Panelists debate how money, morals, myths drive Americans' behavior

NEW YORK (CNS) -- American behavior is driven by intertwined forces of money, morals and myths in a constantly shifting struggle for pre-eminence, according to participants in a debate at Jesuit-run Fordham University.

Three writers engaged one another and the audience Feb. 1 in a lively discussion on "What Rules America: Money, Morals or Myth?"

Unlimited amounts of money rule politics and lead to a "participatory inequality," according to Robert Kuttner, co-editor of The American Prospect magazine. Involvement in civic life and public institutions is the only possible counterweight to the power of wealth, he said.

Robert A. George, editorial writer for the New York Post, said the Declaration of Independence enshrines an overarching morality in the United States that has a greater impact than Judeo-Christian principles. "We have a unique vision that our sense of equality is divinely inspired. Conflicts inevitably come about because of our inability to live up to the creed of our founding statements."

He said, "Foundational morality ultimately ends up trumping religious contemporary moralities of the day. Once a debate, such as gay marriage, is argued under the rubric of equality under the law, the traditional myths, the traditional religious groups, end up having to surrender the ground."

Susan Jacoby, author of "Freethinkers: A History of American Secularism," said American exceptionalism is the country's "overarching myth."

She quoted Harvard Law School professor Randall Kennedy to describe exceptionalism as "a community of perceptions, ideas, institutions and ambitions, which posits, among other things, that the United States is uniquely virtuous, uniquely powerful, uniquely destined to accomplish great things and thus uniquely authorized to act in ways to which Americans would object if done by other nations."

Jacoby said meritocracy is a particularly perilous public myth. Meritocracy holds that only in America, "it's not where you start but where you finish, and where you finish is largely something you can control," she said.

Contrary to the myth, Jacoby said Americans have a hard time rising from one economic class to another and it is even more difficult for them to move upward within the middle class. She cited a study by the Pew Charitable Trusts that showed about a third of Americans raised in the middle fifth of income-earners move up into the next higher group as adults, while 23 percent stay on the same level and 41 percent move down.

Jacoby said the split between the myth of meritocracy and the current state of American life can be used politically in two opposing ways. In one, the government is the villain and any action it takes to enable upward social mobility for large groups seems to impinge on people who have already succeeded. Alternatively, the government has furthered mobility during crucial periods in history, such as when it used the GI Bill after the Second World War to "facilitate a mass movement of people from the working poor to the college-educated, white-collar middle class," she said.

"All of those members of the greatest generation did work hard, but they didn't 'make it on their own.' They made it during a period when the government extended extraordinary benefits to ordinary citizens."

Kuttner said, "Morals and myths matter and all are under assault by the overweening dominance of commercial values, of money."

Although the free market is generally accepted as the preferable way to run an economy, "the dogmatism of the free market economy is a hideous marriage with the political power of wealth," he said.

"Morality and myth are at risk of being submerged by the market claiming a universal imperative set of values that makes religious dogma seem positively liberal by comparison. We have to watch out for money and market if we are going to retain what is valuable in morality," Kuttner said.

"Money doesn't rule everything, but it rules a lot more than it did earlier in our history. If free public education or Social Security were before our Congress, they would be voted down," Kuttner said.

The speakers agreed that the country's political center of gravity has moved to the right and made politicians less likely to draft progressive legislation.

George said because the Declaration of Independence credits the Creator as the source of human rights, the founding document seems divinely inspired and weaves theism into society. As a result, "it will be many years, if ever, before an atheist will be president of the United States. To be president, you have to show some kind of belief."

Jacoby, an atheist, said: "There's a general stupidity in this country that does not exist in other Western societies, that thinks that anyone who doesn't believe in God is on the 'qui vive' to go out to kill and rape and murder."

