including Rep. Blackburn and Sen. Rubio. Both pieces of legislation overreach their goals and will harm the internet.


We hope the Republican co-sponsors of these pieces of legislation will remove their names and we hope the legislation will die. In solidarity with those sites shutting down today to show you the potential impact of this legislation, RedState will suspend posting new content for much of today.

FAITH‘WE’RE GONNA BE HOMELESS’: NYC PASTORS & POLITICIANS HOLD PROTEST AGAINST BAN ON CHURCHES USING PUBLIC SCHOOL SPACE

Politicians and faith leaders came together in Lower Manhattan, NYC to protest the city's public school church worship ban
Pastors and clergy have held a series of protests in New York City against a ban on church use of public school buildings for “worship.” The rule, which goes into effect on Feb. 12, would leave countless churches homeless and without a location to converge.
On Wednesday, the Blaze was on-site as faith leaders and politicians came together, once again, to protest on the steps of the Tweet Courthouse in Lower Manhattan. After participating in a press conference held by Bronx Councilman and pastor Fernando Cabrera, the group marched to nearby City Hall, singing Christian hymns and humming praise songs along the way.
New York City Comptroller John Liu and City Council members Peter Vallone Jr., Letitia James and Ydanis Rodriguez joined the protesters in their efforts. Rev. Richard Del Rio (the Blaze interviewed Del Rio about his opposition to the clergy ban at Ground Zero last year), a local faith leader at Abounding Grace Ministries, also spoke at the event.
“We’re gonna be homeless,” Del Rio said, going on to claim that he doesn’t see another alternative location for his church.
“Throughout the years we have served. We have worked with the children. We have worked with the gangs. I have worked with the police department…to be able to [work] with the community,” he said. “And now, Mr. Mayor…you forgot and you‘re turning a deaf ear and a blind eye and you’re closing your mind to what it is we do.”

House Committee to Consider Bill to Advance Keystone Pipeline

In the wake of President Obama’s decision to shut down the Keystone XL pipeline on Wednesday, the House Energy and Commerce Committee has scheduled a hearing to review legislation that would restart the project, and give oversight responsibility to an agency the bill’s proponents say is less politically motivated than the White House.
Secretary of State Hillary Clinton will be invited to testify at the hearing, scheduled for Jan. 25, to discuss her department’s environmental review procedures.
The hearing will focus on a bill introduced by Rep. Lee Terry (R-NE), which would allow construction on the pipeline to begin a month after passage. The legislation would shift responsibility for approving the project from the White House to the Federal Energy Regulatory Commission.
Under the bill, FERC would have 30 days to approve the Keystone route examined in State’s “Final Environmental Impact Statement,” which found no significant environmental risk associated with the project. Construction would begin immediately after FERC approval. Nebraska, which has expressed concerns over the route of the pipeline, could then craft its own route, seek approval from its own environmental regulatory body, and submit it to FERC for approval, which would have 30 days to approve that route.
In an interview with Energy & Environment TV, Terry explained that he wants to take responsibility for the Keystone pipeline “out of the politics that have developed in the State Department and the White House.”
While FERC does have experience with pipelines, they generally transport natural gas. Heritage energy policy expert Nick Loris has offered a proposal that, while moving Keystone forward, would delegate responsibility for approving the project to Congress.
A simple, effective approach would be for Congress to authorize the pipeline application as submitted by TransCanada pursuant to its authority to regulate commerce with other nations. Since there is no federal entity that sites and authorizes Interstate petroleum pipeline construction, the state of Nebraska could site and approve an alternative route, following the Pipeline and Hazardous Materials Safety Administration’s construction codes.
Both Terry and other Energy and Commerce members blasted the administration’s Keystone decision in anews release announcing the hearing. “The White House, blinded by politics and public perception, has turned Keystone from a commonsense issue into a political issue,” Terry stated.
Heritage has also criticized the administration’s apparently political move. The decision on Keystone “rejects jobs, energy, and logic,” noted Loris.