WASHINGTON — Rick Santorum’s presidential campaign took off last night as he swept GOP primary contests in three crucial battleground states.
Santorum crushed front-runner Mitt Romney in Missouri and Minnesota.
The former Pennsylvania senator also upset the heavily favored Romney in Colorado, 40 percent to 35 percent, according to nearly complete returns.
Newt Gingrich followed in Colorado with 13 percent, while Ron Paul had 11 percent.
“Conservatism is alive and well in Missouri and Minnesota!” Santorum told a cheering crowd of supporters in the Show Me State of Missouri.

BACK IN IT: Rick Santorum campaigns yesterday in Minnesota, where he rolled to an easy primary victory over Mitt Romney. He also posted big wins in Missouri and Colorado.
Taunting Romney, a buoyant Santorum said, “We doubled him up here and in Minnesota.”
He told supporters they were heard “loud and louder all across this country,” adding, “Maybe in Massachusetts they were heard particularly loud tonight” — referring to Romney’s national headquarters.
Santorum’s victory in Colorado was a stinging blow to Romney, who carried the Rocky Mountain state with 60 percent of the GOP vote in 2008.
In Missouri, Santorum trounced Romney, 55 percent to 25 percent, with y all precincts reporting. Ron Paul came in third, with 12 percent. Gingrich was not on the ballot there.
In Minnesota, Santorum won, 45 percent to 27 percent for Ron Paul. Romney, who handily took Minnesota in 2008, was a distant third, with 17 percent, according to nearly complete returns. Gingrich got only 11 percent.
Santorum’s strong performances raised new doubts about Romney’s ability to win over the GOP’s conservative base.
Santorum called his wins a victory for “conservatives and Tea Party people” who are “building the base of the Republican Party,” then belittled Romney’s campaign for what he said was its chief attributes, mocking, “I’ve got the most money and the best organization.”
Romney, appearing in Colorado, told a crowd, “This was a good night for Rick Santorum. But I expect to become our nominee with your help.”
Missouri’s 52 delegates won’t be awarded until March, so last night’s primary vote there was effectively a straw poll.
But by winning more than 100,000 votes in a swing-state battleground, Santorum seized the spotlight and showed strength in an important industrial region.
Tim Pawlenty, the former governor of Minnesota, campaigned for Romney there, to no avail .
Santorum blanketed all three states yesterday after bailing out of the Jan. 31 Florida primary early and spending more than 20 days in the heartland.
Gingrich abandoned the field there, spending yesterday stumping in Ohio, which doesn’t vote until Super Tuesday on March 6.
A total of 76 delegates were at stake last night, 40 in Colorado and 36 in Minnesota.

2) Santorum has character and integrity, something Obama made a mockery out of when he declared with others like Holder, that theirs would be the most transparent Administration, ever.
What we have seen is a repeat of all of Bush Jr.’s policies and GOP corruption on steroids!! The most glaring example of this has been the Obama-Newt-Romney Bain connection, and Clear Channel radio media: all invested in both parties and all manipulating Press and radio with Bain cash... so much so, that the ghost of Bain came back to haunt Romney from nearly a decade ago, and Newt’s $300,000 ethics fine in 1998.

Here are twelve hot spots on your return that can raise the chances of scrutiny by the IRS.

The IRS audits only slightly more than 1% of all individual tax returns annually. The agency doesn't have enough personnel and resources to examine each and every tax return filed during a year. So the odds are pretty low that your return will be picked for review. And, of course, the only reason filers should worry about an audit is if they are fudging on their taxes.
However, the chances of being audited or otherwise hearing from the IRS increase depending upon various factors, including your income level, whether you omitted income, the types of deductions or losses you claimed, the business in which you're engaged and whether you own foreign assets. Math errors may draw IRS inquiry, but they'll rarely lead to a full-blown exam. Although there's no sure way to avoid an IRS audit, you should be aware of red flags that could increase your chances of drawing unwanted attention from the IRS.

1. Making too much money

Although the overall individual audit rate is about 1.11%, the odds increase dramatically for higher-income filers. IRS statistics show that people with incomes of $200,000 or higher had an audit rate of 3.93%, or one out of slightly more than every 25 returns. Report $1 million or more of income? There's a one-in-eight chance your return will be audited. The audit rate drops significantly for filers making less than $200,000: Only 1.02% of such returns were audited during 2011, and the vast majority of these exams were conducted by mail. We're not saying you should try to make less money -- everyone wants to be a millionaire. Just understand that the more income shown on your return, the more likely it is that you'll be hearing from the IRS.