Democrats receive more Bain Capital dollars than Republicans

Democrats have accepted more political donations than Republicans from executives at Bain Capital, complicating the left’s plan to attack Mitt Romney for his record at the private equity firm.
During the last three election cycles, Bain employees have given Democratic candidates and party committees more than $1.2 million. The vast majority of that sum came from senior executives.
Republican candidates and party committees raised over $480,000 from senior Bain executives during that time period.
Recipients include Democratic senators facing tough reelection races this year, such as Jon Tester (Mont.), Claire McCaskill (Mo.), Sherrod Brown (Ohio) and Bill Nelson (Fla.).
The Hill reviewed contributions made from the 2008, 2010 and 2012 cycles.
Romney has collected more money from Bain Capital employees than any federal candidate since the beginning of 2007, amassing more than $166,000 in contributions. He took more than $84,000 from Bain employees in the first three quarters of 2011.
But President Obama received a sizable share as well. He has accepted more than $80,000 from Bain employees since the beginning of 2007. Bain Capital employees gave $27,500 to Obama during the first three quarters of 2011.
The donations were reported to the Federal Election Commission and culled in a database created by the Center for Responsive Politics, a nonpartisan group that tracks federal campaign spending.
Obama does not accept money from lobbyists, but does accept donations from Wall Street executives. Campaign finance records show that Democrats collect more money from Wall Street than does the GOP.
The sums collected by Democrats from managing partners and other senior executives at Bain could hamper the Democratic message that Romney is a corporate raider who does not care about workers, charges based on his record as CEO of Bain.
Democrats could be forced to justify attacking Bain — which specializes in buying companies and boosting profitability, often by laying off workers — while accepting campaign funds from the same executives who made the cost-cutting decisions.
“They’re going to have a difficult time explaining why they’re padding their war chest with contributions from the same executives that they’re accusing of hurting jobs,” said Brian Walsh, a spokesman for the National Republican Senatorial Committee.
Democratic strategists disagree.
“What you have with Romney and Bain is a kid stuck with his hand in the cookie jar. There’s no question he had direct involvement in thousands of people losing their jobs and in some cases their homes,” said David Di Martino, a Democratic strategist. “That’s different than company executives at an investment fund making contributions to Democrats.”
Republican presidential candidates, most notably former Speaker Newt Gingrich (Ga.), have led the charge in ripping Romney about his tenure at Bain. But Democratic leaders have also criticized Romney’s record in the private sector, and liberal operatives say it will be a major theme of the 2012 election if he wins the GOP nomination.
“Mitt Romney, I think, is more of a job cremator than a job creator,” Democratic National Committee Chairwoman Debbie Wasserman Schultz said on a conference call with reporters earlier this month. “He was a corporate-buyout specialist at Bain Capital. He dismantled companies. He cut jobs. He forced companies into bankruptcy and he outsourced jobs and sent jobs overseas.”
Meanwhile, Rep. James Clyburn (S.C.), the assistant House Democratic leader, last week held a conference call on Romney’s record at which he criticized Bain for closing a photo-album factory in Gaffney, S.C.
Despite the donations from Bain officials to Democrats, Romney is clearly on the defensive, according to Darrell West, director of governance studies at the Brookings Institution.
He said Obama will be able to use the bully pulpit to steer the national conversation.
“The president will be focusing on job impact instead of campaign contributions,” said West.
Republicans have already tried to make campaign donations an issue in battleground states.
The Montana Republican Party ran television ads in the fall criticizing Tester from accepting more than $200,000 in contributions from lobbyists.
Tester received a $2,500 contribution from Joshua Beckenstein, a managing director at Bain Capital, in June of last year, according to a fundraising report.
McCaskill received $2,500 from Beckenstein in March and $5,000 from Jonathan Lavine, a Bain Capital investor, in June.
Lavine also gave $1,000 to Brown in May of 2010, and $2,500 to Sen. Robert Menendez (D-N.J.) in September of last year. Over the last three cycles, he gave nearly $90,000 to the Democratic National Committee, $78,000 to the Democratic Congressional Campaign Committee and $25,000 to sitting Democratic senators.
As of Dec. 21, fundraising reports show Bain employees gave $123,000 to the Democratic National Committee in 2011, according to the Center for Responsive Politics.
The Democratic fundraising advantage, however, was offset by at least $750,000 that Bain Capital employees gave to Restore Our Future, a pro-Romney super-PAC, in 2011.
Paul Edgerley, an investor at Bain Capital, gave $500,000 to Restore our Future in May. But Edgerly also donated to former Sen. Chris Dodd (Conn.), who recently served as Democratic chairman of the Senate Banking Committee.
In April and June, he gave two $2,500 contributions to Alan Khazei, a Democrat who was vying to take on Sen. Scott Brown (R-Mass.). Khazei has since dropped out and endorsed Elizabeth Warren for the Senate Democratic nomination.
In the 2010 cycle, many Bain executives also gave to Steve Pagliuca (D), a managing director at Bain who sought to fill former Sen. Edward Kennedy’s (D-Mass.) seat but lost in the primary.

Richard Rubin Sentenced to Ten Months in Federal Prison

Richard Rubin — husband of former Broward County Commissioner Diana Wasserman-Rubin, who still faces seven felony charges of her own — was sentenced this morning to ten months in federal prison.
Rubin, 66, pleaded guilty in April to federal tax evasion after failing to report $100,000 in fees he received from the town of Davie for a land deal he brokered in 2004.
With attorney David Bogenschutz at his side, Rubin managed to get only ten months up the river — which is in accordance with sentencing guidelines but much less than the maximum penalty of five years.
Rubin had said in court that he and the wife faced financial burdens from damage done to their home by Hurricane Wilma and also owed on a loan he could not repay — which is why he attempted to cheat on his taxes a bit.
That also wasn’t too long after Rubin took in $1.1 million for writing grants for the town of Southwest Ranches — grants that were approved in part by the votes of his wife while she was a county commissioner.
Then, the probable-cause affidavit released last year contended, the couple was living quite lavishly — including spending money on artwork, cruises, vacations to Europe, and a $150,000 home repair project.
Rubin wasn’t charged with tax evasion until April of this year.
The State Attorney’s Office, however, charged Wasserman-Rubin last year with seven counts of felony unlawful compensationrelated to her votes for her husband’s grant-writing.

12 charged with voter fraud in Georgia election

Law enforcement officials have charged 12 people with using absentee ballots to skew an election in Georgia.
“As a result of their grand jury findings, 12 individuals were indicted in that particular matter and we will be trying that case in a court of judicial law instead of a court of public opinion,” District Attorney Joe Mulholland told the local TV station, WALB.
The charges followed a bitter November 2010 school board election in Brooks County in which the final tally was changed by an unusually large wave of absentee ballots.
During the election, 1,060 absentee votes were cast out of the 1,403 ballots mailed out to people who requested them, according to a July 2010 report by WCTV.
That’s far higher than nearby Thomas County, which had 119 absentee votes cast out of 202 requests, and Lowndes County, which had 169 absentee votes cast out of 439 requests, said WCTV’s report.
The 12 people charged are aligned with the Democratic Party.
News of the arrests followed The Daily Caller’s interview with former Alabama Democratic Rep. Artur Davis, in which he said voter identification laws are needed to counter ballot fraud in local elections.