2. Failing to report all taxable income

The IRS gets copies of all 1099s and W-2s you receive, so make sure you report all required income on your return. IRS computers are pretty good at matching the numbers on the forms with the income shown on your return. A mismatch sends up a red flag and causes the IRS computers to spit out a bill. If you receive a 1099 showing income that isn't yours or listing incorrect income, get the issuer to file a correct form with the IRS.

3. Taking large charitable deductions

We all know that charitable contributions are a great write-off and help you feel all warm and fuzzy inside. However, if your charitable deductions are disproportionately large compared with your income, it raises a red flag. That's because IRS computers know what the average charitable donation is for folks at your income level. Also, if you don't get an appraisal for donations of valuable property, or if you fail to file Form 8283 for donations over $500, the chances of audit increase. And if you've donated a conservation easement to a charity, chances are good that you'll hear from the IRS. Be sure to keep all your supporting documents, including receipts for cash and property contributions made during the year, and abide by the documentation rules. And attach Form 8283 if required.

4. Claiming the home office deduction

Like Willie Sutton robbing banks (because that's where the money is), the IRS is drawn to returns that claim home office write-offs because it has found great success knocking down the deduction and driving up the amount of tax collected for the government. If you qualify, you can deduct a percentage of your rent, real estate taxes, utilities, phone bills, insurance and other costs that are properly allocated to the home office. That's a great deal. However, to take this write-off, you must use the space exclusively and regularly as your principal place of business. That makes it difficult to successfully claim a guest bedroom or children's playroom as a home office, even if you also use the space to do your work. "Exclusive use" means that a specific area of the home is used only for trade or business, not also for the family to watch TV at night. Don't be afraid to take the home office deduction if you're entitled to it. Risk of audit should not keep you from taking legitimate deductions. If you have it and can prove it, then use it.

5. Claiming rental losses

Normally, the passive loss rules prevent the deduction of rental real estate losses. But there are two important exceptions. If you actively participate in the renting of your property, you can deduct up to $25,000 of loss against your other income. But this $25,000 allowance phases out as adjusted gross income exceeds $100,000 and disappears entirely once your AGI reaches $150,000. A second exception applies to real estate professionals who spend more than 50% of their working hours and 750 or more hours each year materially participating in real estate as developers, brokers, landlords or the like. They can write off losses without limitation. But the IRS is scrutinizing rental real estate losses, especially those written off by taxpayers claiming to be real estate pros. The agency will check to see whether they worked the necessary hours, especially in cases of landlords whose day jobs are not in the real estate business.

6. Deducting business meals, travel and entertainment

Schedule C is a treasure trove of tax deductions for self-employeds. But it's also a gold mine for IRS agents, who know from experience that self-employeds sometimes claim excessive deductions. History shows that most underreporting of income and overstating of deductions are done by those who are self-employed. And the IRS looks at both higher-grossing sole proprietorships and smaller ones.
Big deductions for meals, travel and entertainment are always ripe for audit. A large write-off here will set off alarm bells, especially if the amount seems too high for the business. Agents are on the lookout for personal meals or claims that don't satisfy the strict substantiation rules. To qualify for meal or entertainment deductions, you must keep detailed records that document for each expense the amount, the place, the people attending, the business purpose and the nature of the discussion or meeting. Also, you must keep receipts for expenditures over $75 or for any expense for lodging while traveling away from home. Without proper documentation, your deduction is toast.

7. Claiming 100% business use of a vehicle

Another area ripe for IRS review is use of a business vehicle. When you depreciate a car, you have to list on Form 4562 what percentage of its use during the year was for business. Claiming 100% business use of an automobile is red meat for IRS agents. They know that it's extremely rare for an individual to actually use a vehicle 100% of the time for business, especially if no other vehicle is available for personal use. IRS agents are trained to focus on this issue and will scrutinize your records. Make sure you keep detailed mileage logs and precise calendar entries for the purpose of every road trip. Sloppy recordkeeping makes it easy for the revenue agent to disallow your deduction. As a reminder, if you use the IRS' standard mileage rate, you can't also claim actual expenses for maintenance, insurance and other out-of-pocket costs. The IRS has seen such shenanigans and is on the lookout for more.

8. Writing off a loss for a hobby activity

Your chances of "winning" the audit lottery increase if you have wage income and file a Schedule C with large losses. And if the loss-generating activity sounds like a hobby -- horse breeding, car racing and such -- the IRS pays even more attention. Agents are specially trained to sniff out those who improperly deduct hobby losses. Large Schedule C losses are always audit bait, but reporting losses from activities in which it looks like you're having a good time all but guarantees IRS scrutiny.
You must report any income you earn from a hobby, and you can deduct expenses up to the level of that income. But the law bans writing off losses from a hobby. For you to claim a loss, your activity must be entered into and conducted with the reasonable expectation of making a profit. If your activity generates profit three out of every five years (or two out of seven years for horse breeding), the law presumes that you're in business to make a profit, unless IRS establishes otherwise. If you're audited, the IRS is going to make you prove you have a legitimate business and not a hobby. So make sure you run your activity in a businesslike manner and can provide supporting documents for all expenses.

9. Running a cash business

Small business owners, especially those in cash-intensive businesses -- think taxis, car washes, bars, hair salons, restaurants and the like -- are a tempting target for IRS auditors. Experience shows that those who receive primarily cash are less likely to accurately report all of their taxable income. The IRS has a guide for agents to use when auditing cash-intensive businesses, telling how to interview owners and noting various indicators of unreported income.

10. Failing to report a foreign bank account

The IRS is intensely interested in people with offshore accounts, especially those in tax havens, and tax authorities have had success getting foreign banks to disclose account information. The IRS has also used voluntary compliance programs to encourage folks with undisclosed foreign accounts to come clean -- in exchange for reduced penalties. The IRS has learned a lot from these programs and has collected a boatload of money ($4.4 billion so far).
Failure to report a foreign bank account can lead to severe penalties, and the IRS has made this issue a top priority. Make sure that if you have any such accounts, you properly report them when you file your return.

11. Engaging in currency transactions

The IRS gets many reports of cash transactions in excess of $10,000 involving banks, casinos, car dealers and other businesses, plus suspicious-activity reports from banks and disclosures of foreign accounts. A report by Treasury inspectors concluded that these currency transaction reports are a valuable source of audit leads for sniffing out unreported income. The IRS agrees, and it will make greater use of these forms in its audit process. So if you make large cash purchases or deposits, be prepared for IRS scrutiny. Also, be aware that banks and other institutions file reports on suspicious activities that appear to avoid the currency transaction rules (such as persons depositing $9,500 in cash one day and an additional $9,500 in cash two days later).

12. Taking higher-than-average deductions

If deductions on your return are disproportionately large compared with your income, the IRS may pull your return for review. But if you have the proper documentation for your deduction, don't be afraid to claim it. There's no reason to ever pay the IRS more tax than you actually owe.

The Republican presidential contest is a two-man race no more.
Rick Santorum proved that the 2012 primary election still has a few surprises left, after he went three for three in Tuesday’s contests and once again shook up the GOP nomination battle.
Santorum, in perhaps the biggest upset of the night, was declared the winner of the Colorado caucuses -- a contest Mitt Romney had been leading in recent polls and won in the 2008 race. The former Pennsylvania senator also won the Minnesota caucuses and the non-binding Missouri GOP primary.

The candidates head next into Maine, and later in the month to Arizona and Michigan. Santorum’s performance stokes questions about Romney’s appeal in some corners of the Republican Party but also puts the pressure on Newt Gingrich – as he challenges Santorum’s claim to be the “conservative” alternative to Romney.
Santorum, though, said Tuesday night in Missouri that he wasn’t looking to be the alternative to Romney.
"I stand here to be the conservative alternative to Barack Obama,” Santorum said.
The three-for-three finish marked the best night of Santorum's campaign since Iowa, in which he was belatedly declared the winner.
Santorum said at his victory rally in Missouri that the night's results showed conservatism is "alive and well." Santorum used the victories to build his case that the Republicans need a nominee who can demonstrate "sharp contrasts" with President Obama -- something he claims the other candidates cannot do.
Santorum went after Romney, accusing him of holding the "same positions" as the president on several issues, but largely glossed over the other GOP candidates in his remarks.
Romney is still ahead in the delegate count, despite Santorum's big night. But Santorum's victories disrupt the narrative that the GOP presidential contest had become a two-person race between Gingrich and Romney.
With all precincts reporting in Colorado, Santorum led with 45 percent of the vote. Romney was in second with 35 percent, followed by Gingrich and Paul.
With 95 percent of precincts reporting in Minnesota, Santorum led with 45 percent. Ron Paul was pulling in second with 27 percent, followed by Romney and Gingrich.
A total of 70 delegates are up for grabs in those two states Tuesday, though the caucuses are just the start of a lengthy delegate-allocating process.
In Missouri, the primary is effectively a statewide straw poll, as it sets the stage for the delegate-awarding caucuses a month from now. Still, more than 240,000 people voted in the contest, and Santorum cruised to a crushing victory. With all precincts reporting, Santorum had 55 percent of the vote. Romney had 25 percent, followed by Paul with 12 percent. Gingrich was not on the ballot in that contest.
Turnout in the caucus states was smaller. About 66,000 showed up in Colorado; turnout in Minnesota appeared slightly lower.
Gingrich, though, hardly competed in any of the three states Tuesday, instead focusing his attention on other contests down the primary calendar. He campaigned Tuesday in Ohio, which holds its election on March 6, "Super Tuesday," as the other candidates made last-minute appeals in Colorado and Minnesota.
Romney acknowledged at his rally in Colorado that Santorum had a "good night." He went on to define himself as the only candidate, though, who has never been "compromised" by the culture of Washington. And he said he still expects to be the nominee.
"This is a time for real change in Washington -- fundamental, bold, dramatic change," Romney said.
At his post-election rally in Minnesota, Paul touted his second-place finish in the state while predicting his campaign will do well in the delegate battle -- despite the fact Paul has not yet won a primary contest.
Tuesday's contests were the first of the season in which multiple states were holding contests on one day. Up next, Maine concludes its caucuses this Saturday, and primaries will be held in Michigan and Arizona later in the month.
Romney so far has won three contests, in New Hampshire, Florida and Nevada. Gingrich has won one, in South Carolina.
Romney entered Tuesday's competition with a healthy lead in the delegate count -- at 101 delegates.
Gingrich trailed with 32 delegates, following by Santorum with 17 and Paul with nine. It takes 1,144 delegates to win the nomination.
Though Missouri's primary Tuesday was largely symbolic, the contest was still expected to cost state taxpayers about $6 million.

Clayton police burn $12M in drugs

Clayton County police burned more than $12 million worth of drugs that had accumulated in the departments crowded evidence room, authorities said.

Police received a court order from a Superior Court judge to allow them to burn nearly 10,000 pounds of marijuana, crystal meth and other assorted narcotics, Clayton County police spokeswoman Lt. Tina Daniel said.

"This is in response to the audit of the police department," Daniel said.

As part of a scathing indictment of former Police Chief Jeff Turner's management of the department, county Chief of Staff Alex Cohilas cited a narcotics evidence room that was "in shambles."

The burns happened on two different occasions, last week and Tuesday, in an undisclosed, secure location, Daniel said.

"This is just a small part of the police department's aggressive efforts to fight illegal drug use and sales in Clayton County," police chief Timothy Robinson said.

The burn was done with the aid of the Clayton Fire and Emergency Services, the Clayton County Sheriff's Office and the Clayton County District Attorney's Office.

Victor Hill sent to jail after 37-count indictment handed down

CLAYTON COUNTY, Ga. —
A grand jury indicted former Clayton County sheriff Victor Hill on 37 counts, alleging he used county cars for getaways and county credit cards for shopping sprees.

Hill’s charges include theft by taking, making false statements and violation of the Racketeer Influenced and Corrupt Organizations (RICO) Act, wrapping up a nearly year-long investigation.

A hearing was immediately held for Hill where a judge set bond at $50,000 and ordered the former sheriff to surrender his passport, remain in Georgia and not to contact any witnesses. Hill was still behind bars the next morning. His attorney said bonding companies want no part in the case.

“I’ve had them tell me they will not for fear that they will be decertified from being able to have bonds at the Clayton County Jail in the future,” attorney Musa Ghanayem said.

Channel 2 investigative reporter Mark Winne talked to Hill before he addressed the grand jury panel Wednesday. Hill maintained his innocence and said he still plans on running for sheriff again.

“Looking forward to defending myself. I think everyone knows it’s politically motivated and we’re ready to get back on the campaign trail,” Hill told Winne.

The grand jury started an investigation into Hill in April, and prosecutors finished their presentation on Wednesday afternoon. Hill then had the option to make a final statement before the panel voted on the charges.

Sources told Winne the special grand jury looked at the use of county credit cards, the handling of campaign finances, if there was personal travel using county equipment, if county employees engaged in campaign or personal business for Hill.

Clayton County Sheriff Kem Kimbrough has been critical of Hill, whom he won against in 2008. Kimbrough said he takes no joy in Hill’s downfall but considers it vindication.

“It is not politically motivated. It is all about accountability and the integrity of the offices we hold,” Kimbrough told Winne.

Kimbrough said he would be ready for Hill in another face-off.

“This is how I'm going to campaign against him,” Kimbrough told Thomas, holding a copy of the indictment against Hill. “Not only was he a poor sheriff, but he broke the law.”

Beatrice Powell, a former Clayton County corrections officer, was also indicted on perjury and theft by taking charges in connection with Hill’s case. Investigators said they contacted her last summer about her friendship with Hill.

Investigators said they wanted to know if Powell campaigned for Hill on county time and whether he allowed her to get paid on the county’s dime. Powell told investigators she committed no crime.

Hill's attorney, Steve Fry, said he will fight the charges and Hill has not violated the law.
Hill is currently being held in the Gwinnett County Jail instead of the Clayton County Jail for security reasons.

This disciplinary matter is before the Court on the Report and Recommendation of special master James E. Patterson who recommends that this Court accept the petition for voluntary discipline which was filed by Respondent, Joseph A. Maccione (State Bar No. 462925) after the Bar filed a Formal Complaint. In his petition, Maccione requests the imposition of a Review Panel reprimand with conditions for his admitted violations of Rules 5.3 and 8.4(a)(4). Although the maximum sanction for a single violation of either rule is disbarment, the State Bar has indicated that it has no objection to the requested discipline.
In his petition Maccione, who was admitted to the Bar in 1976, admits that he is a solo practitioner who for several years regularly used the services of an employee/contractor as an investigator and paralegal. Maccione was aware that the employee/contractor had no license as an investigator, no education in paralegal studies, and an extensive criminal history. Maccione nevertheless allowed the employee/contractor to use business cards and letterhead that indicated he was an investigator and paralegal associated with Maccione's firm. Maccione also allowed the employee/contractor to prepare correspondence to clients and others, to communicate with clients, to collect retainer funds for Maccione's firm, and to generally represent to the public that he was working on cases with Maccione.
In early June 2005, Maccione agreed to represent a client on a drug charge and in a civil action the client wished to file regarding the death of his dog. After accompanying the client to a meeting with a county official about the civil matter, Maccione referred the client to the employee/contractor so that he could prepare the civil complaint which Maccione then had filed as a pro se complaint. Maccione did not clearly inform the client that he would not be handling the civil matter himself; he did not monitor the employee/contractor's activities regarding preparation of the complaint; and he did not take any action to assist the client with his civil suit. In mid-June 2005, the client was arrested and charged with murder. Maccione and the employee/contractor met with the client and advised him that Maccione and another attorney would defend the client for a flat fee of $30,000, which included attorney fees for Maccione and the other attorney. The employee/contractor then prepared a document titled “Affidavit” to be signed by the client. The affidavit authorized Maccione's law firm, generally, and the employee/contractor, specifically, to take all of the client's personal property from his home, to be applied to the cost of his defense. Maccione signed the document as a notary notwithstanding the fact that the document had been left undated and that the signature line for the witness was blank. Maccione admits that he cannot say with any certainty that he observed the client executing this affidavit.
In late June 2005, while the client was confined in a mental hospital following a suicide attempt, the employee/contractor entered the client's home and took numerous items of personal property, purportedly pursuant to the above described affidavit (and apparently as payment for the employee/contractor's services). Maccione had not discussed with the client any fee for the employee/contractor's work on his case, nor did he provide the client with any billing statements or accounting for the employee/contractor's services. The value of the property taken by the employee/contractor was not credited toward the client's quoted legal fees. The client subsequently discharged Maccione and during the course of these disciplinary proceedings, Maccione severed his relationship with the employee/contractor. As a result, Maccione no longer uses the employee/contractor's services in any capacity and asserts that he will not use those services in the future.
Based on these admitted facts and having reviewed the record as a whole, we agree with the special master that Maccione violated Rules 5.3 and 8.4(a)(4) of the Georgia Rules of Professional Conduct, See Bar Rule 4-102(d). However, we disagree with the special master that a review panel reprimand is the appropriate punishment under the circumstances presented here. In light of the serious nature of the facts presented in this case, and in light of Maccione's prior disciplinary history (he received an Investigative Panel reprimand in 1989), we conclude that a review panel reprimand is not the appropriate level of punishment to impose on Maccione for his actions. Although Maccione has ended his relationship with the employee/contractor, who the Bar believes to be the “primary wrong-doer in this matter,” that does not change the fact that Maccione supervised or otherwise acquiesced in the wrongful conduct of this employee/contractor to the detriment of his client.
Accordingly, we reject Maccione's petition for voluntary discipline.
Voluntary Discipline Rejected.

This morning, when Karen Handel, senior vice president of public policy at Susan G. Komen for the Cure, resigned—a resignation that founder and CEO Nancy Brinker has officially accepted—Handel included, in her letter, a rather curious admission:
I openly acknowledge my role in the matter ...
Why, it seems like only last week, founder and CEO Karen Brinker was insisting that Handel did not have anything to do with this decision.
Oh, right. That's because it was last week:
Well, let me just for the record tell you, Karen did not have anything to do with this decision.
Of course, we already knew that wasn't true. As Laura Bassett at Huffington Post reported:
Karen Handel was the prime instigator of this effort, and she herself personally came up with investigation criteria," the source, who requested anonymity for professional reasons, told HuffPost. "She said, 'If we just say it's about investigations, we can defund Planned Parenthood and no one can blame us for being political.'"
In her resignation letter, Handel insists that "the controversy related to Planned Parenthood has long been a concern to the organization." But as Bassett also reported, according to a source at Komen:
Komen's been dealing with the Planned Parenthood issue for years, and you know, some right-wing groups would organize a protest or send out a mailing every now and then, but it was on a low simmer [...[ What Karen's been doing for the past six months is ratcheting up the issue with leadership. Every time someone would even mention a protest, she would magnify it, pump it up, exaggerate it. She's the one that kept driving this issue.
There really is no question that Karen Handel joined Komen last year with an agenda to defund Planned Parenthood. That was part of her platform during her failed, Sarah Palin-endorsed run for governor in Georgia; it was clearly part of her mission at Komen too.
For the past week, Brinker has insisted that Handel had nothing to do with the decision, and that the decision had nothing to do with politics. But it has become increasingly clear that Nancy Brinker is lying. And now Handel has confirmed it.

A report released today by two leading pro-life organizations alleges more Planned Parenthood affiliates have engaged in fraud than the ones that have already become public knowledge and part of an investigation of the abortion business by Congress.
Today the Alliance Defense Fund and the Susan B. Anthony List released a new report to Congress identifying waste, abuse, and potential fraud by Planned Parenthood. ADF attorneys prepared the report to aid Congress in its investigation of the nation’s leading abortion business.
The report alleges that millions of dollars of waste, abuse, and potential fraud have been revealed in state and federal audits across the country. It identifies twelve types of potential fraud being committed by Planned Parenthood affiliates nationwide, including fraudulent billing and reimbursement by Title XIX agencies for medications and/or services provided in connection with an abortion, illegal under federal law.
“After 40 years of receiving taxpayer funds, not one oversight hearing of Planned Parenthood has occurred.  Now is the time for such scrutiny on behalf of its most important benefactor, American Taxpayers,” SBA List president Marjorie Dannenfelser said today.
She said the report detailed “findings of systemic financial waste, abuse and potential fraud spanning many years” – problems that “reveal a pattern of gross financial mismanagement.”
“Planned Parenthood receives 46 percent of its budget from taxpayers,” Dannenfelser said. “Taxpayers spend over $1 million a day on this nonprofit entity which reports over a billion dollars of net assets.  No organization is entitled to taxpayer funds especially one mired in controversy and under investigation.  Organizations who receive such largess from taxpayers deserve scrutiny.”
“Planned Parenthood campaigns to destroy those who ask questions should be a matter of questioning itself.  Their current posture of entitlement is that of a spoiled teenager, not a mature non-profit committed to programs with integrity,” she added. “Congressman Stearns took a prudent and responsible action in committing to oversight hearings.  There is much to scrutinize.  We encourage him to pursue them now, and the Congress to watch closely.”
“Americans deserve to know if their hard-earned tax money is being funneled to groups that are misusing it,” said ADF Senior Counsel Steven H. Aden. “Planned Parenthood has to play by the same rules as everyone else. It certainly isn’t entitled to a penny of public funds, especially if it is committing Medicare fraud.”
The ADF report found:
* Federal and state audits of family planning funding have found a minimum of $95,742,982.15 in waste, abuse, and potential fraud from 1995 to 2009;
* Of this waste, abuse, and potential fraud, at least $7,867,547.15 has been identified in separate state audits to have occurred in a total of seven audited Planned Parenthood affiliates in New York state, California, Washington state, and Texas due to a variety of abuses, including extensive overbilling and illegal billing for abortion-related procedures that are ineligible for government reimbursement under federal laws, including the Hyde Amendment;

* In addition, federal audits of family planning programs from 1995 to 2009 have identified a total of nearly $88 million in overbilling, with the sum rising as high as $99 million according to the Inspector General’s Office at the U.S. Department of Health and Human Services;
* Of the 38 federal family planning audits covering federal funding streams and 19 states, two audits, in New Jersey and New York, specifically identified Planned Parenthood, and only Planned Parenthood, as a source of overbilling in the family planning programs. The combined waste in these two audits alone was $1,516,312.
* All told, extensive waste, abuse, and potential fraud have been identified to date in 9 percent of Planned Parenthood’s 79 U.S. affiliates. Two others,
one in Texas and one in California, are the subject of federal whistleblower lawsuits by former Planned Parenthood employees alleging fraud;
ADF concludes: “The extent of possible waste, abuse, and potential fraud at the nation’s remaining percent of Planned Parenthood affiliates is unknown and merits congressional review by the House Energy and Commerce Committee. This investigation is especially pertinent given Planned Parenthood Federation of America’s extensive management, operational, and fiscal authority over the policies and conduct of its affiliates, as well as its ongoing requirement that each of its affiliates avoid deficits in its expendable net assets.”
